Please find enclosed a completed Sewer System Permit Name/Ownership Change Form
(PNOCF 01-16) and supporting documentation for the above-referenced collection system.
Attached to this request are copies of documents provided by the current owner (Pluris,
LLC): it appears the referenced permit expired in 2021, but other WQ permits that divide the
collection system into three basins do not have a specific expiration date. While ONWASA does
not have an issue with renewal of the original collection system permit at this time, we would also
ask consideration for simply including this collection system within ONWASA's existing Collection
System Permit (WQCS00249). A copy of the current version of that permit is also included.
Based on the schedule to obtain final approvals and secure the necessary funding, we
anticipate closing on the sale of the plant and associated collection system on November 9, 2023,
and assuming operation immediately. Please also note there will be no change in the waste
stream or collection system configuration with this change in ownership.

Sewer permits start with a WQ or WQCS and contain the terms sewer extension or collection system in the subject field. This
form should not be used for permits with NC,NCG,SW or other types of non-sewer permits beginning with WQ.

BY THE COMMISSION: On June 26, 2023, Pluris, LLC (Pluris or Applicant), filed
an application with the North Carolina Utilities Commission (Commission) for authority to
transfer its wastewater treatment plant and wastewater system assets providing
wastewater utility service in its service areas in Onslow County to the Onslow Water and
Sewer Authority (ONWASA). ONWASA is exempt from Commission regulation pursuant
to N.C. Gen. Stat. § 62-3(23)(d). Pluris currently provides wastewater utility service to
approximately 7,000 customers in its service areas. ONWASA provides water utility
service to this service area. Pursuant to the terms of the transfer, Applicant will transfer
all of Applicant's customers to ONWASA.
On July 24, 2023, the Commission issued its Order Requiring Customer Notice,
specifying that the matter be determined without public hearing if no significant protests
are received subsequent to customer notice.
On August 7, 2023, the Applicant filed the Certificate of Service, properly signed
and notarized, which stated that the Notice to Customers had been mailed with sufficient
postage or hand delivered to all affected customers. Two customer protests have been
received by the Public Staff — North Carolina Utilities Commission (Public Staff). One
customer opposed the rate increase, and one customer requested additional information
concerning the nature of a municipality serving as the utility provider.
Pluris Holdings, LLC, is the corporate parent of the Applicant as well as Pluris
Hampstead, LLC, which operates a wastewater utility system in Pender County, North
Carolina and other wastewater utility systems operating outside of North Carolina.
The Applicant, Pluris Webb Creek, LLC, Pluris Hampstead LLC, and other related
utility systems share certain corporate costs. The allocation of corporate costs will
continue after the transfer to ONWASA by Applicant.
The Applicant and the Public Staff filed a letter on August 21, 2023, providing the
terms of an agreement they have reached regarding allocation of shared costs in an effort
to avoid significant adverse impacts on rates charged to customers of Pluris Hampstead,
LLC, in the future as a result of the transfer to ONWASA.
This matter was presented at the Commission's Regular Staff Conference on
August 28, 2023. The Public Staff stated that it had reviewed the application and
recommends that the Commission approve the transfer of the wastewater utility system
from Pluris to ONWASA without public hearing since significant protests were not received
after customer notice.
Based upon the verified application, the recommendation of the Public Staff, and
the records of the Commission, the Commission makes the following:
FINDINGS OF FACT
1. On August 9, 2023, the Applicant filed a fully executed System Purchase
Agreement for the Purchase and Sale of Assets (Agreement). Pursuant to the terms of
the Agreement, ONWASA agreed to purchase the "System Assets" of the Applicant and
Pluris Webb Creek, LLC described in the Agreement for $37.5 million and $11 million,
respectively, a total of $48.5 million. Pluris' present net investment in the assets being
transferred is approximately $2.296 million.
2. The present rates for Pluris were approved in Docket Nos. W-1282, Sub 11,
and M-100, Sub 138, by the Commission's Order Approving Tariff Revision and Requiring
Customer Notice and have been in effect since January 1, 2017. Pluris' and ONWASA's
present monthly wastewater rates are as follows:

3. Under ONWASA's current rates, the average monthly residential
wastewater bill for Pluris' customers would increase from $58.08 (flat rate) to $59.96,
(metered), based on estimated usage of 4,000 gallons per month. Existing Pluris
customers would not be required to pay a connection fee to ONWASA.
4. Under ONWASA's current rates, the average monthly metered non-
residential wastewater bill for Pluris' customers would decrease from $64.35 to $59.96,
based on estimated usage of 4,000 gallons per month for <1" meter size customer.
5. Pursuant to the terms of the Agreement, any Pluris' customer deposits will
be transferred to ONWASA.
6. The Pluris wastewater plant is an advanced state of the art membrane
bio-reactor treatment plant between four and ten years old. Since it has been in service,
the North Carolina Department of Environmental Quality has issued one Notice of
Violation to Pluris for a limit exceedance violation that occurred on May 31, 2021.
NOV-2021-LV-0596 was issued on August 11, 2021, when flow through the North Topsail
wastewater treatment plant exceeded the specified monthly average amount. No other
violations have been identified. ONWASA will continue operating the present system.
There are no major plant replacements planned for the immediate future.
7. The proposed transfer is in the public interest and should be approved
under N.C.G.S. §62-111.
8. In consideration of the circumstances presented, an exception to the
Commission's policy of assigning 100% of the gain on sale to water and wastewater utility
company shareholders is not warranted in this proceeding. Accordingly, the gain on sale
of the System shall be assigned 100% to Applicant's shareholders.
CONCLUSIONS
Based on the foregoing and the recommendations of the Public Staff, the
Commission concludes that the transfer of ownership of the wastewater system from
Pluris to ONWASA should be approved, that the franchises should be canceled upon
receipt of notification that the transfer is complete, and customer notice should be
required.
IT IS, THEREFORE, ORDERED as follows:
1. That Pluris, LLC, is hereby authorized to transfer its wastewater treatment
plant and wastewater system assets serving its service area in Onslow County, North
Carolina to Onslow Water and Sewer Authority, which is exempt from Commission
regulation;

2. That Pluris, LLC shall provide written notification to the Commission within
ten days after Onslow Water and Sewer Authority assumes responsibility for providing
wastewater utility service in the affected service area;
3. That the Certificates of Public Convenience and Necessity to provide
wastewater service granted to Pluris, LLC in Docket No. W-1282, Subs 0, 1 , 3, 5, and 12
for its service areas in Onslow County, North Carolina is hereby canceled upon receipt of
written notification to the Commission that Onslow Water and Sewer Authority has
assumed responsibility for providing wastewater utility service in the affected service
area;
4. That the Commission approves the agreement entered into between the
Applicant and Public Staff on August 21, 2023, to protect Pluris Hampstead, LLC
customers from being significantly impacted by the transfer;
5. That 100% of the gain on sale of the wastewater treatment plant and
wastewater system assets owned by Pluris, LLC, that serve its service area in Onslow
County shall be assigned to Pluris, LLC's shareholders; and
6. That a copy of this Order shall be mailed with sufficient postage or hand
delivered by Pluris, LLC, to all its customers in the service area not later than 15 days
after the date of this Order and that Pluris, LLC, shall submit to the Commission the
attached Certificate of Service properly signed and notarized not later than 30 days after
the date of this Order.

BILL OF SALE
THIS BILL OF SALE, is made this 9th day of November, 2023, by PLURIS, LLC, a
North Carolina limited liability company, and PLURIS WEBB CREEK, LLC, a North Carolina
limited liability company (collectively, "Seller") to ONSLOW WATER AND SEWER
AUTHORITY("Buyer.")
WITNESSETH:
That Seller, for the consideration set forth in, and as contemplated by, that "Systems
Purchase Agreement"dated August 8,2023 (the"Systems Purchase Agreement"),the receipt and
sufficiency of which is hereby acknowledged, has bargained and sold and by these presents doth
bargain,sell and convey in"as-is"where-is"condition without warranty or representation unto the
Buyer, Buyer's heirs, successors in interest, and/or assigns, certain articles of personal property,
more particularly described as follows:
(i) All sewer lift station equipment, booster pump station equipment, and all trunk,
collection and other pipes, drains and lines used or held for use by Seller in connection with the
Systems as set forth on Schedule 1.1(a)(ii) attached;
(ii) The equipment, machinery, furniture, computer hardware and software and related
peripheral equipment and other tangible personal property set forth on Schedule l.1(a)(iii)
attached;and
(iii)All supplies,tools, raw materials,parts,work in process and inventories used or held
for use by Seller in connection with the Systems as set forth on Schedule 1.1(a)(iv)attached.
Buyer to have and to hold said personal property in fee simple. Seller hereby covenants
that it is seized of said propertyin fee and has the right to convey
they same in fee simple,that the
same is free and clear of all encumbrances whatsoever,and that Seller will warrant and defend the
title thereto against the lawful claims of all persons whomsoever.

and understands that all sales are final and that all monies paid or to be paid are"non-refundable."
Except as otherwise stated in this Bill of Sale,the capitalized terms used in this Bill of Sale
shall have the same meanings for those terms as defined in the Systems Purchase Agreement.The
provisions of Article 8 of the Systems Purchase Agreement are incorporated into this Bill of Sale
by this reference. Each party will execute and deliver all additional documents and do all other

Dear Mr. Gallarda:
In accordance with your application received February 12th, 2013, and the additional information
received August 21St, 2013, we are forwarding herewith Permit No. WQCS00275, dated
September 4, 2013, to Pluris, LLC for the operation and maintenance of the subject wastewater
collection system.
This permit shall be effective from September 1st, 2013 until August 31St, 2021 and shall be
subject to the conditions and limitations specified herein. It is your responsibility to thoroughly
review this permit. Please pay particular attention to the monitoring and reporting requirements
in this permit and any compliance schedules shown in bold.
For purposes of permitting, the collection system is considered to be any existing or newly
installed system extension up to the wastewater treatment facility property or point of connection
with a separately owned sewer system. The cbliectiOn system is considered all gravity lines,
pump stations, force mains, low pressure sewer systems, STEP systems, vacuum systems, etc.
and associated piping, valves and appurtenances that help to collect, manage and transport
wastewater to a wastewater treatment plant under the Permittee's ownership or maintained and
operated by the Permittee through a perpetual legal agreement. Satellite systems are systems
tributary to the Permittee's collection system but those collection systems are not owned or
maintained by the Permittee. The system description provided on Page 1 of this permit is meant

A release of wastewater from the wastewater collection system is referred to herein as a Sanitary
Sewer Overflow (SSO). The evaluation of enforcement options after an SSO will be determined
considering the criteria listed in condition I(3)(a) and I(3)(b) of the permit and all other relevant
information available or requested of the Permittee. Compliance with all conditions of the
permit as well as all statutes and regulations pertaining to the collection system must be
maintained or appropriate enforcement actions may be taken as noted in Condition VI(2).
A reportable SSO is an SSO greater than 1,000 gallons to the ground or an SSO of any amount
that reaches surface water (including through ditches, storm drains, etc.) Below is the procedure
to use for reporting SSOs to the Division:
1. Report by telephone to a Division of Water Resources (DWR) staff member(not email,
facsimile, or voicemail) at your regional DWR office during regular business hours
(Monday to Friday, 8AM to 5PM) as soon as possible, but in no case more than 24 hours
after the SSO is known or discovered. To report outside of regular business hours, call
(800) 858-0368.
2. Follow up the verbal report by sending a completed written report on the most current
Division approved form within five days.
To provide a uniform method for all systems covered under this permit and to provide useful and
consistent information pertaining to SSOs, please utilize form CS-SSO consisting of two parts.
Part I serves to provide to the Division the required information that has always been necessary.
Part II serves as an area to provide a justification for the spill, as optional under Condition I(3)of
your permit. Form CS-SSO can be downloaded from the SSO Reporting area at
http://portal.ncdenr.org/web/wq/swp/ps/cs/ssoreport.
An NOV, civil penalty, and/or a moratorium on the addition of waste to the system may be
issued if adequate justification for an SSO is NOT submitted to the regional office. In order to
submit a claim for justification of an SSO, you must use Form CS-SSO with additional
documentation as necessary. DWR staff will review the justification claim and determine if
enforcement action is appropriate. Please be advised that the information needed to justify a spill
is very comprehensive. Begin using this form immediately to report SSOs from the collection
system. Continue to use our old form for reporting bypasses at the wastewater treatment plant
until further notice. The time frame for submittal of both Part I and Part II, if pertinent, is five
days.
Failure to abide by the conditions in this permit may subject the Permittee to enforcement action.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty days following the
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh,NC 27699-6714. Unless such demands are made,
this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
operation and maintenance of a wastewater collection system consisting of, at the time of permit
issuance, approximately 30.4 miles of gravity sewer, approximately 42.74 miles of force main,
634 simplex pump stations that discharge to a pressure sewer and serve a single building and
20 simplex pump stations without permanent pump reliability that serve more than one building,
83 duplex pump stations, and all associated piping, valves, and appurtenances required to
make a complete and operational wastewater collection system to serve the Pluris LLC and any
deemed permitted satellite communities, pursuant to the application received February 12th,
2013, and the additional information received August 21st, 2013, and in conformity with the
documents referenced therein and other supporting data subsequently filed and approved by
the Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from September 1St, 2013 until August 31st, 2021 and shall be
subject to the following specified conditions and limitations:
I. PERFORMANCE STANDARDS
1. The sewage and wastewater collected by this system shall be treated in the Pluris, LLC
Wastewater Treatment Facility (W00005849) prior to being disposed into the receiving
infiltration system. This collection system permit will be referenced upon renewal or
modification of your treatment permit.
2. The wastewater collection system shall be effectively managed, maintained and
operated at all times so that there is no SSO to land or surface waters, nor any
contamination of groundwater. In the event that the wastewater collection system fails to
perform satisfactorily, including the creation of nuisance conditions, the Permittee shall
take immediate corrective actions, includin
g actions that may be required by the Division
of Water Resources (Division), such as the construction of additional or replacement
sewer lines and/or equipment.
•
3. The Director may take enforcement action against the Permittee for SSOs that must be
reported to the Division as stipulated in Condition IV(2). This includes SSOs that were
caused by severe natural conditions or exceptional events unless the Permittee
demonstrates through properly signed, contemporaneous operating logs, or other
relevant evidence that:
a. The SSO was caused by severe natural conditions; there were no feasible
alternatives to the SSO, such as the use of auxiliary treatment facilities, retention
of untreated wastewater, reduction of inflow and, infiltration, use of adequate
back-up equipment, or an increase in the capacity of the system. This provision
is not satisfied if, in the exercise of reasonable engineering judgment, the
Permittee should have installed auxiliary or additional collection system
components, wastewater retention or treatment facilities, adequate back-up
equipment or should have reduced inflow and infiltration; or
b. The SSO was exceptional, unintentional, temporary and caused by factors
beyond the reasonable control of the Permittee; the SSO could not have been
prevented by the exercise of reasonable control, such as proper management,
operation and maintenance; adequate treatment facilities or collection system
facilities or components (e.g., adequately enlarging treatment or collection
facilities to accommodate growth or adequately controlling and preventing
infiltration and inflow); preventive maintenance; or installation of adequate back-
up equipment;
The Permittee can submit a claim to the Division Regional Office that the SSO meets the
criteria of this condition. The Permittee has the option of submitting this claim along with
the spill report required by Condition IV(2) (i.e., within five days) in order to be
considered for immunity from enforcement action. Form CS-SSO Part II, or most current
Division approved form, shall be used for any claims. The Permittee has the burden of
proof that the above criteria have been met.
4. The Permittee shall establish by ordinance its legal authority to require new sewers be
properly constructed; to ensure proper inspection and testing of sewer mains and
service laterals; to address flows from satellite systems and to take enforcement action
as required by Condition 1(5).
5. The Permittee shall develop and implement an educational fats, oils and grease program
that shall include at least bi-annual distribution of educational material targeted at both
residential and non-residential users. The Permittee shall also develop and implement
an enforceable fats, oils and grease program for non-residential users under which the
Permittee can take enforcement against users who have not properly installed, operated
and maintained grease traps or grease interceptors as directed or otherwise violated the
terms of the local ordinance pertaining to fats, oils and grease.
6. The Permittee shall adopt and implement a Capital Improvement Plan (CIP) to designate
funding for reinvestment into the wastewater collection system infrastructure. The CIP
should address the short-term needs and long-term "master plan" concepts. The CIP
should typically cover a three to five year period and include a goal statement,
description of the project area, description of the existing facilities, known deficiencies
(over a reasonable period) and forecasted future needs. Cost analysis is integral to the
CIP.
7. Existing overflow piping from manholes and pump stations, excluding piping to approved
equalization structures, known or discovered after permit issuance shall be immediately
removed or permanently capped. Plugged emergency pumping connections are
allowable for portable pumping or rerouting without intentionally bypassing the
wastewater treatment facility.
8. The Permittee shall maintain a contingency plan for pump failure at each pump station.
If one of the pumps in a pump station containing multiple pumps fails, the process of
repairing or replacing the pump shall be initiated immediately and the new parts or pump
shall be installed as soon as possible. If the pump in a simplex pump station fails, it
shall be replaced immediately.
9. Each pump station shall be clearly and conspicuously posted with a pump station
identifier and an emergency contact telephone number at which an individual who can
initiate or perform emergency service for the wastewater collection system 24 hours per
day, seven days per week can be contacted. This emergency contact telephone number
shall be coupled with instructions that the emergency contact should be called if the
visual alarm illuminates, if the audible alarm sounds, or if an emergency is apparent.
10. Pump station sites, equipment and components shall have restricted access, per 15A
NCAC 02T .305(h)(4).
11. Pump stations that do not employ an automatic polling feature (i.e. routine contact with
pump stations from a central location to check operational status of the communication
system) shall have both audible and visual high water alarms. The alarms shall be
weather-proof and placed in a clear and conspicuous location. Permits issued for the
construction of pump stations that included high water alarms in the description must
maintain the alarms even if ry (telemet simple i.e. notification of an alarm condition
p
initiated by the pump station control feature) is installed.
12. For all newly constructed, modified and rehabilitated pump stations, all equipment and
components located within the pump station shall be corrosion-resistant and
components in close proximity of the pump station shall be sealed within a corrosion-
resistant coating or encasement.
13.All construction and rehabilitation of the wastewater collection system (i.e., permitted or
deemed permitted) shall be scheduled to minimize the interruption of service by the
existing utilities. Construction and rehabilitation shall not result in the violation of
Condition (1)(2) of this permit.
14.The Permittee shall develop a plan to design, permit, and begin construction on pump
stations with multiple pumps (duplex pump station) for the simplex units that serve more
than two (2) residential units (designated as simplex units 14-16 in Attachment B).
These include the following simplex pump stations:
• The simplex unit that serves 704,705,706,707, 708, 709, 710 Trade Winds Dr
• The simplex unit station that serves 159,161, 163, 165, 167, 169 Topsail Rd
• The simplex unit that serves 2976, 2978, 2980, 2982 Island Dr and 200 Ernest Dr
The Permittee shall begin construction within 15 months of permit issuance. A
report on the progress of the design, permitting, and construction of these pump
stations is required within 7 months of permit issuance. A copy of this report
shall be provided to the Wilmington Regional Office and the PERCS unit to show "
progress.
15. The Permittee shall conduct an onsite survey of the 13 simplex units (designated as
simplex units 1-13 in Attachment B) that serve two (2) residential units to determine the
feasibility for interconnection.
The Permittee shall-determine the number of stations that share a connection
currently and determine the feasibility (given proximity of units) of installing
others within 12 months of permit issuance. A copy of this study shall be
provided to the Wilmington Regional Office and .the PERCS unit to show
compliance. Results of the study may require additional conditions or
modification of this permit.
II. OPERATION AND MAINTENANCE REQUIREMENTS
1. Upon classification of the collection system by the Water Pollution Control System
Operators Certification Commission (WPCSOCC), the Permittee shall designate and
employ a certified operator to be in responsible charge (ORC) and one or more certified
operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G
.0201. The ORC shall visit the system within 24 hours of knowledge of a bypass, spill,
or overflow of wastewater from the system, unless visited by the Back-Up ORC, and
shall comply with all other conditions of 15A NCAC 8G .0204.
2. The Permittee shall develop and adhere to a schedule for reviewing all inspection,
maintenance, operational and complaint logs. If the review process results in the

identification of any recurring problem in the wastewater collection system that cannot be
resolved in a short time period, the.Permittee shall establish a plan for addressing the
problem(s).
3. The Permittee shall develop and adhere to a schedule for testing emergency and
standby equipment.
4. The Permittee shall develop and implement a routine pump station inspection and
maintenance program, which shall include, but not be limited to, the following
maintenance activities:
a. Cleaning and removing debris from the pump station structure, outside perimeter,
and wet well;
b. Inspecting and exercising all valves;
c. Inspecting and lubricating pumps and other mechanical equipment according to
the manufacturer's recommendations; and
d. Verifying the proper operation of the alarms, telemetry system and auxiliary
equipment.
5. For each pump station without pump reliability (i.e. simplex pump stations serving more
than a single building or pump stations not capable of pumping at a rate of 2.5 times the
average daily flow rate with the largest pump out of service), at least one fully
operational spare pump capable of pumping peak flow shall be maintained on hand.
6. The Permittee shall maintain on hand at least two percent of the number of pumps
installed, but no less than two pumps, that discharge to a pressure sewer and serve a
single building, unless the Permittee has the ability to purchase and install a
replacement pump within 24 hours of first knowledge of the simplex pump failure or
within the storage capacity provided in any sewer line extension permit.
7. Rights-of-way and/or easements shall be properly maintained to allow accessibility to the
wastewater collection system unless the Permittee can demonstrate the ability to gain
temporary access in an emergency situation where existing land-use conditions do not
allow the establishment and maintenance of permanent access. In this case, the
Permittee shall continue to observe the lines visually, utilize remote inspection methods
(e.g. CCTV) and use the opportunity of drier conditions to perform further inspections
and necessary maintenance.
8. The Permittee shall assess cleaning needs, and develop and implement a program for
appropriately cleaning, whether by hydraulic or mechanical methods, all sewer lines. At
least 10 percent of the wastewater collection system, selected at the discretion of the
ORC, shall be cleaned each year. Preventative cleaning is not required for sewer lines
less than five years old unless inspection otherwise reveals the need for cleaning or
cleaning is required by a sewer line extension permit.
9. Adequate measures shall be taken to contain and properly dispose of materials
associated with SSOs. The Permittee shall maintain a Response Action Plan that
addresses the following minimum items:
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Response time;
c. Equipment list and spare parts inventory;
d. Access to cleaning equipment;
e. Access to construction crews, contractors and/or engineers;
f. Source(s) of emergency funds;
g. Site sanitation and clean up materials; and
h. Post-SSO assessment.
10. The Permittee, or their authorized representative, shall conduct an on-site evaluation for
all SSOs as soon as possible, but no more than two hours after first knowledge of the
SSO.
11. In the event of an SSO or blockage within the wastewater collection system, the
Permittee shall restore the system operation, remove visible solids and paper, sanitize
any ground area and restore the surroundings.
12.The Permittee shall immediately implement a once per week inspection program for the
three simplex units that serve more than two residential units. All inspections and any
maintenance activities that result from the inspections should be recorded and records
shall be kept on file in accordance with Condition 111(1).
13.The Permittee shall immediately implement a once per month inspection program for the
13 simplex units (designated as simplex units 1-13 in Attachment B) that serve two (2)
residential units. Should the units be replaced with duplex pump stations or additional
simplex units be added, the inspection schedule can be modified for those units. All
inspections and any maintenance activities that result from the inspections should be
recorded and records shall be kept on file for a minimum of three years in accordance
with Condition 111(1).
III. RECORDS
1. Records shall be maintained to document compliance with Conditions 1(5), 11(2) - 11(4),
11(7) - 11(8), IV(3) and V(1) -V(4). Records shall be kept on file for a minimum of three
years.
•2: The Permittee shall maintain adequate records pertaining to SSOs, and complaints for a
minimum of three years. These records shall include, but are not limited to, the following
information:
a. Date of SSO or complaint;
b. Volume of wastewater released as a result of the SSO and/or nature of
complaint;
c. Location of the SSO and/or complaint;
d. Estimated duration of the SSO;
e. Individual from the Division who was informed about the SSO and/or complaint,
when applicable;
f. Final destination of the SSO;
g. Corrective actions;
h. Known environmental/human health impacts resulting from the SSO; and
i. How the SSO was discovered.
3. The Permittee shall maintain an up-to-date, accurate, comprehensive map of its
wastewater collection system that also notes the locations where other wastewater
collection systems become tributary. If a comprehensive map of the collection system
has not been established, a rough sketch shall be drawn. The Permittee shall map
approximately 10 percent of its existing collection system each year for the next ten
years beginning at the original permit issuance date, or until complete, whichever is
sooner. The comprehensive map shall include, but is not limited to: pipe size, pipe
material, pipe location, flow direction, approximate pipe age, number of active service
taps, and each pump station identification, location and capacity.
4. The Permittee shall maintain records of all of the modifications and extensions to the
collection system permitted herein. The Permittee shall maintain a copy of the
construction record drawings and specifications for modifications/extensions to the
wastewater collection system for the life of the modification/extension. Information
concerning the extension shall be incorporated into the map of the wastewater collection
system within one year of the completion of construction. The system description
contained within this permit shall be updated to include this modification/extension
• information upon permit renewal.
IV. MONITORING AND REPORTING REQUIREMENTS
1. Any monitoring (including, but not necessarily limited to, wastewater flow, groundwater,
surface water, soil or plant tissue analyses) deemed necessary by the Division to ensure
surface water and groundwater protection will be established, and an acceptable
sampling and reporting schedule shall be followed.
2. The Permittee shall verbally report to a Division of Water Resources staff member at the
Wilmington Regional Office, at telephone number 910-796-7215 as soon as possible,
but in no case more than 24 hours following the occurrence or first knowledge of the
occurrence of either of the following:
a. Any SSO and/or spill over 1,000 gallons; or
b. Any SSO and/or spill, regardless of volume, that reaches surface water.
Voice mail messages or faxed information shall not be considered as the initial verbal
report. SSOs (and other types of spills) occurring outside normal business hours may
also be reported to the Division of Emergency Management at telephone number (800)
858-0368 or (919) 733-3300. Persons reporting any of the above occurrences shall file
a spill report by completing Part I of Form CS-SSO (or the most current Division
approved form), within five days following first knowledge of the occurrence. This report
shall outline the actions taken or proposed to ensure that the problem does not recur.
Per Condition 1(3), Part II of Form CS-SSO (or the most current Division approved form)
can also be completed to show that the SSO was beyond control.
3. The Permittee shall meet the annual reporting and notification requirements provided in
North Carolina General Statute §143-215.1C.
V. INSPECTIONS
1. The Perrriittee or the Permittee's designee shall inspect the wastewater collection
system regularly to reduce the risk of malfunctions and deterioration, operator errors,
and other issues that may cause or lead to the release of wastes to the environment,
threaten human health or create nuisance conditions. The Permittee shall keep an
inspection log or summary including, at a minimum, the date and time of inspection,
observations made, and any maintenance, repairs, or corrective actions taken by the
Permittee.
2. Pump stations without Supervisory Control and Data Acquisition (SCADA) systems or
telemetry shall be inspected everyday (i.e. 365 days per year). Pump stations equipped
with SCADA systems or telemetry shall be inspected at least once per week.
3. A general observation of the entire collection system shall be performed throughout the
course of every year.
4. Inspections of all high priority lines (i.e. aerial line, sub-waterway crossing, line
contacting surface waters, siphon, line positioned parallel to stream banks that are
subject to eroding in such a manner that may threaten the sewer line, or line designated
as high-priority in a permit) shall be performed at least once per every six-month period
of time. ,..A list of high-priority lines is presented as Attachment A and is hereby
incorporated into this permit condition. New high priority lines installed or identified after
permit issuance are incorporated by reference and subject to this permit condition until
permit renewal where they shall be referenced in writing in Attachment A.
VI. GENERAL CONDITIONS
1. This permit is not transferable. In the event that the Permittee desires to transfer
ownership of the wastewater collection system or there is a name change of the
Permittee, a formal permit modification request shall be submitted to the Division. The
request shall be accompanied by documentation from the parties involved, and other
supporting materials as may be appropriate. Such request will be considered on its
merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division in accordance with North Carolina
General Statute §143-215.6A through §143-215.6C, and a sewer moratorium may be
established.
3. The issuance of this permit does not exempt the Permittee from complying with any and
all statutes, rules, regulations, or ordinances that may be imposed by other government
agencies (i.e., local, state, and federal) having jurisdiction, including but not limited to
applicable river buffer rules in 15A NCAC 2B .0200, soil erosion and sedimentation
control requirements in 15A NCAC Chapter 4 and under the Division's General Permit
NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200
and I5A NCAC 02T .0100 and all applicable North Carolina Occupational Safety and
Health Act health and safety standards.
4. The issuance of this permit does not prohibit the Division from reopening and modifying
thepermit, revokingand reissuingtheper
mit or terminatingthepermit as allowed bythe
laws, rules, and regulations contained in 15A NCAC 02T .0100 and North Carolina g
General Statute §I43-215.1 et. al., or as needed to address changes in federal regulations
with respect to the wastewater collection system.
5. The Permittee shall pay the annual fee within thirty (30) days after being billed by the
Division. Failure to paythe fee accor

6. The Permittee shall request renewal of this permit at least six months prior to the
expiration of this permit. Upon receipt of the request, the Commission will review the
adequacy of the wastewater collection system described therein, and if warranted, will
extend the permit for a period of time and under such conditions and limitations, as the
Commission may deem appropriate.
7. The Permittee shall notify the Division's Pretreatment, Emergency Response and
Collection Systems Unit in writing at 1617 Mail Service Center, Raleigh, North Carolina
27699-1617 of any changes to the name and/or address of the responsible party (i.e.
mayor, city/town manager) of the wastewater collection system.
8. Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises or place on or
related to the collection system at any reasonable time for the purpose of determining
compliance with this permit, may inspect or copy any records that must be maintained
under the terms and conditions of this permit, and may obtain samples of wastewater,
groundwater, surface water, soil, or plant tissue.

WQCS00275,dated September 17,2009,to Pluris,LLC for the operation and maintenance of the subject
wastewater collection system.Purpose of this modification is to change ownership from North Topsail
Utilities Inc.to Pluris,LLC.
This permit shall be effective from the effective date of September 17,2009 until June 30,2010.This permit shall
be subject to the conditions and limitations specified herein.It is your responsibility to thoroughly review this
permit.Please pay particular attention to the monitoring and reporting requirements in this permit and any
compliance schedules shown in bold.
For purposes of permitting,the collection system is considered to be any existing or newly installed system
extension up to the wastewater treatment facility property or point of connection with a separately owned sewer
system. The collection system is considered all gravity lines,pump stations,force mains, low pressure sewer
systems,STEP systems,vacuum systems,etc.and associated piping,valves and appurtenances that help to
collect, manage and transport wastewater to a wastewater treatment plant under the Permittee's ownership or
maintained and operated by the Permittee through a perpetual legal agreement.Satellite systems are systems
tributary to the Permittee's collection system but those collection systems are not owned or maintained by the
Permittee.The system description provided on Page 1 of this permit is meant to provide a general idea about the
size of the system and may not be all inclusive of the collection system at the time of permit issuance or
afterward.

2. The wastewater collection system shall be effectively managed,maintained and operated at all times so that there
is no SSO to land or surface waters, nor any contamination of groundwater. In the event that the wastewater
collection system fails to perform satisfactorily, including the creation of nuisance conditions,the Permittee shall
take immediate corrective actions,including actions that may be required by the Division of Water Quality
(Division),such as the construction of additional or replacement sewer lines and/or equipment.
The Director may take enforcement action against the Permittee for SSOs that must be reported to the Division as
stipulated in Condition IV(2). This includes SSOs that were caused by severe natural conditions or exceptional
events unless the Permittee dem

relevant evidence that:
a) The SSO was caused by severe natural conditions;there were no feasible alternatives to the SSO,such as
the use of auxiliary treatment facilities,retention of untreated wastewater,reduction of inflow and
infiltration,use of adequate back-up equipment,or an increase in the capacity of the system. This
provision is not satisfied if, in the exercise of reasonable engineering judgment,the Permittee should have
installed auxiliary or additional collection system components,wastewater retention or treatment
facilities,adequate back-up equipment or should have reduced inflow and infiltration;or
b) The SSO was exceptional,unintentional,temporary and caused by factors beyond the reasonable control
of the Permittee;the SSO could not have been prevented by the exercise of reasonable control,such as
proper management,operation and maintenance;adequate treatment facilities or collection system
facilities or components(e.g.,adequately enlarging treatment or collection facilities to accommodate
growth or adequately controlling and preventing infiltration and inflow);preventive maintenance;or
installation of adequate back-up equipment;
The Permittee can submit a claim to the Division Regional Office that the SSO meets the criteria of this condition.
The Permittee has the option of submitting this claim along with the spill report required by Condition IV(2)(i.e.,
within five days)in order to be considered for immunity from enforcement action. Form CS-SSO Part II,or most
current Division approved form,shall be used for any claims.The Pen:nittee has the burden of proof that the above
criteria have been met.
3. The Permittee shall establish by ordinance its legal authority to require new sewers be properly constructed;to
ensure proper inspection and testing of sewer mains and service laterals;to address flows from satellite systems
and to take enforcement action as required by Condition 1(4).
4. The Permittee shall develop and implement an educational fats,oils and grease program that shall include at least
bi-annual distribution of educational material targeted at both residential and non-residential users.The Permittee
shall also develop and implement an enforceable fats,oils and grease program for non-residential users under
which the Permittee can take enforcement against users who have not properly installed,operated and maintained
grease traps or grease interceptors as directed or otherwise violated the terms of the local ordinance pertaining to
fats,oils and grease.
5. The Permittee shall adopt and implement a Capital Improvement Plan(CIP)to designate funding for reinvestment
into the wastewater collection system infrastructure.The CIP should address the short-term needs and long-term
"master plan"concepts. The CIP should typically cover a three to five year period and include a goal statement,
description of the project area,description of the existing facilities,known deficiencies(over a reasonable period)
and forecasted future needs.Cost analysis is integral to the CIP.
3. The Permittee shall develop and adhere to a schedule for testing emergency and standby equipment.
4. The Permittee shall develop and implement a routine pump station inspection and maintenance program,which
shall include,but not be limited to,the following maintenance activities:
a. Cleaning and removing debris from the pump station structure,outside perimeter,and wet well;
b. Inspecting and exercising all valves;
c. Inspecting and lubricating pumps and other mechanical equipment according to the manufacturer's
recommendations;and
d. Verifying the proper operation of the alarms,telemetry system and auxiliary equipment.
S. For each pump station without pump reliability(i.e.simplex pump stations serving more than a single building or
pump stations not capable of pumping at a rate of 2.5 times the average daily flow rate with the largest pump out
of service),at least one fully operational spare pump capable of pumping peak flow shall be maintained on hand.
6. The Permittee shall maintain on hand at least two percent of the number of pumps installed,but no less than two
pumps,that discharge to a pressure sewer and serve a single building,unless the Permittee has the ability to
purchase and install a replacement pump within 24 hours of first knowledge of the simplex pump failure or within
the storage capacity provided in any sewer line extension permit.
7. Rights-of-way and/or easements shall be properly maintained to allow accessibility to the wastewater collection
system unless the Permittee can demonstrate the ability to gain temporary access in an emergency situation where
existing land-use conditions do not allow the establishment and maintenance of permanent access. In this case,
the Permittee shall continue to observe the lines visually,utilize remote inspection methods(e.g.CCTV)and use
the opportunity of drier conditions to perform further inspections and necessary maintenance.
8. The Permittee shall assess cleaning needs,and develop and implement a program for appropriately cleaning,
whether by hydraulic or mechanical methods,all sewer lines. At least 10 percent of the wastewater collection
system,selected at the discretion of the ORC,shall be cleaned each year. Preventative cleaning is not required for
sewer lines less than five years old unless inspection otherwise reveals the need for cleaning or cleaning is
required by a sewer line extension permit.
9. Adequate measures shall be taken to contain and properly dispose of materials associated with SSOs. The
Permittee shall maintain a Response Action Plan that addresses the following minimum items:
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Response time;
c. Equipment list and spare parts inventory;
d. Access to cleaning equipment;
e. Access to construction crews,contractors and/or engineers;
f. Source(s)of emergency funds;
g. Site sanitation and clean up materials;and
h. Post-SSO assessment.
10. The Permittee,or their authorized representative,shall conduct an on-site evaluation for all SSOs as soon as
possible,but no more than two hours after first knowledge of the SSO.
11. In the event of a SSO or blockage within the wastewater collection system,the Permittee shall restore the system
operation,remove visible solids and paper,sanitize any ground area and restore the surroundings.

2. The Permittee shall verbally report to a Division of Water Quality staff member at the Wilmington Regional
Office,at telephone number 910-796-7215 as soon as possible,but in no case more than 24 hours following the
occurrence or first knowledge of the occurrence of either of the following:
a. Any SSO and/or spill over 1,000 gallons;or
b. Any SSO and/or spill,regardless of volume,that reaches surface water.
Voice mail messages or faxed information shall not be considered as the initial verbal report.SSOs(and other
types of spills)occurring outside normal business hours may also be reported to the Division of Emergency
Management at telephone number(800)858-0368 or(919)733-3300. Persons reporting any of the above
occurrences shall file a spill report by completing Part I of Form CS-SSO(or the most current Division approved
form),within five days following first knowledge of the occurrence. This report shall outline the actions taken or
proposed to ensure that the problem does not recur. Per Condition 1(2), Part II of Form CS-SSO(or the most
current Division approved form)can also be completed to show that the SSO was beyond control.
3. The Permittee shall meet the annual reporting and notification requirements provided in North Carolina General
Statute §143-215.1 C.
V. INSPECTIONS
1. The Permittee or the Permittee's designee shall inspect the wastewater collection system regularly to reduce the
risk of malfunctions and deterioration,operator errors,and other issues that may cause or lead to the release of
wastes to the environment,threaten human health or create nuisance conditions. The Permittee shall keep an
inspection log or summary including,at a minimum,the date and time of inspection,observations made,and any
maintenance,repairs,or corrective actions taken by the Permittee.
2. Pump stations without Supervisory Control and Data Acquisition(SCADA)systems or telemetry shall be
inspected everyday(i.e.365 days per year). Pump stations equipped with SCADA systems or telemetry shall be
inspected at least once per week.
3. A general observation of the entire collection system shall be performed throughout the course of every year.
4. Inspections of all high priority lines(i.e.aerial line,sub-waterway crossing, line contacting surface waters,
siphon, line positioned parallel to stream banks that are subject to eroding in such a manner that may threaten the
sewer line,or line designated as high-priority in a permit)shall be performed at least once per every six-month
period of time. A list of high-priority lines is presented as Attachment A and is hereby incorporated into this
permit condition. New high priority lines installed or identified after permit issuance are incorporated by
reference and subject to this permit condition until permit renewal where they shall be referenced in writing in
Attachment A.
VI.GENERAL CONDITIONS
1. This permit is not transferable. In the event that the Permittee desires to transfer ownership of the wastewater
collection system or there is a name change of the Permittee,a formal permit modification request shall be
submitted to the Division.The request shall be accompanied by documentation from the parties involved,and
other supporting materials as may be appropriate. Such request will be considered on its merits and may or may
not be approved.
9. The Collection System operator/contact shall keep a copy of this permit on hand and be able to produce it upon
request of the Division during compliance inspection or other on-site visit.
10. The Operational Agreement between the Permittee and the Environmental Management Commission is
incorporated herein by reference and is a condition of this permit. Noncompliance with the terms of the
Operational Agreement shall subject the Permittee to all sanctions provided by North Carolina General Statute
§143-215.6A through§143-215.6C for violation of or failure to act in accordance with the terms and conditions of
this permit.

In accordance with your request and documentation received September 21, 2009, we are forwarding
herewith Permit No. WQ0034483, dated ISSUE DATE (Month Day, Year), to the Pluris, LLC for the
construction and operation upon certification of the subject wastewater collection system extension.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein. This cover letter shall be considered a part of this permit
and is therefore incorporated therein by reference.
This permit describes a portion of the sewer system previously issued to North Topsail Utilities Incorporated
under a single, consolidated permit (WQ0017535) that will be voided upon issuance of the three new
permits that will ultimately be created. System changes are in the process of being designed for
implementation to increase the efficiency of the overall system that modeling has previously shown as
becoming degraded. In addition, the residential flow reduction rate of 80 qpd/bedroom with a
minimum of 160 gpd that was granted on November 6, 2009 for systems on the mainland is being
applied where possible.
Please pay particular attention to Conditions 17 regarding systems approved as "Construction Only"
and the requirement to request and receive a permit modification prior to certification and placement
into operation.
Please note the following standard conditions that are contained in this permit.
Condition 3: Requires that the wastewater collection facilities be properly operated and
maintained in accordance with 15A NCAC 2T .0403 or any individual system-wide
collection system permit issued to the Perrnittee.
Condition 6: Requires that the system be properly certified upon completion of construction
and prior to being placed into operation.
Condition 7: Regarding the installation of gravity sewer at greater than ten percent below the
minimum required slope per the Division's Gravity Sewer Minimum Design Criteria
shall not be acceptable and shall not be certified until corrected.

Permitting of this project does not constitute an acceptance of any part of the project that does not
meet 15A NCAC 2T; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria
adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast-Track
Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically
mentioned herein. Division approval is based on acceptance of the certification provided by the North
Carolina-licensed Professional Engineer named in the application.
It shall be the Pluris, LLC's responsibility to ensure that the as-constructed project meets
the appropriate design criteria and rules. Failure to comply may result in penalties in
accordance with North Carolina General Statute §143-215.6A through §143-215.6C,
construction of additional or replacement wastewater collection facilities, and/or referral
of the North Carolina-licensed Professional Engineer to the licensing board.
A stormwater management plan shall be submitted to and approved by the Wilmington Regional
Office in accordance with 15A NCAC 2H .1000.
If any parts,requirements, or limitations contained in this permit are unacceptable,you have the right to
request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This
request must be in the form of a written petition, conforming to Chapter 150B of North Carolina General
Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. Unless such demands are made, this permit shall be final and binding.

amended, other applicable Laws, Rules, and Regulations, and in conformity with 15A NCAC 2T; the
Division's Gravity Sewer Minimum Design Criteria adopted February 12, 1996 and Minimum Design
Criteria for the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as
applicable; and other supporting data subsequently filed at time of application and approved by the
Department of Environment and Natural Resources upon issuance and considered a part of this permit;

The continued operation, construction and operation upon certification, or construction only of
wastewater collection system extensions or connections previously permitted and consolidated into this
permit listed below as part of the North Topsail Beach Consolidated Sewer Basin with the potential
discharge of at least 331,185 gallons per day of collected domestic wastewater into the Pluris, LLC's
existing sewerage system pursuant to the request received September 21, 2009.
The sewage and wastewater collected by this system shall be treated in the Pluris North Topsail
Wastewater Treatment Facility (Permit No. W00005849) prior to being land applied by spray irrigation or
rapid infiltration.
New direct connections to existing systems may be either be gravity or pressure, but pressure
connections shall be 25 - 50 gallon per minute pump stations with simplex pumps, on-site audible and
visual high water alarms.
Continued operation of 119 linear feet of 2-inch force main to serve 1 residence with 8 habitable rooms,
1 residence with 5 habitable rooms and 1 duplex unit with 16 habitable rooms for a total of 29 habitable
rooms as part of the 23rd Street North Topsail Private Sewer project, and the discharge of 3,480 gallons
per day of collected domestic wastewater into the Pluris, LLC's existing sewerage system pursuant to the
application received December 4, 2008. Certified complete on May 28, 2009.
Continued operation of approximately an upgraded 1,510-gallon per minute firm capacity pump
station (designed to handle 2.14 MGD) with triplex pumps, on-site audible and visual high water alarms,
telemetry, an on-site generator with automatic transfer switch, and a Siemens ZABOCS BTF odor control
system with continued use of approximately 15,200 linear feet of existing 12-inch force main to serve
existing & future customers on North Topsail Beach as part of the North Topsail Beach Main Pump Station
Upgrade project with no additional discharge of collected domestic wastewater into Pluris, LLC's
existing sewerage system pursuant to the application received January 28, 2008 and additional
information received February 27, 2008. Certified complete on April 13, 2009.

Continued construction and operation upon certification of approximately 58 linear feet of 2-inch and
181 linear feet of 3-inch pressure sewer, and a 20 to 40-gallon per minute simplex pump station with
audible and visual alarms to serve 1 three-bedroom single family home (Ninth Avenue Lot#3) and the
discharge of 360 gallons per day of collected domestic wastewater into Pluris, LLC's existing sewerage
system pursuant to the application received December 8, 2006;
Please note that regardless of any other statements to the contrary elsewhere in this document, a
permit modification will be required for any additional taps to this sewer line.
Continued construction only of approximately 318 linear feet of 8-inch gravity sewer to serve 35 one-
bedroom units as part of the Sea Side Inn Condominiums project with a potential discharge of 8,550
gallons per day, but zero (0) flow allocation is being allocated to discharge into the Pluris, LLC's existing
sewerage system, pursuant to the application received December 8, 2006 and flow removal per a
December 13, 2007 application;
Continued construction only of a 95-gallon per minute pump station with duplex pumps and on-site
audible and visual high water alarms, telemetry, onsite standby generator with automatic transfer
switch and approximately 190 linear feet of 2-inch force main to serve 24 three-bedroom units in
LaCosta Bay with a potential discharge of 8,640 gallons per day, but zero (0) flow allocation is being
allocated to discharge into the Pluris, LLC's existing sewerage system, pursuant to the application
received January 30, 2006 and flow removal per a December 13, 2007 application;

inch gravity sewer (previously 298 linear feet); 82 linear feet of 3-inch pressure line (previously 90 linear
feet); and a 50-gallon per minute pump station to serve 13 three-bedroom residences and swimming
pool with a permitted flow volume of 4,680 gpd. This permit was modified and consolidated into
WQ0017535 pursuant to the application received January 20, 2004.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T or rules in effect at the time of original
issuance; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted
February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting
materials unless specifically mentioned herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system-wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T
.0403:

a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L.0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency,
preventative maintenance schedule, spare parts inventory, and overflow response shall be
developed and implemented. -
d. Pump stations that are not connected to a telemetry system (i.e. remote alarm system) shall
be inspected by the Permittee or its representative every day (i.e. 365 days per year). Pump
stations that are connected to a telemetry system shall be inspected at least once per week.
e. High-priority sewer lines shall be inspected by the Permittee or its representative at least once
per every six-month period of time.
f. A general observation of the entire sewer system shall be conducted by the Permittee or its
representative at least once per year.
g. Overflows and bypasses shall be reported to the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required
q by
North Carolina General Statute §143-215.1 C.
h. A Grease Control Plan shall be implemented as follows:
1. For publicly owned collection systems, the Program shall include at least bi-annual
distribution of educational materials for both commercial and residential users and the
legal means to require grease interceptors for new construction and retrofit, if necessary, of
grease interceptors at existing establishments. The Program shall also include legal means
for inspections of the grease interceptors, enforcement for violators, and the legal means
to control grease entering the system from other public or private satellite sewer systems.
2. For privately owned collection systems, the Program shall include at least bi-annual
distribution of educational materials to all users of the collection system by the Permittee or
its representative.
3. Grease education materials shall be distributed more often than required in Parts 1 or 2 of
this sub-paragraph if necessary to prevent grease-related sanitary sewer overflows.
i. Right-of-ways and easements shall be maintainedin thefullea
sement y easem nt width for personnel and
equipment accessibility.
j. Documentation shall be kept on file for Sections (a.) through (i.) of this rule for a minimum of
three (3) years with the exception of the map, which shall be maintained for the life of the
system.
4. This permit shall not be transferable. In the event there is a desire for thewa
stewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be considered
on its merits and may or may not be approved.
5. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State.
6. Per 15A NCAC 2T .0116, upon completion of construction and prior to operation of these permitted
facilities, the completed Engineering Certification form attached to this permit shall be submitted
with the required supporting documents (as-built or recording drawings and pump station designs,if
applicable) to the address provided on the form. A complete certification is one where the form is
fully executed and the supporting documents are provided as applicable. Any wastewater flow
made tributary to the wastewater collection system extension prior to completion of this Engineer's
Certification shall be considered a violation of the permit and shall subject the Permittee to
appropriate enforcement actions.

If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles
of Incorporation, Declarations, and Bylaws that have been appropriately filed with the applicable
County's Register of Deeds office shall be submitted with the certification.
A complete certification is one where the form is fully executed and the supporting documents are
provided as applicable. Supporting documentation shall include the following:
a. One copy of the project construction record drawings (plan & profile views of sewer lines &
force mains) of the wastewater collection system extension. Record drawings are defined as
the design drawings that are marked up or annotated with after construction information and
show required buffers, separation distances, material changes, etc.
b. One copy of the supporting pump station design calculations (selected pumps, system curve,
operating point, buoyancy calculations, available storage if portable generator(s) or storage
greater than longest past three year outage reliability option selected) for any pump stations
permitted as part of this project.
c. Changes to the project that do not result in non-compliance with this permit, regulations, or
the Minimum Design Criteria should be clearly identified on the record drawings, on the
certification in the space provided, or in written summary form.
Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (including pipe length increases of 10% or greater, increased flow,
pump station design capacity design increases of 5% or greater, and increases in the number/type
of connections), regulations, or the Minimum Design Criteria. Requested modifications or variances
to the Minimum Design Criteria will be reviewed on a case-by-case basis and each on its own merit.
Please note that variances to the Minimum Design Criteria should be requested and approved
during the permitting process prior to construction. After-construction requests are discouraged by
the Division and may not be approved, thus requiring replacement or repair prior to certification &
activation.
7. Gravity sewers installed greater than ten percent below the minimum required slope per the
Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified
until corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting
documentation. This shall be done through a permit modification with fee. Such variance requests
will be evaluated on a case-by-case basis. Resolution of such request shall be evident prior to
completing and submitting the construction certification.
8. A copy of the construction record drawings and pump station designs, if applicable, shall be
maintained on file by the Permittee for the life of the wastewater collection facilities.
9. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast-Track Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
10. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
11. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by other government agencies (local, state
and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the
Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A
NCAC 2B .0200 and 15A NCAC 2H .0500.

12. NON-COMPLIANCE NOTIFICATION:
The Permittee shall verbally report to a Division of Water Quality staff member at the Wilmington
Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than
24 hours or on the next working day, following the occurrence or first knowledge of the occurrence
of either of the following:
a. Any failure, due to known or unknown reasons, that renders the system incapable of
adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass of any wastewater directly
to receiving waters from the station or sewer line.
Voice mail messages or faxed information is permissible, but shall NOT be considered as the initial
verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number (800) 858-0368 or (919) 733-3300.
Persons reporting any of the above occurrences shall file a spill report by completing Part I of Form
CS-SSO (or the most current Division approved form), within five days following first knowledge of
the occurrence. This report shall outline the actions taken or proposed to ensure that the problem
does not recur. Part II of Form CS-SSO (or the most current Division approved form) can also be
completed to show that the SSO was beyond control.
13. Each pump station including simplex stations shall be clearly and conspicuously posted with the
telephone number and name of the owner/operator of the sewer system and instructions to call
the number in the event of alarm activation.
14. The Permittee shall maintain on hand for immediate installation a supply of spare, fully operational
pump units of each simplex type used in the sewer system. The number of pumps on hand shall not
be less than two (2) percent of the number of installed units or one unit, whichever is greater.
15. A minimum of 90 gallons of storage capacity above the pump-on activation level to meet the
greater of the Permittee response time for service or the longest non-catastrophic power outage of
the previous three years for any simplex pump station serving a single family residence. This is based
on a three-bedroom residence. The Permittee is advised that since many of these residences
actually serve as 4 and 5 bedroom residences during the resort season, any overflows due to
inadequate storage will be subject to enforcement action.
16. The Permittee shall provide for the pump station and force main the following items:
a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in
the pump station,
b. An air relief valve located at all high points along the force main,
c. A screened vent for the wetwell,
d. Fillets located in the wetwell at the intersection of the flooring and sidewalls,
e. Three feet of cover (minimum) over the force main or the use of ferrous material where
three feet cannot be maintained,
f. Sufficient devices which will protect the pump station from vandals, and
g. Flood protection if the pump station is located below the 100-year flood elevation.
17. The projects in this permit indicated to be for construction only of the wastewater collection facilities
must have flow allocation provided prior to activation. Flow allocation requires a permit
modification application to be submitted (with the appropriate fee), a modified permit be issued,
and the Engineer's Certification is received and approved by the Division.

October 26th, November 5th,and December 7,2021,we are forwarding herewith Permit No.WQ0034485
dated December 8, 2021 to the Pluris LLC (Permittee) for the construction and operation upon
certification of the subject wastewater collection system extension. This permit shall be effective from
the date of issuance until rescinded, shall void Permit No. WQ0034485 issued December 18, 2013, and
shall be subject to the conditions and limitations as specified therein.This cover letter shall be considered
a part of this permit and is therefore incorporated therein by reference.
This modification is for approximately 4,346 feet of 8-inch gravity sewer with an 80-gpm pump station
& 1,218 feet of 4-inch force main to serve 90 three-bedroom residences & an amenity center with
22,600 gpd of flow allocation in the Landing at Mill Creek Phase 5. The above phase is a replacement
project/design for the previously approved Phase 2 Section 3 via a different design engineer and it was
discovered that two additional potential connections were made in Phase 2 Section 2.

following applies: For all newly constructed, modified and rehabilitated pump stations,
all equipment and components shall be sealed within a corrosion-resistant coating or
encasement to the extent practicable and equivalent to the minimum design criteria
unless the permittee can demonstrate it is not practicable or another form of corrosion
resistance is employed. [15A NCAC 02T.0108 (b))
It shall be responsibility of the Permittee to ensure that the as-constructed project meets the appropriate
design criteria and rules. Failure to comply may result in penalties in accordance with North Carolina
General Statute §143-215.6A through §143-215.6C, construction of additional or replacement
wastewater collection facilities, and/or referral of the North Carolina-licensed Professional Engineer to
the licensing board.
If any parts, requirements,or limitations contained in this permit are unacceptable,you have the right to
request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This

amended,and other applicable Laws, Rules, and Regulations, permission is hereby granted to the
PLURIS LLC

for the construction and operation upon certification of approximately 4,346 linear feet of 8-inch gravity
sewer; an 80-gallon per minute pump station with duplex pumps, on-site audible and visual high water
alarms, telemetry, and an automatically activated stand-by bypass pump as well as approximately 1,218
linear feet of 4-inch force main to serve 90 three-bedroom residences (80 gpd/br)and an amenity center
(1,000 gpd) as part of the Landing at Mill Creek Phase 5 project, and the discharge of 22,600 gallons per
day of collected domestic wastewater into the Pluris LLC's existing sewerage system, pursuant to the
application received October 20, 2021, and additional information received on October 26th, November
5', and December 7, 2021 and in conformity with 15A NCAC 2T; the Division's Gravity Sewer Minimum
Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the
Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other
supporting data subsequently filed and approved by the Department of Environmental Quality and
considered a part of this permit.

SUPPLEMENT TO PERMIT COVER SHEET
PLURIS LLC is hereby authorized to:
Construct,and then operate upon certification the aforementioned wastewater collection extension. The
sewage and wastewater collected by this system shall be treated in the Pluris North Topsail Wastewater
Treatment Facility in accordance with Permit Number WQ0005849.
Permitting of this project does not constitute an acceptance of any part of the project that does not meet
15A NCAC 2T;the Division of Water Resources'(Division)Gravity Sewer Minimum Design Criteria adopted
February 12,1996 as applicable;and the Division's Minimum Design Criteria for the Fast-Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically mentioned
herein. Division approval is based on acceptance of the certification provided by a North Carolina-licensed
Professional Engineer in the application. It shall be the Permittee's responsibility to ensure that the as-
constructed project meets the appropriate design criteria and rules.
Construction and operation is contingent upon compliance with the Standard Conditions and any Special
Conditions identified below.
I. SPECIAL CONDITIONS
1. No flow in excess of the quantity or number&type of connections permitted herein shall be made
tributary to the subject sewer system until an application for permit modification has been submitted
to and approved by the Division. [15A NCAC 02T.0304(b)]
2. Each pump station shall be clearly and conspicuously posted using a weatherproof sign with the
address,a pump station identifying name/number,24-Hour Emergency telephone number,and name
of the owner/operator of the sewer system/pump station and instructions to call the number in the
event of alarm activation or other emergency. Simplex pump stations or vacuum sewer pits serving a
single-family residence may have a placard or sticker without the address placed on the control panel
in lieu of a sign. [15A NCAC 02T.0305(h)(2)]
II.STANDARD CONDITIONS
1. This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be considered
on its merits and may or may not be approved. [15A NCAC 02T.0104;G.S 143-215.1(d3)]
2. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T;the Division's Gravity Sewer Minimum
Design Criteria adopted February 12, 1996 as applicable;the Division's Minimum Design Criteria for
the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1,2000 as applicable;and
other supporting materials unless specifically mentioned herein. [15A NCAC 02T.0110]
3. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data. [15A NCAC 02T.0110]

4. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system-wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required,the following performance criteria shall be met: [15A NCAC 02T.0108(b)]
a. The sewer system shall be effectively maintained and operated at all times to prevent discharge
to land or surface waters,and to prevent any contravention of groundwater standards or surface
water standards.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency, preventative
maintenance schedule, spare parts inventory and overflow response has been developed and
implemented.
d. Pump stations that are not connected to a telemetry system shall be inspected every day(i.e.365
days per year). Pump stations that are connected to a telemetry system shall be inspected at
least once per week.
e. High-priority sewer lines shall be inspected at least once per every six-months and inspections are
documented.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance
with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina
General Statute§143-215.1C.
h. A Grease Control Program is in place as follows:
1. For public owned collection systems, the Grease Control Program shall include at least
biannual distribution of educational materials for both commercial and residential users and
the legal means to require grease interceptors at existing establishments. The plan shall also
include legal means for inspections of the grease interceptors,enforcement for violators and
the legal means to control grease entering the system from other public and private satellite
sewer systems.
2. For privately owned collection systems,the Grease Control Program shall include at least bi-
annual distribution of grease education materials to users of the collection system by the
permittee or its representative.
3. Grease education materials shall be distributed more often than required in Parts(1)and(2)
of this Subparagraph if necessary to prevent grease-related sanitary sewer overflows.
i. Right-of-ways and easements shall be maintained in the full easement width for personnel and
equipment accessibility.
j. Documentation shall be kept for Subparagraphs(a)through(i)of this Rule for a minimum of three
years with exception of the map,which shall be maintained for the life of the system.
5. Noncompliance Notification:
The Permittee shall report by telephone to a water resources staff member at the Wilmington
Regional Office,telephone number(910)796-7215,as soon as possible, but in no case more than 24
hours or on the next working day,following the occurrence or first knowledge of the occurrence of
either of the following:

a. Any process unit failure,due to known or unknown reasons,that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage,etc.;or
b. Any SSO and/or spill over 1,000 gallons;or
c. Any SSO and/or spill,regardless of volume,that reaches surface water

verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number (800) 858-0368 or (919) 733-3300.
Persons reporting any of the above occurrences shall file a spill report by completing and submitting
Part I of Form CS-SSO (or the most current Division approved form) within five days following first
knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to
ensure that the problem does not recur. Part II of Form CS-SSO(or the most current Division approved
form)can also be completed to show that the SSO was beyond control. [G.S.143-215.1C(a1)]
6. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State. [15A NCAC 02T.0108(b)J
7. Upon completion of construction and prior to operation of these permitted facilities, the completed
Engineering Certification form with checklist attached to this permit shall be submitted with the
required supporting documents to the address provided on the form. A complete certification is one
where the form is fully executed and the supporting documents are provided as applicable. Any
wastewater flow made tributary to the wastewater collection system extension prior to completion
of this Engineer's Certification shall be considered a violation of the permit and shall subject the
Permittee to appropriate enforcement actions.
If the permit is issued to a private entity with an Operational Agreement,then a copy of the Articles
of Incorporation, Declarations/Covenants/Restrictions, and Bylaws that have been appropriately
filed with the applicable County's Register of Deeds office shall be submitted with the certification.
A complete certification is one where the form is fully executed and the supporting documents are
provided as applicable. Supporting documentation shall include the following:
a. One copy of the project construction record drawings(plan&profile views of sewer lines&force
mains) of the wastewater collection system extension. Final record drawings should be clear on
the plans or in accepted electronic format and are defined as the design drawings that are marked
up or annotated with after construction information and show required buffers, separation
distances,material changes, etc.
b. One copy of the supporting applicable design calculations including pipe and pump sizing,velocity,
pump cycle times, and level control settings, pump station buoyancy, wet well storage, surge
protection, detention time in the wet well, and force main, ability to flush low points in force
mains with a pump cycle,and downstream sewer capacity analysis. If a portable power source or
pump is dedicated to multiple stations,an evaluation of all the pump stations'storage capacities
and the rotation schedule of the portable power source or pump,include travel timeframes,shall
be provided.
c. Changes to the project that do not result in non-compliance with this permit, regulations,or the
Minimum Design Criteria should be clearly identified on the record drawings,on the certification

Prior to Certification(Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (including pipe length changes of 10% or greater by type & size,
increased flow, pump station design capacity design increases of 5%or greater,and increases in the
number/type of connections),regulations,or the Minimum Design Criteria. Requested modifications
or variances to the Minimum Design Criteria will be reviewed on a case-by-case basis and each on its
own merit. Please note that variances to the Minimum Design Criteria should be requested and
approved during the permitting process prior to construction. After-construction requests are
discouraged by the Division and may not be approved,thus requiring replacement or repair prior to
certification&activation. [15A NCAC 02T.0116]
8. Gravity sewers installed greater than ten percent below the minimum required slope per the Division's
Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until
corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined,a slope variance can be requested from the Division with firm supporting documentation.
This shall be done through a permit modification with fee. Such variance requests will be evaluated
on a case-by-case basis.Resolution of such request shall be evident prior to completing and submitting
the construction certification. [ 15A NCAC 02T.0105(n)]
9. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of
the wastewater collection facilities. [15A NCAC 02T.0116]
10. Failure to abide by the conditions and limitations contained in this permit;15A NCAC 2T;the Division's
Gravity Sewer Design Criteria adopted February 12,1996 as applicable;the Division's Minimum Design
Criteria for the Fast-Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as
applicable; and other supporting materials may subject the Permittee to an enforcement action by
the Division, in accordance with North Carolina General Statutes§143-215.6A through §143-215.6C,
construction of additional or replacement wastewater collection facilities,and/or referral of the North
Carolina-licensed Professional Engineer to the licensing board. [15A NCAC 02T.0104; 1SA NCAC 02T
.0108(b-c)]
11. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions,the Permittee shall take immediate corrective action,including those
as may be required by this Division, such as the construction of additional or replacement facilities.

12. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules,regulations,or ordinances that may be imposed by the Division any other Federal,State,or Local
government agencies which have jurisdiction or obtaining other permits which may be required by

13. If the Permittee/Applicant holds a system-side collection system operation, maintenance and
management permit (WQCS-prefix) from the Division, then the following applies: For all newly
constructed,modified and rehabilitated pump stations,all equipment and components shall be sealed
within a corrosion-resistant coating or encasement to the extent practicable and equivalent to the
minimum design criteria unless the permittee can demonstrate it is not practicable or another form

In accordance with your documentation received June 3, 2010, we are forwarding the corrected
Permit No. WQ0034485, dated June 4, 2010, to the Pluris, LLC for the construction and operation upon
certification of the subject wastewater collection system extension. This permit shall be effective from
the date of issuance until rescinded and shall be subject to the conditions and limitations as specified
therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein
by reference.
This correction replaces the permit version dated January 15, 2010 and addresses existing commercial
connections that were granted a variance under the previous permit (WQ0017535) to operate with a
simplex pump station in lieu of a duplex station as required by State regulations. In addition, it clarifies
the allowance of residential connections via either gravity or pressure to existing sewer mains.
This permit describes a portion of the sewer system previously issued to North Topsail Utilities Incorporated
under a single, consolidated permit (WQ0017535) that will be voided upon issuance of the three new
permits that will ultimately be created. System changes are in the process of being designed for
implementation to increase the efficiency of the overall system that modeling has previously shown as
becoming degraded. In addition, the residential flow reduction rate of 80 gpd/bedroom with a
minimum of 160 cod that was granted on November 6, 2009 for systems on the mainland is being
applied where possible.
Please pay particular attention to Conditions 17 & 18 regarding connections to existing lines and existing
variances for identified commercial connections to utilize simplex pump station connections.
Please note the following standard conditions that are contained in this permit.
Condition 3: Requires that the wastewater collection facilities be properly operated and
maintained in accordance with 15A NCAC 2T .0403 or any individual system-wide
collection system permit issued to the Permittee.

Criteria for the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as
applicable; and other supporting data subsequently filed at time of application and approved by the
Department of Environment and Natural Resources upon issuance and considered a part of this permit;

The continued operation, construction and operation upon certification, or construction only of
wastewater collection system extensions or connections previously permitted and consolidated into this
permit listed below as part of the Sneads Ferry South Consolidated Sewer Basin with the potential
discharge of at least 138,170 gallons per day of collected domestic wastewater into the Pluris, LLC's
existing sewerage system pursuant to the original request received September 21, 2009.
The sewage and wastewater collected by this system shall be treated in the Pluris North Topsail
Wastewater Treatment Facility (Permit No. WQ0005849) prior to being land applied by spray irrigation or
rapid infiltration.
For the continued operation of approximately 1,420 linear feet of 8-inch gravity sewer; a 79-gallon per
minute pump station with duplex pumps, on-site audible and visual high water alarms, telemetry, and a
portable generator receptacle with approximately 561 linear feet of 4-inch force main to serve 24 four-
bedroom residences as part of the Old Millstone Landing Sewer project (previously permitted under
WQ0030060) and the discharge of 7,680 gallons per day (reduced from 13,440 gpd w/flow reduction
applied) of collected domestic wastewater into the Pluris, LLC's existing sewerage system, pursuant to
the application received December 4, 2008. Certified complete on September 18, 2009.
For the construction and operation upon certification of approximately 4,800 linear feet of 8-inch gravity
sewer to serve 102 three-bedroom residences as part of The Landing @ Mill Creek Phase 2 project, and
the discharge of 24,480 gallons per day (reduced from 36,720 gpd w/flow reduction applied) of
collected domestic wastewater into Pluris, LLC's existing sewerage system, pursuant to the application
received December 13, 2007.
Continued operation of approximately 328 linear feet of 8-inch gravity sewer, a centrifugal duplex
grinder pump station with on-site audible and visual high water alarms, telemetry, portable standby
generator connection, and approximately 76 linear feet of 3-inch force main to serve the commercial
development at CNSL Investments (4 buildings consisting of a fish market, coffee shop, retail store and
office space) and the discharge of 1,770 gallons per day of collected commercial & domestic
wastewater into the Pluris, LLC's existing sewerage system, pursuant to the application received June 13,
2006;
WQ0008971 dated January 4, 2001 - Mill Run at North Shore - approximately 5,804 linear feet of 8-inch
gravity sewer to serve 13 three-bedroom lots in Mill Run at North Shore (Lots 6, 7, 9, 12, 14, 16, 18, 20-22,
24, 31, and 35) with a permitted flow volume of 3,120 gallons per day (reduced from 4,680 qpd w/flow
reduction applied).
WQ0014790 dated July 17, 2000- Chadwick Acres/Crystal Cove-approximately 10,250 linear feet of 8-
inch gravity sewer; a 11-gallon per minute, 64-gallon per minute, 107-gallon per minute, and 215-gallon
per minute pump station each with duplex pumps, on-site audible and visual high water alarms, and
portable standby power supplies; and approximately 1,900 linear feet of 2-inch force main; 450 linear
feet of 2.5-inch force main; approximately 2,328 linear_feet of 3-inch force main, approximately 1,878

force main; approximately 25,100 linear feet of 8-inch force main; a 350-gallon per minute (main), a 100-
gallon per minute (#2), a 20-gallon per minute (#1), a 30-gallon per minute (#3), and a 60-gallon per
minute (#4) pump station all equipped with dual pumps and high water alarms to serve a total of 57
three-bedroom lots in Golden Acres Subdivision (Lots 1, 2, 4, 6-8, 10-22, 29-33, 37, 39, 40, 48, 52, 66, 68, 69,
81, 82, 84, and 85) and Pages Golden Acres (Lots 1, 2, 5, 11-13, 16-20, 22-30, and 64) with a permitted
flow volume of 13,680 gallons per day (reduced from 20,520 clod w/flow reduction applied).
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T or rules in effect at the time of original
issuance; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted
February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting
materials unless specifically mentioned herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system-wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T
.0403:
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency,
preventative maintenance schedule, spare parts inventory, and overflow response shall be
developed and implemented.
d. Pump stations that are not connected to a telemetry system (i.e. remote alarm system) shall
be inspected by the Permittee or its representative every day (i.e. 365 days per year). Pump
stations that are connected to a telemetry system shall be inspected at least once per week.

b. One copy of the supporting pump station design calculations (selected pumps, system curve,
operating point, buoyancy calculations, available storage if portable generator(s) or storage
greater than longest past three year outage reliability option selected) for any pump stations
permitted as part of this project.
c. Changes to the project that do not result in non-compliance with this permit, regulations, or
the Minimum Design Criteria should be clearly identified on the record drawings, on the
certification in the space provided, or in written summary form.
Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (including pipe length increases of 10% or greater, increased flow,
pump station design capacity design increases of 5% or greater, and increases in the number/type
of connections), regulations, or the Minimum Design Criteria. Requested modifications or variances
to the Minimum Design Criteria will be reviewed on a case-by-case basis and each on its own merit.
Please note that variances to the Minimum Design Criteria should be requested and approved
during the permitting process prior to construction. After-construction requests are discouraged by
the Division and may not be approved, thus requiring replacement or repair prior to certification &
activation.
7. Gravity sewers installed greater than ten percent below the minimum required slope per the
Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified
until corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting
documentation. This shall be done through a permit modification with fee. Such variance requests
will be evaluated on a case-by-case basis. Resolution of such request shall be evident prior to
completing and submitting the construction certification.
8. A copy of the construction record drawings and pump station designs, if applicable, shall be
maintained on file by the Permittee for the life of the wastewater collection facilities.
9. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast-Track Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
10. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
11. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by other government agencies (local, state
and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the
Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A
NCAC 2B .0200 and 15A NCAC 2H .0500.
12. NON-COMPLIANCE NOTIFICATION:
The Permittee shall verbally report to a Division of Water Quality staff member at the Wilmington
Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than
24 hours or on the next working day, following the occurrence or first knowledge of the occurrence
of either of the following:
a. Any failure, due to known or unknown reasons, that renders the system incapable of
adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or

18. Any commercial entity operating with a simplex pump station must immediately cease operations
upon activation of the high water alarm. No additional wastewater is to be generated until the
condition creating the alarm has been remedied.
The following locations may continue to utilize a simplex pump station in lieu of the required duplex
pump station as required under a variance issued with the January 6, 2006 permit issuance of
WQ0017535 that was voided by the issuance of this permit. Any change in the owner/occupant of
these establishments that causes the flow to exceed 600 GPD where a simplex station exists, then
the station shall be immediately upgraded to a duplex station meeting the current regulations and
the Division adopted minimum design criteria.

Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically
mentioned herein. Division approval is based on acceptance of the certification provided by the North
Carolina-licensed Professional Engineer named in the application.
It shall be the Pluris, LLC's responsibility to ensure that the as-constructed project meets
the appropriate design criteria and rules. Failure to comply may result in penalties in
accordance with North Carolina General Statute §143-215.6A through §143-215.6C,
construction of additional or replacement wastewater collection facilities, and/or referral
of the North Carolina-licensed Professional Engineer to the licensing board.
A stormwater management plan shall be submitted to and approved by the Wilmington Regional
Office in accordance with 15A NCAC 2H .1000.

amended, other applicable Laws, Rules, and Regulations, and in conformity with 15A NCAC 2T; the
Division's Gravity Sewer Minimum Design Criteria adopted February 12, 1996 and Minimum Design
Criteria for the Fast-Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as
applicable; and other supporting data subsequently filed at time of application and approved by the
Department of Environment and Natural Resources upon issuance and considered a part of this permit;
PERMISSION IS HEREBY GRANTED TO:

ONSLOW COUNTY
The continued operation, construction and operation upon certification, or construction only of
wastewater collection system extensions or connections previously permitted and consolidated into this
permit listed below as part of the Sneads Ferry North Consolidated Sewer Basin with the potential
discharge of at least 31,220 gallons per day of collected domestic wastewater into the Pluris, LLC's
existing sewerage system pursuant to the original request received September 21, 2009.
The sewage and wastewater collected by this system shall be treated in the Pluris North Topsail
Wastewater Treatment Facility (Permit No. WQ0005849) prior to being land applied by spray irrigation or
rapid infiltration.
Continued operation of a 9 to 15-gallon per minute pump station with duplex pumps and on-site
audible and visual high water alarms, telemetry, approximately 270 linear feet of 1.25-inch force main
and approximately 345 linear feet of 4-inch force main to serve office space associated with The Village
Phase 1 and the discharge of 1,080 gallons per day of collected domestic wastewater into the Pluris,
LLC's existing sewerage system pursuant to the application received May 6, 2005; and flow increase per
a December 13,2007 application;
Continued construction and operation upon certification of approximately 1,285 linear feet of 8-inch
gravity sewer, a 150-gallon per minute pump station with duplex pumps and on-site audible and visual
high water alarms, telemetry, on-site standby generator with automatic transfer switch, and
approximately 663 linear feet of 3-inch force main to serve future commercial development at The
Village Phase 2 and the discharge of 3,960 gallons per day of collected domestic & commercial
wastewater for a McDonalds restaurant into Pluris, LLC's existing sewerage system pursuant to the
application received January 30, 2006 and reduction of flow allocation from 65,000 gpd per a
December 13,2007 application;
Continued operation of a 32-gallon per minute centrifugal duplex grinder pump station with on-site
audible and visual high water alarms, telemetry, and portable generator hookup; and approximately
500 linear feet of 2-inch force main to serve the 8 two-bedroom units of the Manchester Apartments
project and the discharge of 1,280 gallons per day (reduced from 1,920 w/flow reduction applied) of
collected wastewater into the Pluris, LLC's existing sewerage system, pursuant to the application
received June 29, 2006;
Continued operation of approximately 711 linear feet of 10-inch force main across Stones Creek on NC
Highway 210 due to a project by NCDOT requiring its relocation as part of the DOT Bridge (B-4215)
Replacement project with no additional discharge of wastewater into the Pluris, LLC's existing sewerage
system, pursuant to the application received August 20, 2007.
Consolidated Permits/Systems
WQ0000959 dated January31, 1989 - Dixon ElementarySchool -oa 85-gallonper minute duplex pump

station with submersible pumps, high water alarms and standby power outlet and approximately 925
linear feet of 4-inch force main and 1,900 linear feet of 12-inch force main to serve Dixon Elementary
School with a permitted flow volume of 7,200 gpd.
WQ0005887 dated August 6, 1992-Dixon Junior and Senior High Schools-approximately 121 linear feet
of 8-inch gravity sewer, an 85-gallon per minute pump station with duplex pumps and high water
alarms, approximately 96 linear feet of 4-inch force main and approximately 15,736 linear feet of 10-
inch force main to serve Dixon Junior and Senior High Schools, with a permitted flow volume of 5,700
gallons per day.
WQ0010698 dated August 18, 1995- Loggerhead Inn-a 50-gallon per minute pump station with duplex
pumps, high water alarms, portable generator receptacle, and approximately 190 linear feet of 3-inch
force main to serve 60 hotel rooms with a permitted flow volume of 12,000 gallons per day.
WQ0022249 dated April 4, 2003 - Atlantic Plaza Commercial - construction only of approximately 2,525
linear feet of 8-inch gravity sewer; 140 linear feet of 4-inch force main; and a 80-gallon per minute pump
station to serve unspecified commercial development with a permitted flow volume of zero (0) gpd.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the wastewater collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2T or rules in effect at the time of original
issuance; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted
February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast-Track Permitting
of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting
materials unless specifically mentioned herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system-wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2T .0403. If an individual
permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2T
.0403:
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency,
preventative maintenance schedule, spare parts inventory, and overflow response shall be
developed and implemented.
d. Pump stations that are not connected to a telemetry system (i.e. remote alarm system) shall
be inspected by the Permittee or its representative every day (i.e. 365 days per year). Pump
stations that are connected to a telemetry system shall be inspected at least once per week.

e. High-priority sewer lines shall be inspected by the Permittee or its representative at least once
per every six-month period of time.
f. A general observation of the entire sewer system shall be conducted by the Permittee or its
representative at least once per year.
g. Overflows and bypasses shall be reported to the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by
North Carolina General Statute §143-215.1 C.
h. A Grease Control Plan shall be implemented as follows:
1. For publicly owned collection systems, the Program shall include at least bi-annual
distribution of educational materials for both commercial and residential users and the
legal means to require grease interceptors for new construction and retrofit, if necessary, of
grease interceptors at existing establishments. The Program shall also include legal means
for inspections of the grease interceptors, enforcement for violators, and the legal means
to control grease entering the system from other public or private satellite sewer systems.
2. For privately owned collection systems, the Program shall include at least bi-annual
distribution of educational materials to all users of the collection system by the Permittee or
its representative.
3. Grease education materials shall be distributed more often than required in Parts 1 or 2 of
this sub-paragraph if necessary to prevent grease-related sanitary sewer overflows.
i. Right-of-ways and easements shall be maintained in the full easement width for personnel and
equipment accessibility.
j. Documentation shall be kept on file for Sections (a.) through (i.) of this rule for a minimum of
three (3) years with the exception of the map, which shall be maintained for the life of the
system.
4. This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be considered
on its merits and may or may not be approved.
5. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State.
6. Per 15A NCAC 2T .01 16, upon completion of construction and prior to operation of these permitted
facilities, the completed Engineering Certification form attached to this permit shall be submitted
with the required supporting documents (as-built or recording drawings and pump station designs, if
applicable) to the address provided on the form. A complete certification is one where the form is
fully executed and the supporting documents are provided as applicable. Any wastewater flow
made tributary to the wastewater collection system extension prior to completion of this Engineer's
Certification shall be considered a violation of the permit and shall subject the Permittee to
appropriate enforcement actions.
If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles
of Incorporation, Declarations, and Bylaws that have been appropriately filed with the applicable
County's Register of Deeds office shall be submitted with the certification.
A complete certification is one where the form is fully executed and the supporting documents are
provided as applicable. Supporting documentation shall include the following:
a. One copy of the project construction record drawings (plan & profile views of sewer lines &
force mains) of the wastewater collection system extension. Record drawings are defined as
the design drawings that are marked up or annotated with after construction information and
show required buffers, separation distances, material changes, etc.

b. One copy of the supporting pump station design calculations (selected pumps, system curve,
operating point, buoyancy calculations, available storage if portable generator(s) or storage
greater than longest past three year outage reliability option selected) for any pump stations
permitted as part of this project.
c. Changes to the project that do not result in non-compliance with this permit, regulations, or
the Minimum Design Criteria should be clearly identified on the record drawings, on the
certification in the space provided, or in written summary form.
Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in
non-compliance with this permit (including pipe length increases of 10% or greater, increased flow,
pump station design capacity design increases of 5%or greater, and increases in the number/type
of connections), regulations, or the Minimum Design Criteria. Requested modifications or variances
to the Minimum Design Criteria will reviewedg be on a case-by-case basis and each on its own merit.
Please note that variances to the Minimum Design Criteria should be requested and approved
during the permitting process prior to construction. After-construction requests are discouraged by
the Division and may not be approved, thus requiring replacement or repair prior to certification &
activation.
7. Gravity sewers installed greater than ten percent below the minimum required slope per the
Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified
until corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting
documentation. This shall be done through a permit modification with fee. Such variance requests
will be evaluated on a case-by-case basis. Resolution of such request shall be evident prior to
completing and submitting the construction certification.
8. A copy of the construction record drawings and pump station designs, if applicable, shall be
maintained on file by the Permittee for the life of the wastewater collection facilities.
9. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2T; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast-Track Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
10. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
11. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by other government agencies (local, state
and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A
NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the
Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A
NCAC 2B .0200 and 15A NCAC 2H .0500.
12. NON-COMPLIANCE NOTIFICATION:
The Permittee shall verbally report to a Division of Water Quality staff member at the Wilmington
Regional Office, -g c , telephone number (910) 796 7215, as soon as possible, but in no case more than
24 hours or on the next working day, following the occurrence or first knowledge of the occurrence
of either of the following:
a. Any failure, due to known or unknown reasons, that renders the system incapable of
adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.;or

b. Any failure of a pumping station or sewer line resulting in a by-pass of any wastewater directly
to receiving waters from the station or sewer line.
Voice mail messages or faxed information is permissible, but shall NOT be considered as the initial
verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number(800) 858-0368 or (919) 733-3300.
Persons reporting any of the above occurrences shall file a spill report by completing Part I of Form
CS-SSO (or the most current Division approved form), within five days following first knowledge of
the occurrence. This report shall outline the actions taken or proposed to ensure that the problem
does not recur. Part II of Form CS-SSO (or the most current Division approved form) can also be
completed to show that the SSO was beyond control.
13. Each pump station including simplex stations shall be clearly and conspicuously posted with the
telephone number and name of the owner/operator of the sewer system and instructions to call
the number in the event of alarm activation.
14. The Permittee shall maintain on hand for immediate installation a supply of spare, fully operational
pump units of each simplex type used in the sewer system. The number of pumps on hand shall not
be less than two (2) percent of the number of installed units or one unit, whichever is greater.
15. A minimum of 90 gallons of storage capacity above the pump-on activation level to meet the
greater of the Permittee response time for service or the longest non-catastrophic power outage of
the previous three years for any simplex pump station serving a single family residence. This is based
on a three-bedroom residence. The Permittee is advised that since many of these residences
actually serve as 4 and 5 bedroom residences during the resort season, any overflows due to
inadequate storage will be subject to enforcement action.
16. The Permittee shallprovide for the pumpstation and force main the followingitems:
a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in
the pump station,
b. An air relief valvelocatedall at high points along the force main,
c. A screened vent for the wetwell,
d. Fillets located in the wetwell at the intersection of the flooring and sidewalls,
e. Three feet of cover (minimum) over the force main or the use of ferrous material where
three feet cannot be maintained,
f. Sufficient devices which will protect the pump station from vandals, and
g. Flood protection if the pump station is located below the 100-year flood elevation.
17. The projects in this permit indicated to be for construction only of the wastewater collection
facilities must have flow allocation provided prior to activation. Flow allocation requires a permit
modification application to be submitted (with the appropriate fee), a modified permit be issued,
and the Engineer's Certification is received and approved by the Division.
18. All new connections are allowed on existing sewer line only and may be any combination of
gravity or pressure sewer taps. New direct residential connections to existing systems may be either
be gravity or pressure, but simplex pressure connections shall be 25- 50 GPM simplex pump stations
with on-site audible and visual high water alarms.

A new, separate permit application is required if any of the following scenarios should arise:
• Any connections requiring additional collection lines.
• For new potential commercial, non-residential establishments projected to generate a flow
of 600 gallons per day or less as properly calculated using flow rates per NCAC 15A 2T .0114
and connecting to the pressure system may request a variance to the requirement to install
a duplex station prior to construction. Each variance request will be evaluated on its own
individual merit by providing supporting documentation for each location/connection and
may or may not be approved. Approved variances shall be noted in the individual permit
issued for the project/connection and variances that are denied will require the installation
of a duplex station.
19. Any commercial entity operating with a simplex pump station must immediately cease operations
upon activation of the high water alarm. No additional wastewater is to be generated until the
condition creating the alarm has been remedied.
The following locations may continue to utilize a simplex pump station in lieu of the required duplex
pump station as required under a variance issued with the January 6, 2006 permit issuance of
WQ0017535 that was voided by the issuance of this permit. Any change in the owner/occupant of
these establishments that causes the flow to exceed 600 GPD where a simplex station exists, then
the station shall be immediately upgraded to a duplex station meeting the current regulations and
the Division adopted minimum design criteria.

In accordance with your application received February 2, 2017, we are forwarding herewith Permit No.
WQCS00249, dated March 15, 2017, to the Onslow Water and Sewer Authority for the operation and
maintenance of the subject wastewater collection system.
This permit shall be effective from March 15, 2017 until December 31, 2025 and shall be subject to the
conditions and limitations specified herein. It is your responsibility to thoroughly review this permit. Please
pay particular attention to the monitoring and reporting requirements in this permit and any special
conditions.
Changes have been made to the boiler plate language of the permit. Most of the changes are for clarification
purposes, however Condition 1(3) has been removed. The Department of Environmental Quality (DEQ)
believes that condition was included erroneously in previous permits. It was included based on proposed
rulemaking by EPA which was never promulgated and, in the continued absence of Federal regulations, DEQ
lacks authority to include such language in a permit. DEQ will continue to exercise enforcement discretion
when evaluating sanitary sewer overflows that may be considered to be beyond the reasonable control of the

For purposes of permitting, the collection system is considered to be any existing or newly installed system
extension up to the wastewater treatment facility property or point of connection with a separately owned
sewer system. The collection system is considered all gravity lines, pump stations,force mains, low pressure 1
sewer systems, STEP systems, vacuum systems, etc. and associated piping, valves and appurtenances that
help to collect, manage and transport wastewater to a wastewater treatment plant under the Permittee's
ownership or maintained and operated by the Permittee through a perpetual legal agreement. Satellite
systems are systems tributary to the Permittee's collection system but those collection systems are not owned
or maintained by the Permittee.The system description provided on Page 1 of this permit is meant to provide
a general idea about the size of the system and may not be all inclusive of the collection system at the time of
permit issuance or afterward.

A discharge of wastewater to the environment from the Permittee's wastewater collection system prior to
reaching the wastewater treatment facilities is referred to herein as a Sanitary Sewer Overflow (S50). The
evaluation of enforcement options after an SSO will be determined considering all relevant information
available or requested of the Permittee. Compliance with all conditions of the permit as well as all statutes
and regulations pertaining to the wastewater collection system must be maintained or appropriate
enforcement actions may be taken as noted in Condition VI(2).
A reportable SSO is an SSO greater than 1,000 gallons to the ground or an SSO of any amount that reaches
surface water(including through ditches, storm drains, etc.). Reporting requirements including the required
verbal report and written report to the appropriate regional office are referenced in Condition IV(2). Form

A notice of deficiency(NOD), notice of violation (NOV), civil penalty,and/or a moratorium on the addition of
waste to the system may be issued if adequate justification for an SSO is NOT submitted to the regional office.
In order to submit a claim for justification of an SSO, you must use Part II of form CS-SSO with additional
documentation as necessary. DWR staff will review the justification claim and determine if enforcement
action is appropriate. Please be advised that the information needed to justify a spill is very comprehensive.

deemed permitted satellite communities pursuant to the application received February 6, 2017, and in
conformity with the documents referenced therein and other supporting data subsequently filed and
approved by the Department of Environmental Quality and considered a part of this permit.
This permit shall be effective from March 15, 2017 until December 31, 2025, and shall be subject to the
following specified conditions and limitations:

I. PERFORMANCE STANDARDS •
1. The sewage and wastewater collected by this system shall be treated in the properly permitted
Wastewater Treatment Facility identified in the permit application and documented in the Division's
database. [15A NCAC 02T.0108(b)]
2. The wastewater collection system shall be effectively managed, maintained and operated at all times
to prevent discharge to land or surface waters, and to prevent any contravention of groundwater
standards or surface water standards. In the event that the wastewater collection system fails to
perform satisfactorily,including the creation of nuisance conditions,the Permittee shall take immediate
actions as per the Response Action Plan (Condition 11(9)),as well as any actions that may be required by
the Division of Water Resources(Division),such as the construction of additional or replacement sewer
lines and/or equipment. [15A NCAC 02T.0108 (b)]
3. The Permittee shall establish by ordinance, inter-local agreement or contract its legal authority to
require new sewers be properly constructed; to ensure proper inspection and testing of sewer mains
and service laterals;to address flows from satellite systems and to take enforcement action as required
by Condition 1(4). [G.S. 143-215.9B; G.S. 143-215.1(f)(1)]
4. The Permittee shall develop and implement an educational fats, oils and grease program that shall
include at least semiannual distribution of educational material targeted at both residential and non-
residential users.The Permittee shall also develop and implement an enforceable fats, oils and grease
program for non-residential users under which the Permittee can take enforcement against users who
have not properly installed, operated and maintained grease traps or grease interceptors as directed
or otherwise violated the terms of the enforcement program pertaining to fats, oils and grease.

5. The Permittee shall adopt and implement a Capital Improvement Plan (CIP) to designate funding for
reinvestment into the wastewater collection system infrastructure.The CIP should address the short-
term needs and long-term "master plan" concepts. The CIP should typically cover a three to five year
period and include a goal statement,description of the project area,description of the existing facilities,
known.deficiencies (over a reasonable period) and forecasted future needs. Cost analysis is integral to
the CIP. [G.S. 143-215.9B]
6. Overflow piping from manholes and pump stations, excluding piping to approved equalization•
structures, known or discovered after permit issuance shall be immediately removed or permanently
capped. Plugged or valved emergency pumping connections are allowable for portable pumping or
rerouting without intentionally bypassing the wastewater treatment facility.

The Permittee shall maintain a contingency plan for pump failure at each pump station. If one of the
pumps in a pump station containing multiple pumps fails,the process of repairing or replacing the pump
shall be initiated immediately and the new parts or pump shall be installed as soon as possible. The
permittee shall provide justification for delay in initiating the process for repair or replacement at the
Division's request. If the pump in a simplex pump station serving more than a single building or pump
stations not capable of pumping at a rate of 2.5 times the average daily flow rate with the largest pump
out of service fails, it shall be replaced immediately. [15A NCAC 02T.0305 (h) (1)]

'8. Each pump station shall be clearly and conspicuously posted with a pump station identifier and an
emergency contact telephone number at which an individual who can initiate or perform emergency
service for the wastewater collection system 24 hours per day,seven days per week can be contacted.
This emergency contact telephone number shall be coupled with instructions that the emergency
contact should be called if the visual alarm illuminates, if the audible alarm sounds,or if an emergency
is apparent. [15A NCAC 02T.0305 (h) (2)]
9. Pump station sites, equipment and components shall have restricted access.

10.1 Pump stations that do not employ an automatic polling feature(i.e.routine contact with pump stations
from a central location to check operational status of the communication system) shall have both
audible and visual high water alarms. The alarms shall be weather-proof and placed in a clear and
conspicuous location. Permits issued for the construction of pump stations that included high water
alarms in the description must maintain the alarms even if simple telemetry(i.e.notification of an alarm
condition initiated by the pump station control feature) is installed.

11. For all newly constructed, modified and rehabilitated pump stations, all equipment and components
shall be sealed within a corrosion-resistant coating or encasement to the extent practicable and
equivalent to the minimum design criteria unless the permittee can demonstrate it is not practicable
or another form of corrosion resistance is employed. [15A NCAC 02T.0108(b)]
II. OPERATION AND MAINTENANCE REQUIREMENTS
1. Upon classification of the collection system by the Water Pollution Control System Operators
Certification Commission(WPCSOCC),the Permittee shall designate and employ a certified operator to
be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the
facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the system within 24 hours of
knowledge of a bypass,spill,or overflow of wastewater from the system, unless visited by the Back-Up
ORC,and shall comply with all other conditions of 15A NCAC 8G .0204.

2. The Permittee shall develop and adhere to a schedule for reviewing all inspection, maintenance,
operational and complaint logs. If the review process results in the identification of any recurring
problem in the wastewater collection system that cannot be resolved in a short time period, the
Permittee shall establish a plan for addressing the problem(s). [15A NCAC 02T.0108 (b)]
3. The Permittee shall develop and adhere to a schedule for testing emergency and standby equipment.

The Permittee shall develop and implement a routine pump station inspection and maintenance
program which shall include the following maintenance activities:
a. Cleaning and removing debris from the pump station structure, outside perimeter, and wet
well;
b. Inspecting and exercising all valves;
c. Inspecting and lubricating pumps and other mechanical equipment;and
d. Verifying the proper operation of the alarms,telemetry system and auxiliary equipment.

'5. For each pump station without pump reliability(i.e.simplex pump stations serving more than a single •
building or pump stations not capable of pumping at a rate of 2.5 times the average daily flow rate with
the largest pump out of service), at least one fully operational spare pump capable of pumping peak
flow shall be maintained on hand. [15A NCAC 02T.0305 (h) (1) (A)]
6. The Permittee shall maintain on hand at least two percent of the number of pumps installed, but no
less than two pumps, that discharge to a pressure sewer and serve a single building, unless the
Permittee has the ability to purchase and install a replacement pump within 24 hours of first knowledge
of the simplex pump failure or within the storage capacity provided in a sewer line extension permit.

7. Rights-of-way and/or easements shall be properly maintained to allow accessibility to the wastewater
collection system unless the Permittee can demonstrate the ability to gain temporary access in an
emergency situation where existing land-use conditions do not allow the establishment and
maintenance of permanent access. In this case, the Permittee shall continue to observe the lines
visually, utilize remote inspection methods (e.g. CCTV) and use the opportunity of drier conditions to
perform further inspections and necessary maintenance. [15A NCAC 02T.0108 (b)]
8. The Permittee shall assess cleaning needs, and develop and implement a program for appropriately
cleaning,whether by hydraulic or mechanical methods,the wastewater collection system. At least 10
percent of the gravity wastewater collection system, selected at the discretion of the ORC, shall be
cleaned each year. Preventative cleaning is not required for sewer lines less than five years old unless
inspection otherwise reveals the need for cleaning or cleaning is required by a sewer line extension
permit. [15A NCAC 02T.0108 (b)]
9. The Permittee shall maintain a Response Action Plan that addresses the following minimum items:
a. Contact phone numbers for 24-hour response, including weekends and holidays;
b. Response time;
c. Equipment list and spare parts inventory;
d. Access to cleaning equipment;
e. Access to construction crews, contractors and/or engineers;
f. Source(s)of emergency funds;
g. Site restoration and clean up materials; and
h. Post-SSO assessment.

10. The Permittee, or their authorized representative, shall conduct an on-site evaluation for all SSOs as
soon as possible,but if feasible no more than two hours after first knowledge of the SSO. The Permittee
shall document in its 5-day report why it was unable to initially respond to any SSO location within two
hours. [15A NCAC 02T.0108 (b)]
11. In the event of an SSO or blockage within the wastewater collection system,the Permittee shall restore
the system operation, remove visible solids and paper, restore any ground area and restore the
surroundings. [15A NCAC 02T.0108 (b)]
III. RECORDS
1. Records shall be maintained to document compliance with Conditions 1(4), 11(2)- 11(4), 11(7) - 11(8), IV(3)
and V(1)-V(4). Records shall be kept on file for a minimum of three years. [15A NCAC 02T.0108(b)]

'2. The Permittee shall maintain adequate records pertaining to SS0s, and SSO or wastewater collection
system complaints for a minimum of three years. These records shall include, but are not limited to,
the following information:
a. Date of SSO or complaint;
b. Volume of wastewater released as a result of the SSO and/or nature of complaint;
c. Location of the SSO and/or complaint;
d. Estimated duration of the SSO;
e. Individual from the Division who was informed about the SSO and/or complaint, when
applicable;
f. Final destination of the SSO;
g. Corrective actions;
h. Known environmental/human health impacts resulting from the SSO; and
i. How the SSO was discovered.

3. The Permittee shall maintain an up-to-date,accurate,comprehensive map of its wastewater collection
system that also notes the locations where other wastewater collection systems become tributary. If
a comprehensive map of the collection system has not been established,a rough sketch shall be drawn.
The Permittee shall map approximately 10 percent of its existing collection system each year for the
next ten years beginning at the original permit issuance date, or until complete, whichever is sooner.
The comprehensive map shall include, but is not limited to: pipe size, pipe material, pipe location,flow
direction, approximate pipe age, and each pump station identification, location and capacity. [15A
NCAC 02T.0108 (b)]
4. The Permittee shall maintain records of all of the modifications and extensions to the collection system
permitted herein. The Permittee shall maintain a copy of the construction record drawings and
specifications for modifications/extensions to the wastewater collection system for the life of the
modification/extension. Information concerning the extension shall be incorporated into the map of
the wastewater collection system within one year of the completion of construction. The system
description contained within this permit shall be updated to include this modification/extension
information upon permit renewal. [15A NCAC 02T.0108(b)]
IV. MONITORING AND REPORTING REQUIREMENTS
1. In the event of an SSO the Division may require monitoring that is necessary to ensure surface water
and groundwater protection and an acceptable sampling and reporting schedule shall be implemented.

2. The Permittee shall verbally report to a Division of Water Resources staff member at the Wilmington
Regional Office, at telephone number(910)796-7215 as soon as possible, but in no case more than 24
hours following first knowledge of the occurrence of the following circumstances within the collection
system which is under the Permittee's ownership or maintained and operated by the Permittee through
a perpetual legal agreement:
a. Any SSO and/or spill over 1,000 gallons to the ground;or
b. Any SSO and/or spill, regardless of volume,that reaches surface water.
Voice mail messages or faxed information shall not be considered as the initial verbal report. SSOs(and
other types of spills) occurring outside normal business hours may also be reported to the Division of
Emergency Management at telephone number(800)858-0368 or(919)733-3300.

• ' Persons reporting any of the above occurrences shall file a spill report by completing Part I'of Form CS-
SSO (or the most current Division approved form), within five business days following first knowledge
of the occurrence. This report shall outline the actions taken or proposed to ensure that the problem •
does not recur. [G.S. 143-215.1C(a1)]
3. The Permittee shall meet the annual reporting and notification requirements provided in North Carolina
General Statute§143-215.1C.
V. INSPECTIONS
1. The Permittee or the Permittee's designee shall inspect the wastewater collection system regularly to
reduce the risk of malfunctions and deterioration, operator errors, and other issues that may cause or
lead to the release of wastes to the environment,threaten human health or create nuisance conditions.
The Permittee shall keep an inspection log or summary including, at a minimum, the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by the
Permittee. [15A NCAC 02T.0108 (b)]
2.` Pump stations that are not connected to a telemetry system (i.e., remote alarm system) shall be
inspected by the permittee or its representative every day(i.e.,365 days per year). Pump stations that
are connected to telemetry shall be inspected at least once per week. [15A NCAC 02T.0108 (b)]
3. A general observation by the permittee or its representative of the entire wastewater collection system
shall be conducted at least once per year. [15A NCAC 02T.0108(b)]
4. Inspections of all high priority lines (i.e. aerial line, sub-waterway crossing, line contacting surface
waters, siphon, line positioned parallel to stream banks that are subject to eroding in such a manner
that may threaten the sewer line, or line designated as high-priority in a permit)shall be performed at
least once per every six-month period of time. A list of high-priority lines is presented as Attachment A
and is hereby incorporated into this permit condition. New high priority lines installed or identified
after permit issuance are incorporated by reference and subject to this permit condition until permit
renewal where they shall be referenced in writing in Attachment A. [15A NCAC 02T.0108 (b)]
VI. GENERAL CONDITIONS
1. This permit is not transferable. In the event that the Permittee desires to transfer ownership of the
wastewater collection system or there is a name change of the Permittee,a formal permit modification
request shall be submitted to the Division.The request shall be accompanied by documentation from
the parties involved, and other supporting materials as may be appropriate. Such request will be
considered on its merits and may or may not be approved. [15A NCAC 02T.0104; G.S. 143-215.1(d)(3)]
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statute §143-215.6A
through §143-215.6C,and a sewer moratorium may be established. [15A NCAC 02T.0104]
3. The issuance of this permit does not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by other government agencies(i.e., local,state,
and federal) having jurisdiction. [G.S. 143-215.1(b)]
4. The issuance of this permit does not prohibit the Division from reopening and modifying the permit,
revoking and reissuing the permit or terminating the permit as allowed by the laws, rules, and
regulations or as needed to address changes in federal regulations with respect to the wastewater
collection system,in accordance with required procedures. [G.S. 143-215.1(b)(4)]

• '5. The Permittee shall pay the annual fee within thirty(30) days after being billed by the Division. Failure
to pay the fee accordingly may cause the Division to initiate action to revoke this permit.

6. The Permittee shall file an application for renewal of this permit at least six months prior to the
expiration of this permit. Upon receipt of the request, the Director will review the adequacy of the
wastewater collection system described therein, and if warranted, will extend the permit for a period
of time and under such conditions and limitations, as the Director may deem appropriate. [15A NCAC
02T.0109]
7. The Permittee shall notify the Division's Pretreatment, Emergency Response and Collection Systems
Unit in writing at 1617 Mail Service Center, Raleigh, North Carolina 27699 of any changes to the name
and/or address of the responsible party (i.e. mayor, city/town manager) of the wastewater collection
system. [15A NCAC 02T.0106 (c)]
8. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials,enter and inspect any property, premises or place on or related to the collection system at
any reasonable time for the purpose of determining compliance with this permit, may inspect or copy
any records that must be maintained under the terms and conditions of this permit, and may obtain
samples of wastewater,groundwater, surface water,soil,or plant tissue.

9. The Permittee or their authorized representative shall have available a copy of this permit to present
upon request by any duly authorized officer, employee, or representative of the Division.

4) An eight-inch diameter gravity sewer line located near the intersection of Jenkins Street and
Hudiburg Streets in the town of Holly Ridge that has approximately 6 LF of PVC exposed at a
ditch crossing (to be replaced by DIP in 2017).
5) Approximately 48,000 LF of twelve-inch diameter PVC/DIP/HDPE force main along Highway 58
from the Burton Industrial Park Pump Station to the Town of Richlands (designated high priority
per Permit No. WQ0037017).

Holly Ridge Sewer District: Approximately 20 miles of gravity sewer line, approximately 15 miles of force
main and 13 duplex pump stations discharging to the Holly Ridge WWTP (WQ0019907) and the
Summerhouse WWTP (WQ0029945).
Northwest Sewer District: Approximately 15 miles of gravity sewer line, approximately 20 miles of force
main and 15 duplex pump stations discharging to the Northwest Regional WRF (WQ0034367).
Swansboro Sewer District: Approximately 24 miles of gravity sewer line, approximately 16 miles of force
main and 26 duplex pump stations discharging to the Swansboro WWTP (WQ0023261). -
Piney Green Sewer District: Approximately 15 miles of gravity sewer line, approximately 20 miles of
force main, and 10 pump stations discharging to the French Creek WWTP (NC0063029).
