This letter is in response to your request dated September 7, 2015, including two (2) revised
drawings dated September 7, 2015, to revise the utility plans for the project. Your request letter
indicates that the pawer and cable utility companies have reyuested to adjust their utility iine
locations to approximately 31' from the center line of the new roadway alignment, which is
approximately 10' to 15' closer to the new road alignment than currently authorized. The
adjustment would allow easier access to the utility lines from the road and reduce the need for
the utility connpanies to drive service trucks into the permitted wetland restoration area.
Additionally, the request indicates that the existing power pole, guy wires, and anchors would be
removed at Station 20+30 RT and the surrounding area restored to its natural state.
Please be advised that through this Letter of Refinement the N.C. Division of Coastal
Management (DCM) conveys its determination that the proposed revisions are consistent with
the existing State's rules and regulations and are in keeping with the original purpose and intent
of CAMA Major Permit No. 41-14. This letter shall be attached to the original CAMA Major
Permit No. 41-14 and all documents shall be readily available on site when a DCM
representative inspects the project for compliance. All conditions and stipulations of the active
permit remain in force unless altered herein. This approval does not eliminate the need to obtain
any additional permits, approvals, or authorizations that may be required.

Dear Mr. Lane:
The North Carolina Department of Transportation is requesting a Letter of Refinement or Permit
Modification as needed for CAMA Major Development Permit #41-14 for Replacement of
Onslow County Bridge No. 26 on NC 50 over Shelter Swamp Creek. This request is in regard to
the need to relocate the permanent power lines and associated poles and pennanent cable line.
The previous permanent power lines and poles relocation had been proposed in the original
permit application. Later, the cable line, which had been overlooked in the initial application,
was added into permitting via a letter of refinement issued on October 4, 2014.
Recently, in the course of discussion with the power company as it is near time to relocate the
power lines to their permanent location, it has been proposed to move the power lines and
associated poles approximately 31 feet from the center line ofthe new roadway alignment. This
would result in the proposed power lines, as well as the cable line which would be on the same
poles as the power lines, being located approximately ten to fifteen feet on average closer to the
new roadway alignment than had previously been proposed. The main reason for this proposal is
that the power lines being located closer to the roadway would facilitate easier access to the
utility lines for the utility companies as they could better reach the lines from the road fill or
nearer to the road fill rather than having to get down into the wetland restoration area or at least
it would help minimize future need to get down into the restoration area to work on the lines.
While not the driving factor in this request, this would likely result in more reforested wetland
restoration area than had previously been proposed as the utilities would be located closer to the
new roadway which may allow more of the restoration area to reforest than previously proposed.
We are not proposing to officially change the proposed mitigation scenario in this regard, but we
are mentioning this as this would likely be an added benefit to the environment resultant from
this now discussed proposal.

Finally, the existing power pole and guy wires and anchors at approximate station 20+30 RT
would be reinoved. The pole would be grabbed by a pole setter and rocked back and forth to
loosen it and then it would be pulled from the ground. The resultant hole from the pole would be
filled with soil material and dressed up to elevations of the surrounding wetlands. The added soil
would not necessarily be organic soil but with such a small area (probably anl8to 24 inch
diameter hole), this material and area should quickly be welcomed into consistency with the
surrounding wetland environment. The guy anchors would first be attempted to be unscrewed
from the ground and removed with any disturbed ground raked down to conformity with the
surrounding wetlands. If the anchors could not be unscrewed and removed, then they would be
cut off or driven to just below the ground surface and any disturbed ground would be raked into
conformity with the surrounding wetland area.
Please see the revised permit drawings in this regard; the revised drawings are dated accordingly
with today's date 9/7/15. The new proposed location of the permanent power lines and the
permanent cable lines is shown in blue. The power pole and guy location at Station 20+30 RT
has been denoted on the permit drawing. I propose that there are no changes in 404/401 impacts
associated with the above proposals. The minimal disturbances associated with the removal of
the pole and guys at station 20+30 RT are thought to be temporary and de minimis.
If a permit modification is needed, NCDOT acknowledges that the appropriate permit
modification fee will be debited from the provided WBS number above. Please let me know
