Dear Mr. Raper:
The subject Special Order by Consent (SOC) contains terms and conditions agreed to by the Town of
Siler City and the North Carolina Environmental Management Commission that were established to
promote Siler City WWTP's expedited return to consistent compliance with applicable environmental
laws, rules and/or permit conditions. Along with elements of limited relief from existing regulation, the
SOC includes an enforceable compliance schedule and provision for the assessment of stipulated
penalties when SOC terms and conditions are not met.
Pursuant to Paragraph 2 (a) of the SOC, Town of Siler City was required to complete construction of
WTP Pretreatment Improvements by July 31, 2023, the due date was extended to October 29, 2023,
upon the request by the Town. A review of our files has determined that as of the date of this letter,
confirmation of the completion of this schedule item has been submitted on November 22, 2023, to the
Division of Water Resources by the Town, the schedule item was completed on November 21, 2023,
the Town missed the extended due date by 23 days, which constitutes a violation of the SOC.
You are directed to immediately take whatever remedial actions are necessary to correct the problems
that have led to these violations. Paragraph 5 (c) of the SOC stipulates that unless excused per the
provisions of Paragraph 6, a penalty in the amount of $1,000 per day for the first 7 calendar days and
$2,000 per day thereafter shall be paid for Failure to complete a "Scheduled Activity" by the date
specified in Paragraph 2 (a). If you have information that will prove to the Division that any or all of
the criteria set forth in Paragraph 2 (a) have been met, you must submit this information in writing to
the Raleigh Regional Office within ten (10) days after your receipt of this notice. In the absence of
evidence justifying the application of the provision within Paragraph 2 (a), this Office will proceed
with assessment of stipulated penalties as provided for in the SOC.
