Director John Hutton NORTH CAROLINA Environmental Quality January 8, 2024 Wildlands Holdings III, LLC (via electronic mail: jhuttongwildlandseng com ) DWR Project #: 2020-1942v2 Wayne County Re: Wildlands Neuse Umbrella Mitigation Banking Instrument (UMBI) Cox Pond Bank Parcel Credit Release — Task 3 Dear Mr. Hutton: On May 31, 2023, the Division of Water Resources (DWR) received an As -Built Report from Wildlands Holdings III, LLC (Wildlands) for the Cox Pond Site. According to the As -Built survey and corresponding project credit table submitted with the As -Built Report, there are slight adjustments in the total amounts of Riparian Buffer credits and Nutrient Offset credits as compared to the approved Bank Parcel Development Package. The subject site has generated 418,562.000 ft2 of buffer restoration credits, 1,065.374 ft2 buffer preservation credits and 520,913 ft2 (27,181.936 lbs- nitrogen) of nutrient offset credits. DWR received a performance bond (#107917455) issued to Wildlands from Travelers Casualty and Surety Company of America, in the amount of $100,000, to cover monitoring and maintenance at the subject site. The term of this bond applies beginning November 16, 2023 and ends with DWR approval of the Year 1 Monitoring Report. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports. Additionally, the riparian buffer credits must be used for impacts in the Neuse River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015 Upon receipt of this correspondence, update all credit ledgers accordingly.
