Authorization is requested to conduct stream restoration/enhancement activities necessary to provide functional uplift along the Swannanoa River. The center coordinates of the project area are located at 35.608464°,-82.335777°. SSURGO Soils and NWI Map (ESRI World Imagery) Figure 4 — Existing Conditions (2023 Nearmap Aerial Imagery) • Permit Drawings • Agency Correspondence PROJECT BACKGROUND The project area is immediately adjacent to Veterans Park in Black Mountain, Buncombe County, North Carolina. Existing land use in the vicinity of the project includes a recreational park, undeveloped forested land, Interstate 40, U.S. Highway 70, and single-family residences. Kimley)))Horn Paget The original restoration project was designed and completed in July 2021 (SAW-2021-00704). In August 2021, Tropical Storm Fred damaged most of the recently completed project. This application aims to repair the damage that occurred. AGENCY CORRESPONDENCE Cultural Resources Kimley-Horn consulted the North Carolina State Historic Preservation Office (SHPO) HPOWEB GIS service on October 30, 2023. No documented architectural or historic sites of significance within the project boundary were identified. Protected Species A review of the North Carolina Natural Heritage Program (NCNHP) database on October 19, 2023, did not indicate known occurrences of threatened or endangered species within the project boundary. A concurrence request letter was submitted to the USFWS on October 25, 2023. USFWS responded on November 21, 2023, and concurred with "may affect, not likely to adversely affect" for NLEB. Additionally, USFWS considered Section 7 consultation to be complete at that time and required no further information. PROPOSED IMPACTS TO JURISDICTIONAL WATERS The overall project proposes to repair damaged areas of the Swannanoa River which will result in net increases in aquatic resource functions and services. Impacts to the stream are proposed at 4 impact sites: • Permanent Impact 1 — 215 linear feet (LF) to Stream 1 results from adding 165 LF of rock toe, reshaping the thalweg using existing material, and bank grading. • Permanent Impact 2 — 30 LF to Stream 1 results from adding a log sill to an existing log vane. • Permanent Impact 3 — 190 LF to Stream 1 results from stabilizing an existing riffle, reshaping the thalweg using existing material, bank grading, and adding 250 square feet (SF) of Class II rip rap for bank stabilization. • Permanent Impact 4 — 200 LF to Stream 1 results from resetting a log vane slope, bank grading, and adding log sills to existing log vanes. To meet the goals and objectives of the Veterans Park Streambank Restoration, stream enhancement and restoration activities will be conducted, resulting in 635 LF of permanent impacts to non -wetland waters of the United States (WOTUS). AVOIDANCE AND MINIMIZATION Avoidance and minimization efforts were implemented during development planning and design to the greatest extent practicable to reduce the overall impacts on the aquatic environment while staying within nationwide permit thresholds. The final plan demonstrates maximum avoidance and minimization efforts. Impact Sites 1-4 were identified as those areas that demonstrate the largest Kimley»>Horn Page 3 failures and support the greatest rehabilitation potential in lieu of a complete reconstruction of the project. All sediment and erosion control measures will be removed upon completion of construction and the temporary areas of disturbance will be stabilized and restored to pre -construction contours. The temporary haul road stream crossings will be integrated into the stream restoration activities and will be removed upon completion of the construction project. SPECIAL CONDITIONS Authorization is requested under NWP 27 to allow stream restoration activities to be conducted "in the wet." Rock silt checks will be utilized at the downstream end of every construction area to minimize downstream sediment transportation. Construction will occur only in areas no larger than what can be stabilized in one day. COMPENSATORY MITIGATION Compensatory mitigation is not required under NWP 27. We offer the following comments to inform prudent species effect determinations from the appropriate action agency: Based on the Information for Planning and Consultation (IPaC) submission and the standing analysis forthe D- Key, this project has reached the determination of "may affect, not likely to adversely affect" for the federally endangered Northern long-eared bat (NLEB, Myotis septentrionalis). The letter generated by the D-Key is dated October 19, 2023 for project code 2023-0125612. We appreciate project proponents' commitment to accomplishing necessary tree clearing during the inactive season for this species to minimize incidental take. The information provided indicates that suitable forage and/or roosting habitat for the proposed endangered tricolored bat (TCB, Perimyotis subfiavus) may also occur within the proposed action area. Although this species is not currently afforded legal protection under Section 7 of the Endangered Species Act (ESA), the impact minimization measure described above on behalf of NLEB would also support our concurrence with a "may affect, not likely to adversely affect" determination from the appropriate action agency forTCB should it become listed in the future. If the proposed action would not affect suitable habitat for this animal, we would not object to a "no effect" determination from the appropriate action agency. Monarch butterfly (Danaus plexippus) is a candidate species, and we appreciate the project proponent's consideration of monarch butterflywhen evaluating the action area for impacts to federally listed species and their habitats. This animal is also not subject to section 7 consultation, and an effects determination is not necessary. If requested, general recommendations for pollinators including monarch butterfly can be provided should the project proponent choose to implement them in the future. Your evaluation indicates that suitable habitat is not present within the proposed action area for any other federally listed species. Therefore, we consider consultation under Section 7 of the ESA to be complete at this time and require no further information. Please be aware that obligations under section 7 of the ESA must be reconsidered if: (1) new information reveals impacts of the identified action may affect listed species or critical habitat in a manner not previously considered, (2) the identified action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. According to Natural Heritage Program data, this reach of the Swannanoa River supports recent known occurrences of the eastern hellbender (Cryptobranchus alleganiensis). To minimize impacts to this species, we request that project proponents consider the following voluntary recommendations: • Coordinate with the North Carolina Wildlife Resources Commission (cc'd herein) to avoid/minimize impacts to this species if you have not done so already, • If suitable habitat for this animal occurs within the proposed action area, conduct surveys within 14 days prior to instream activities to safely capture and relocate animals out of harm's way.
