D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The proposed greenway alignment was chosen to avoid the FEMA floodway where possible and minimize stream impacts with the use of
perpendicular stream crossings. Crossing locations were chosen to minimize stream bank modifications. The greenway is sloped to drain stormwater
into stormwater ditches and discharged to the creek. The pipe outlets will be stabilized with rip rap in order to reduce erosion.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Sediment and erosion control measures will be used throughtout the project. Silt fence, in particular, along with stone outlets will be used to prevent
sedimentation from entering the streams. The fencing will also serve to restrict the contractor's construction corridor. For construction of the culvert,
the stream will be diverted away from the construction site by use of an impervious dike and temporary by -pass pump. A temporary stream crossing
will provide access to the site during bridge construction while limiting run -off potentials

subject project. The following comments are provided in accordance with the provisions of
section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531- 1543).
We concur with your assessment that with a commitment to winter tree clearing (August 15 to
May 15), the proposed project will not adversely affect the northern long -eared bat and will not
affect any other federally listed endangered or threatened species. Therefore, the requirements
under section 7(c) of the Endangered Species Act are fulfilled. Obligations under section 7 of the
Endangered Species Act must be reconsidered if. (1) new information reveals impacts of this
identified action that may affect listed species or critical habitat in a manner not previously
considered, (2) this action is subsequently modified in a manner that was not considered in this
review, or (3) a new species is listed or critical habitat is determined that may be affected by the
identified action.
