Box 590 Raleigh, NC 27602 RE: Withdrawal of Reservation of Right of Way /Ordinance (1996) 929 ZC 392 ( "Ordinance ") Dear Russell: I am writing regarding the Ordinance referenced above which was adopted by the Raleigh City Council on July 2, 1996 and providing for the rezoning of the Brier Creek project. 1 have included a copy of the Ordinance with this letter for your reference. Pursuant to Paragraph 2(H) of Exhibit C-4 attached to the Ordinance, the developer reserved for 10 years from the date of adoption of the Ordinance certain land for purchase as public right of way. The land to be reserved was associated with planned interchanges to be located at: (a) Brier Creek Parkway and U.S. 70; (b) T. W. Alexander Drive and U.S. 70; and (c) Aviation Parkway and U.S. 70. This same Paragraph states that "If the reservation is not purchased within the ten -year time period, the reservation may, in the sole discretion of the Petitioner, be abandoned and if so, shall no longer exist." Based upon the terms and conditions of the Ordinance, the owner of the land subject to the reservation, Brier Creek Associates Limited Partnership, hereby notifies the City that it abandons and otherwise withdraws land reservations described in Paragraph 2(H) of Exhibit C -4 of the Ordinance effective immediately. Accordingly, the land reservations referenced in Paragraph 2(H) of the Ordinance are null and void and have no further force or effect.
