Good morning, Carmela, I hope you had a very Merry Christmas. I think there may be some confusion here. This is a request for a permit modification, not a brand-new permit. The modification is requesting a reduction in currently authorized permanent impacts. We can provide the requested information, but it was all submitted with the original application, i.e. agency consultations and permit plans, so you should have it in the file. My biggest concern is your comment #7. We have already demonstrated avoidance and minimization which was acceptable to the Corps as demonstrated by the current authorization. This modification request is to further reduce stream impacts, not create additional rationale for a project that has already been authorized. We have submitted a similar 401 modification request to NCDWR. I hope this clears things up but let me know if you have any other questions. If you don't already have the information you requested on file, we can provide it, but I'd like to be clear that we'd like to focus solely on the reduced stream impact and not reevaluate the project as a whole. Learn why this is important Good afternoon, Chris, This email is in reference to the Pre -construction notification (PCN) for the proposed Troutman Widewaters Project (SAW-2021-01566), received on November 16, 2023. The following information is required to complete our evaluation, confirm compliance with one or more General or Regional Conditions, and/or complete consultation with another federal/state agency to verify the use of the Nationwide Permit (NWP), please: 1. Provide SHPO concurrence letter referenced in the PCN. 2. Provide USFWS concurrence referenced in the PCN. 3. Verify the width of the stream and culvert size where the stream impacts are proposed. 4. Provide a cross -sectional drawing of proposed stream impacts. 5. Provide detailed construction plans calling out all proposed impacts, type of impact, and amount of impact at each impact location. 6. The provided plans indicate a 26LF 15in RCP crossing north of, and parallel with, proposed stream impacts 1 and 2. Please provide details on the purpose of the RCP. Would the RCP serve as an additional culvert? Would there be any additional impacts to Waters of The US (WOTUS) as a result of the proposed RCP? 7. Provide rationale for minimization and/or avoidance of W2 impacts. Applicants in similar situations have implemented retaining walls to minimize impacts to WOTUS as a result of grading. Have further minimization measures been considered? 8. Provide a bank credit approval letter for proposed mitigation. Additionally, have you been in contact with NCDWR regarding an updated Individual Water Quality Certification reflecting the proposed impact changes? Please provide the requested information within 30 days, or your application will be administratively withdrawn. To clarify, if the requested information is submitted after the 30-day timeframe, you will not be required to re- submit an entirely new PCN (unless otherwise specified).
