PROJECT SUMMARY: Request for Minor Modification. References: 1) Permit Application Report for PA-1260 submitted by Thomas Byers, Registered Agent, 2) 15A NCAC 07J.0405, Permit Modification, 3) USACE Action SAW- 2014-02024, 4) NCDWR Project 92014-1138 V4. Applicant is proposing a new spoil transfer site at 4053 Tarkle Ridge Drive, Kitty Hawk. This site is proposed to be used during their maintenance excavation of existing canals. 9. NARRATIVE DESCRIPTION: Major Permit (MP) 9153-09 was issued to the Kitty Hawk Landing HOA on 12/07/2009 for excavation of canals, spoil disposal, placement of riprap along existing jetties, and shoreline stabilization. A major modification was issued on 02/16/2017 for excavation, spoil disposal, and a maintenance clause. Another major modification was issued on 03/05/2018 for excavation, spoil disposal, and navigational aides. A minor modification was authorized on 02/06/2019 for a spoil site relocation. MP 9153-09 was renewed on 11/03/2021 and expires 12/31/2026. All prior permit history and supporting documentation can be found in the Parent File, PA-1269. PROJECT DESCRIPTION: Maintenance excavation is proposed along the man-made canals of the Kitty Hawk Landing subdivision in accordance with the conditions of the existing major permit. The new, proposed spoil transfer site is located at 4053 Tarkle Ridge Drive in Kitty Hawk, Dare County. This 7,000-sf vacant lot is a common area owned by the Association. I conducted a site visit on 12/20/2023 and confirmed that the —60-foot unhardened natural shoreline had vegetation consisting of pine trees, sweetgum (gumball trees), and a small patch of Phragmites growing up the embankment. The yard consisted of indigenous grass, and logging mats had been installed in preparation for the transfer of dredge spoil from a barge (once approval has been received). Mark Perry will be conducting the maintenance excavation on behalf of the Association. The spoils will be trucked to a lot owned by Mr. Perry at 1064 Twiford Street in Kitty Hawk. The dredge spoils will be offloaded in an area outside of the CAMA AEC. 11. ANTICIPATED IMPACTS & RECOMMENDATION: In review of 07J.0405, it has been determined that the request meets the requirements of 15A NCAC 07H.0208 Use Standards (b)(1)(C), which states, "Dredged material from maintenance of channels and canals through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles, or disposed of by a method having no significant, long-term wetland impacts. Under no circumstances shall dredged material be placed on regularly flooded wetlands. New dredged material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H .0209(d)(10)". There will be no permanent impacts resulting from the temporary transfer of spoils, and the dredged material is not proposed within a buffer area. It is recommended that the Minor Modification request be granted, provided all the Permit Conditions of the current Major Permit 9153-09 remain in effect. The lot is a common use lot and has no development on the lot. The spoils will be taken from the barge by a long reach front end loaded and then placed into the tubs. The barge will be moored 6 feet off the bank inorder to not damage the existing shoreline. The front end loader and tubs will be placed on log matting to not damage the existine grounds. Any ruts created by the activity will be raked out and the lot will be seeded with grass if necessary. The spoils will be offloded from the truck to a lot located at 1064 Twiford Street, Kitty Hawk, NC 27949 Development Activities Narrative Specifics: Application Narrative: Kitty Hawk Landing Association would like to maintenance dredge our approved dredging area per Major Permit # 153-09 issued on March 5th, 2018. The original permit was issued a Minor Modification on February 6, 2019, to allow the spoils area to be relocated to a new location. We are asking for a Minor Permit Modification to relocate the spoils transfer area to a new location. The new location is 4053 Tarkle Ridge Drive, Kitty Hawk, NC. The site will serve as a transfer/offloading location only. No spoils will be deposited on the site. The spoils will be trucked to 1064 Twiford Street, Kitty Hawk, NC 27949. The spoils will be offloaded at this location. The Debtor contemplated deeding the tracts to the Homeowners' Association after the subdivision was completed, but the transfer did not occur. The spoils from the maintenance dredging will be offloaded from the dredging barge into watertight transfer containers. The barge will moor 6 feet off the bank of 4053 Tarkle Ridge Drive. The spoil material will be scooped into the watertight containers and trucked to another location to be offloaded. No -nateria shall be deposited onto the ground of 4053 Tarkle Ridge Drive. Wood cribbing will be laid down prior to any equipment working on the lot in order to not cause any damage to the ground.
