The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete Stormwater Management Permit
Authoriza?on to Construct (ATC) Applica?on for the subject project on December 28, 2023. Staff review of the plans
and specifica?ons has determined that the project, as proposed, will comply with the Stormwater Regula?ons set forth
in Rule 15A NCAC 2H.1043. We are forwarding Authoriza?on to Construct Permit No. SWA000229, dated January 3,
2024, for the construc?on, opera?on and maintenance of the subject project and the stormwater system. This permit
shall be effec?ve from the date of issuance and shall be subject to the condi?ons and limita?ons as specified therein,
and does not supersede any other agency permit that may be required.
The original signed permit package and approved plans are being mailed to the permi?ee, Debra Stewart, at the
following address (NOTE: An electronic version of this permit can be found in our online repository:

Reminder: Please be aware that per 15A NCAC 02H .1044(2), the Erosion & Sediment Control (E&SC) permit for this site

You can see where this project stands in the review queue by emailing Jim Farkas (He has an autoreply set up that has
the review queue on it). Please upload all documents that you mailed into our office through the link provided
below. Be sure to choose the Central Office as the Primary Contact office.

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Addi?onal file types can be
entered into the electronic form by clicking on the “Add Another Post-Construc?on File Upload” link directly below the
“State Stormwater Informa?on Uploads” sec?on of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding addi?onal file uploads) will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload en?re plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selec?ng the correct file type ensures that the files are properly named in the electronic repository and it helps
expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan
sheets (such as ligh?ng plans, u?lity plans, striping plans, sight distance plans, etc…) as these files are not needed for
review.

We received your application for a new Fast-Track post-construction stormwater permit on 9/20/23. At this time, the
submission is not administratively complete and cannot be accepted for review in its current condition. Please provide
the following submittal items by close of business on 9/27/2023 so that we may accept the project and begin the review
process, otherwise, the project will be returned as administratively incomplete.
1x hard copy of the Application with the following corrections made (These items are required per 15A NCAC
02H .1043(3)(a) and per Section F of the Application):
Section G – Please provide the applicant’s/financially responsible party’s original, notarized and sealed
signature in this section of the Application. NOTE: I apologize that this comment was left off our last
correspondence. I am granting you a week’s extension (due 9/27/23) in order to get this and the
additional comment in. NOTE: Of the 2 copies that we received originally, only one was an original for
the applicant.
2x hard copies and 1x electronic copy of a construc?on sequence that discusses how any future development on
the project may be phased. This is required per 15A NCAC 02H .1043(3)(g) and per Sec?on F, 5 of the
Applica?on. The construc?on sequence does not need to be lengthy, just a brief descrip?on of how future
development on the project (beyond what is shown on the plans) will be phased. If no future development is
planned for the project, you can simply state that in the construc?on sequence. This item is different than the
E&SC sequence of construc?on.
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brought up during the engineering review.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the Fast-Track permitting process can take up to 30 calendar days per statute.

2x hard copies and 1x electronic copy of the Application with the following corrections made (These items are

Section E, 4 - Please use the information for the first named surface water (“Mingo Swamp”, “C;Sw”, &
“18-68-12-2”) for the receiving stream name, classification and index number. This is required per 15A
NCAC 02H .1043(3).
2x original hard copies and 1x electronic copy of a site plan depicting the boundary of the project or project
phase currently being permitted, including the locations of SCMS, streams, wetlands, and buffers. This item is
required per 15A NCAC 02H .1043(3)(f) and per Section F,4 of the Application. NOTE: Please depict surface
waters, vegetative setbacks, and wetland delineation (or a note on the plans stating that there are no wetlands
located on-site). NOTE: The site plans submitted were not signed. Please provide signed site plans.
