This conveyance is subject to the provisions of that certain Declaration of Covenants, Conditions And
Restrictions For The Preserve At Lake Upchurch Community recorded in Book 9577, Page 767,
Cumberland County, North Carolina Registry, as the same may have been supplemented and
amended, including,without limitation,those certain special declarant rights as set forth therein,which
include,inter alia,easements reserved by Grantor herein across the property interests conveyed herein
for ingress, egress and regress,for installation, maintenance, repair and replacement of utilities for the
further development of the remaining property of Grantor, and for the right to substitute or add new
mortgages upon the above-described property.
All or a portion of the property herein conveyed does not include the primary residence of a Grantor.
TO HAVE AND TO HOLD the aforesaid lots or parcels of land and all privileges and appurtenances thereto
belonging to the Grantee in fee simple.
And the Grantor covenants with the Grantee,that the Grantor has done nothing to impair such title as Grantor
received,and Grantor will warrant and defend the title against the lawful claims of persons claiming by,under
or through Grantor,except for the exceptions hereinafter stated.
Title to the property hereinabove described is subject to the following exceptions:
All valid and enforceable easements, restrictions, rights-of-way, conditions and matters of record; the lien of
ad valorem tax for the current year which Grantee shall pay; matters which would be revealed by a
current and accurate survey and inspection of the premises; all other matters of record.
