PROJECT SUMMARY:
The 4.1-acre property, known as Midway Marina & Motel, is located on five parcels at 157 and 159
Coinjock Development Road in Coinjock, Currituck County, North Carolina. Midway Marina is
currently one component of the multi -use facility occupying the property. ACME Coinjock NC, LLC
purchased the property in 2023 with plans of renovating the marina through repair and replacement of
water dependent structures and through re -stabilization of the shoreline. Under this plan, the renovated
marina will be utilized in conjunction with Coinjock Marina which is located directly across the canal
and is also owned by ACME Coinjock NC, LLC.
9. NARRATIVE DESCRIPTION:
Elevations on the property range between 1.0 and 4.0 feet NGVD. Upland development on the 4.1-acre
site presently consists of a building housing a restaurant (currently closed), a building housing a motel
(seasonally open), gravel accessways, and several storage sheds. A swimming pool was once located on
the property; however, the pool was back -filled with clean sand in mid-2023. There was once a fueling
facility at the marina, but the facility was decommissioned several years ago. Vegetation on the
property is patchy — consisting primarily of grassed areas, ornamentals, and opportunistic successional
plant species. The property has been used for commercial purposes over the years, and no
archaeological resources are known to exist within areas of proposed disturbance.
The main shoreline along the property (i.e., excluding boat basins) is 1,480 feet long. Waterfront
structures on the site currently consist of timber bulkheads, boardwalks, fixed platforms, a boat ramp,
wet slips, and three boat basins. Many of the water dependent structures have fallen into disrepair -
including failing bulkheads, dilapidated boardwalks and piers, and eroded areas along the shore.
The marina is situated along the Albemarle/Chesapeake Canal, a part of the Atlantic Intracoastal Water
Way (AIWW). Specifically, the portion of the AIWW at the project site is a manmade and federally
dredged canal known as the North Carolina Cut. The AIWW at Midway Marina is 75 feet wide, with a
reported approach depth of 12 feet and a reported docking depth of 10 feet. Water depths within the
boat basins that will be maintained as part of the marina range between 2.0 and 4.0 feet. No primary or
secondary nursery areas are located within the project vicinity. Water resources in the project area are
classified as SC (Aquatic Life, Secondary Contact Recreation, Tidal Salt Water) which are closed to
shellfishing. Fishing waters in the area are classified as "Joint" which are jointly managed by NC
Wildlife Resources Commission and NC Division of Marine Fisheries. No submerged aquatic
vegetation (SAV) was observed in affected waters at the time of site inspection.
10. PROJECT DESCRIPTION:
Development activities being requested under CAMA Major Permit Application PA-1190 include
shoreline stabilization through replacement of failing bulkheads, replacement of dilapidated water
dependent structures (docks, platforms, and boardwalks), reconfiguration of existing wet slips, and
filling of the northernmost of three basins located on the property. Heavy equipment to be used during
construction will include a barge, a vibratory hammer, dump trucks, skid steers, and an excavator.
Specific development activities consist of:
• Installation of 1,621 linear feet of new vinyl bulkhead to replace failing bulkheads and to close -off the
northern basin fill area. The new bulkhead will be installed an average of two feet waterward of NWL,
with a maximum of five feet waterward of NWL.
• Placement of 1,956 square feet (+/- 145 cubic yards) of clean backfill to be placed behind failing
bulkheads and below NWL.
• Installation of new pier/boardwalk measuring six feet wide by 1,168 feet long (for 7,008 square feet)

to replace the existing structures in need of repair. Approximately 3,700 square feet of the total area
will shade estuarine waters.
• Replacement of three existing platforms with three new platforms (labeled A-C on site plans) totaling
1,628 square feet. Platform "A" will measure 18 feet by 30 feet, Platform `B" will measure 12.5 feet
by 35 feet, and Platform "C" will measure 10 feet by 65 feet. Of the 1,628-square-foot total,
approximately 860 square feet will shade estuarine waters.
• Installation of an elevated accessway measuring six feet by 12 feet (for 72 square feet).
• Placement of 7,992 square feet (+/- 2,370 cubic yards) of clean backfill for filling of the northern boat
basin.
• Reduction in the total number of boat slips from 36 to 24 (filling of the northern boat basin results in
this reduction of slips).
• Disturbance of 40,691 square feet of upland associated with installation of elevated structures (not
extending beyond NWL), accessways, deadman piles, tie -backs, etc..
Existing features in need of repair will be removed prior to replacement with the above -mentioned
structures. Filling of the northern basin will take place after the new bulkhead is complete. This will
serve to contain all fill material, thereby preventing any discharge into the adjacent canal. Once the
basin is filled, all newly created and disturbed land surfaces will be seeded, mulched, and stabilized.
Once work has been completed, the marina will operate as a lease -based and transient dockage facility
with boat ramp. A small number of slips will be used as long-term lease slips, while all others will be
short-term transient slips for boats traveling the AIWW. Under ACME's plan, renovated Midway
Marina will be utilized in conjunction with Coinjock Marina which is located directly across the canal
and is also owned by ACME Coinjock NC, LLC. The renovated Midway Marina will not provide on -
site fueling, food service, or waste pump -out. Instead, transient boaters and lease holders will be
directed to utilize the fueling station, pump -out facility, marina store, restaurant, along with showers
and toilets located directly across the canal at Coinjock Marina.
11. ANTICIPATED IMPACTS:
In total, 55,199 square feet of area will be disturbed, including:
• 9,948 square feet of shallow bottom fill (bulkhead back -fill and basin fill),
• 4,560 square feet of open water shading (elevated structures extending beyond NWL),
• 40,691 square feet of upland disturbance (elevated structures not extending beyond NWL,
accessways, deadman piles, tie -backs, etc.).
In addition, 1,621 linear feet of vinyl bulkhead will be installed.

Detailed Description of the Existing Development Located on the Property
Existing Man -Made Features:
The existing marina facility currently consists of timber bulkheading, docks, piers, platforms, boardwalks, boat slips, and a boat
ramp. Upland improvements include two marina buildings (motel and restaurant), gravel accessways, and several storage sheds.
Existing Land Uses:
The property is the site of Midway Marina - a commercial facility that includes wet slips, a motel, and a restaurant.
Existing Wastewater Treatment/Disposal:

On -site dumpsters with disposal by contract.
Use and Daily Operations of the Project When Complete
Proposed Development Purpose:
The purpose of this project is to maintain and improve a commercial marina facility which has long served recreational boating
interests in and along the Atlantic Intracoastal Waterway. Marina owners will replace existing platforms, boardwalks, piers, and
bulkheads that are aged and in need of replacement. A man-made boat basin in the northern portion of the property is also
proposed to be filled due to lack of use and shallow waters that only allow shallow draft vessels.
Build ings/Facilities/U nits/Structu res:
The project includes the replacement of existing piers and boardwalks paralleling the waterway with a new 1,170 boardwalk and
pier complex. The project also entails replacement of the existing bulkhead with a new 1,621 LF bulkhead,- backed by 1,956 sf of
bulkhead backfill below NWL. An 8,000 sf boat basin located in the northern portion of the property will be backfilled with
approximately 3,500 cy of clean fill. This will result in a minor reconfiguration of boat slips (including a reduction of the net total slip
count from 36 to 24). Three wooden platforms (A, B, and C of site plans) will be replaced in -kind.
Use & Daily Operations:
The daily use and operations will continue as a commercial marina facility.
Construction Methodology & Equipment:
Equipment will include a barge, vibratory hammer, dump trucks, skid steers, excavator, and hand tools.
Development Activities Narrative Specifics:
The proposed project includes the replacement of the existing pier and boardwalk with a new 1,170 boardwalk and pier,
replacement of the existing bulkhead with a new 1,621 LF bulkhead, 1,956 sf of bulkhead backfill below NWL, fill of the 8,000 sf
northern basin (+/- 3,500 cy), replacement of three platforms.
Application Narrative:
The proposed project site, known as Midway Marina & Motel, is located at 157 and
159 Coinjock Development Road in Coinjock, Currituck County, NC. The property is
situated along the Albemarle/Chesapeake Canal, a part of the Atlantic
Intracoastal Water Way (AIWW). The facility is a full -service marina with a
motel, restaurant, boat ramp, and wet slips. There was once a fueling facility
at the marina, but that was decommissioned several years ago. The site consists
of bulkheads, boardwalks, fixed platforms, a boat ramp, two buildings, gravel
accessways, and several storage sheds. Many of the water dependent structures
have fallen into disrepair - including failing bulkheads, dilapidated boardwalks
and piers, and eroded areas along the shore. A swimming pool was once located on
the property; however, the pool has recently been filled with clean backfill.
ACME Coinjock NC, LLC purchased the property in 2023 with intensions to repair
and replace water dependent structures on the property, re -stabilize the
shoreline, and utilize the site in conjunction with the Coinjock Marina located
directly across the canal. ACME also owns the Coinjock Marina, and all fueling
and pump -out needs will be directed to Coinjock Marina.
The proposed project requiring a CAMA Major Permit includes shoreline
stabilization through replacement of failing bulkheads, the replacement of water
dependent structures (docks, platforms, and boardwalks), the reconfiguration of
the existing wet slips, and the filling of the northernmost of three basins
located within the property. All proposed work is as follows:
* 1,170 LF of new pier/boardwalk to replace the existing structures in need of
repair.
* 1,621 LF of new bulkhead to replace existing bulkheads and close -off the
northern basin fill area.
* 1,956 SF of bulkhead backfill to be placed below NWL.
* Fill of the 8,000 SF northern basin (+/- 3,500 CY).
* Replacement of three existing platforms with three new platforms (Labeled
A-C).
* Reduction in the total number of boat slips from 36 to 24 (filling of the
basin results in this reduction of slips).
All existing features in need of repair will be removed prior to replacement
with the above -mentioned structures. Filling of the existing northern basin will
take place after the new proposed bulkhead is complete. This will serve to
contain all fill material, thereby preventing any discharge into the adjacent
canal. Once the basin is filled, all newly created and disturbed land surfaces
will be seeded, mulched, and stabilized. See CAMA Major Permit plan for a
detailed view of the existing site and all proposed work.
Quible performed the water depth and shoreline surveys in 2023. In the winter
of 2022, Quible met with the NCDCM field representative to discuss the same
scope of work, but for the previous owner (Mr. Louis Davis). Mr. Davis sold the
property to Acme Coinjock NC, LLC in 2023 and the current owners are now
pursuing what was discussed in the past. In August 2023, Quible met with Mr.
Martin Mitchell (current NCDCM field representative) to walk the site and to
verify the scope of work related to CAMA rules and regulations before submitting
this permit application. Quible performed a full bathymetric survey in June
2022 (see plans). All existing conditions are shown on Sheet 1 (see also- photo
pages). None of the areas to be filled have had rooted submerged aquatic
vegetation (SAV) or jurisdictional wetlands.
Once all work is completed, the marina will begin operations as a lease -based
and transient dockage facility with boat ramp. A small number of slips will be
used as long-term lease slips, and all others will be short-term transient slips
for boats traveling the AIWW. The new Midway Marina will not provide services
such as fuel, food, pump out, etc. All transient boaters and lease holders will
be directed to utilize Coinjock Marina across the canal that provides fuel,
pump -out, marina store, showers, toilets, and restaurant.
The project proponent hereby certifies that all information contained herein is
true, accurate, and complete to the best of my knowledge and belief. A DWR
Prefiling Notification was submitted on September 1st, 2023 through the DWR's
401 Prefiling email. A copy of this email has been attached. The project
proponent hereby requests that the certifying authority review and take action
on this CWA 401 certification request within the applicable reasonable period of
time.

A two page CAMA Major Permit plan is attached depicting the existing site and conditions on sheet 1, and the proposed
repair and replacement of the marina on sheet 2. In addition to the repair and replacement of the existing marina, the
client proposes to fill the existing northern basin and extend the bulkheading across the entrance to the basin. All

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 8/10/2023. Proposal is to renovate the
marina through repair and replacement of water dependent structures and
through re -stabilization of the shoreline. Property location is 157 and 159
Coinjock Development Road, Coinjock, NC 27923, in Currituck County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City and reached by
phone at (252) 264-3901 during normal business hours. Comments mailed to Braxton
