HomeMy WebLinkAboutNC0005258_NOD2023OC0002_20231129 SENT VIA ELECTRONIC MAIL ONLY: NO HARD COPY WILL BE MAILED November 29, 2023 Shane Holland SGL Carbon Email: shane.holland@sglcarbon.com SUBJECT: NOTICE OF DEFICIENCY Tracking Number: NOD-2023-OC-0001 Permit No: NC0005258 SGL Carbon, LLC Burke County Dear Mr. Holland: On November 14, 2023, Daniel Boss with the Division of Water Resources - Asheville Regional Office, received notification that an estimated one gallon of pitch and oily debris from the pitch trap of building 55 reached Silver Creek (11-34-6.5; Class WS-IV) at the SGL Carbon facility in Morganton. The incident occurred after plumbing contractors were jetting 180 feet of underground stormwater line that was clogged. The release of the clog allowed the oily debris and pitch to migrate from the malfunctioning pitch trap to the creek. Staff from the facility immediately followed the facility’s release procedure and installed booms in the weir. Stephen Richards (Site Environmental, Health & Safety Representative) indicated that a contractor arrived on-site the same day to clean the remainder of the pitch and oily water from the pitch trap and inspect all other traps on site to ensure they are working correctly. SGL Carbon caused an illegal discharge of oil & grease into Silver Creek, and the following violation was identified: DocuSign Envelope ID: A9FB12A7-A817-4FC1-9872-B45E48748949 VIOLATION I. Discharge Without a Valid Permit – G.S. 143-215.1 (a) states that no person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit: G.S. 143-215.1(a)(1) – Make any outlets into waters of the State. Remedial actions, if not already implemented, should be taken to correct the above noncompliance. Please include any additional documentation about this incident in the response and include the steps that will be taken to prevent this type of illegal discharge from happening in the future.
