Based on the poor survival of planted stems indicated in 29 of the 87 vegetation plots, RS included an Adaptive Management Plan (AMP) in the Year 1 report, which also included the commitment to plant riparian areas around Plot 9 that were missed during the initial planting efforts. The AMP was fully implemented in February 2021. Herbaceous vegetation is dense across the site and no encroachment within the conservation easement areas was observed. DWR received a continuation certificate for performance bond (#107255999) in the amount of $100,000 issued to RS from Travelers Casualty and Surety Company of America, to cover monitoring and maintenance at the subject site. The term of this bond ends with DWR approval of the Year 2 monitoring report. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports. In accordance with the MBI, signed on February 17, 2020, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 4) Monitoring Report #1: Approved by the DWR & financial assurance renewed 10% By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and 10% of your Nitrogen nutrient offset credits (0.10 x 118,089.653 lb-N=11,808.965 lb-N) and 10% of your Phosphorus nutrient offset credits (0.10 x 7,605.887 lbs-P = 760.589 lb-P) are now available to sell. Additionally, 10% of your Neuse buffer Restoration credits (0.10 x 1,491,885.751 ft2 = 149,188.575 ft2) and 10% of your Neuse buffer Preservation credits (0.10 x 6,824.342 ft2 = 2,729.740 ft2) are now available to sell. Additionally, the riparian buffer credits must be used for impacts in the Tar -Pamlico River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
