Blake,
We reviewed the items submitted on 8/18/23 and there are no issues that would prevent us from issuing the Fast-Track
ATC permit for this site, however, there may be some issues with the design as proposed. The Fast-Track ATC review is
not an in-depth technical review of the stormwater controls for the site, it is more of an administrative review of the
project/a review to see if the project has the potential to meet the design requirements/rules. The SCM design and
drainage area delineation are not required submission items at this point in the Fast-Track submittal process so issues
with the SCM design or drainage area delineation do not prevent a project from getting Fast-Track ATC approval, but if
the SCM design and drainage area delineation are provided at this point in the review, we look at them to see if the
design appears to meet the rules and MDC. Based on a precursory look at the design the following issues may arise with
the design:
In accordance with 15A NCAC 02H .1003(3)(b), any off-site areas that are not bypassed around the SCM must be
accounted for at their full build-out potential when sizing the SCM. This can be accomplished by assuming that
the off-site area is 100% BUA (its full build-out potential) or by having the permittee and off-site property owner
enter into a legal agreement limiting the amount of BUA and drainage area directed from the off-site area to the
SCM. It is strongly recommended to bypass the off-site areas around the proposed SCM.
The sediment storage zone of the main pool (portion of the main pool below the sediment cleanout elevation)
does not count towards the main pool volume used to determine the average depth of the main pool. You may
need to reconfigure your pond geometry in order to meet Wet Pond MDCs 1 & 2.
The proposed SCM will need to be located within a maintenance access easement per General MDCs 8 & 9. The
easement should include the entire SCM system (side slopes, forebay, riser structure, SCM device, basin outlet,
dam embankment, outlet, emergency spillway, etc…) plus 10 or more feet around the SCM (to provide room for
maintenance tasks) and must extend to the nearest public right of way. Per the requirements, the width of the
access must be at least 10 feet, however, it is recommended to increase this width to 25 ft for wet ponds to
facilitate the large equipment typically used for wet pond maintenance.
Please let me know by close of business tomorrow (9/15/23) if you would like to modify the design (and have me look it
over again for apparent issues with the design) prior to us issuing the Fast-Track ATC or if you would just like us to issue
the ATC (and fix the design sometime between now and Final Approval). NOTE: The project will need to comply with the
rules/regulations before the Final Approval (part 2 of the Fast-Track permitting process) is issued for the site and before
the E&SC permit is closed out.

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be
entered into the electronic form by clicking on the “Add Another Post-Construction File Upload” link directly below the
“State Stormwater Information Uploads” section of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads) will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selecting the correct file type ensures that the files are properly named in the electronic repository and it helps
expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan
sheets (such as lighting plans, utility plans, striping plans, sight distance plans, etc…) as these files are not needed for
review.

Since the application was only filled out once, would it be acceptable to have the applications filled out with different
dates or do both applications need to be for the same date and with the same notary public?

Can you please clarify what you mean by 2 for the applicant, 2 for the designer? On the application form, there is
only one space for each signature.
Are you asking for us to fill out two applications or to submit one with the original signatures and a copy?

2x hard copies and 1x electronic copy of the Application with the following corrections made (These items
are required per 15A NCAC 02H .1043(3)(a) and per Section F of the Application):
Section G – Please provide the applicant’s/financially responsible party’s original, notarized and
sealed signature in this section of the Application.
Section H – Please provide the design professional’s original, notarized and sealed signature in this
section of the Application.
NOTE: I apologize for this being overlooked. The signatures of previous applications are copies and are not
originals. 2 original signatures are needed for both the applicant (Timothy Warren Gregory) and for the designer
(Joe Godwin, Sr.). The sooner we can get the in, the sooner it can move onto the technical review.
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues
that may be brought up during the engineering review.

If these items are received within the stipulated timeframe, we can accept the project and begin the review
process. Once accepted, reviews under the Fast-Track permitting process can take up to 30 calendar days per
statute.

Kaitlin and Jim,
Unfortunately it seems our office does not have any disks or empty flash drives that we can use for the electronic
copies. Instead, the missing files will be attached to this email. If this is insufficient, please let me know and I will
have a flash drive delivered at a later date. Unless something changes, I will be delivering the hard copies today.
The note stating that this project will be completed in one phase can be found at the bottom of the erosion and
sediment control construction sequence in the bottom right corner of page 7.
While these plans have not been signed by an engineer, they have been checked by our senior engineer, Joe
Godwin Sr. and should at least be suitable for review. If this is insufficient, then please let me know.

receiving stream is reported as class SA or the receiving stream drains to class SA waters within ½ mile
of the site boundary, include the ½ mile radius on the map. This item is required per 15A NCAC 02H
.1043(3)(e) and per Section F, 3 of the Application.
2x original hard copies and 1x electronic copy of a site plan depicting the boundary of the project or

description of how future development on the project (beyond what is shown on the plans) will be
phased. If no future development is planned for the project, you can simply state that in the
construction sequence. This item is different than the E&SC sequence of construction.
2x hard copies and 1x electronic copy of documentation from the NC Secretary of state, or other official
documentation, which supports the titles and positions held by the persons listed in Section c, 2 per
15A NCAC 2H .1043(3)(b). The corporation or LLC must be listed as an active corporation in good
standing with the NC Department of the Secretary of state; otherwise, the application will be returned.
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other
