Olive, NC, in the Upper Falling Creek watershed of the Neuse River Basin. The Site is approximately 6.5 miles northwest of Mt. Olive and 1.7 miles south of US Highway 13 on McArthur Pond Road in Wayne County. The Bank Parcel Development Package (BPDP) was approved April 2023 under the Britt and Hales Mitigation Banking Instrument (MBI) between the North Carolina Division of Water Resources (DWR) and the Bank Sponsor, Eco Terra, LLC. The Parcel is approximately 24.7 acres encompassing a series of forked, interconnected ditches and unnamed tributaries to Falling Creek. The Parcel is located within Neuse 01, specifically 8-digit hydrological unit code (HUC) 03020201. The Bank was approved for riparian buffer credit (RBC) and nutrient offset credit (NOC) in the service area designated by Neuse River Basin HUC 03020201 (outside Falls Lake). The Parcel lies in the headwaters of three unnamed tributaries and three agricultural ditches that converge and flow into an unnamed tributary to Falling Creek, approximately 1.8 miles downstream of the Parcel, and subsequently into the Neuse River. According to the as-built survey and 2022 DWR Buffer Mitigation Calculation Tool, the Bank is on track to generate 333,957.870 RBC and 33,148.872 pounds of nitrogen NOC. 1.1 Project Goals Project goals and objectives are consistent with those specified in the 2018 Neuse River Basin Restoration Priorities (RBRP). As stated in the RBRP, restoration of riparian buffers and adjacent riparian areas to address agricultural runoff is a priority for this HUC. Continued Bank success assists DWR in meeting the following goals of the RBRP: 1. Reduce agricultural runoff (i.e., nutrients and sediment) 2. Restore/support terrestrial and aquatic habitat with a riparian corridor 3. Protect the Parcel in perpetuity The Parcel addresses agricultural runoff by reducing sediment and nutrient loading into the unnamed tributaries and Falling Creek. Falling Creek is classified as Water Supply (WS- IV) and Nutrient Sensitive Waters (NSW) by DWR with an impairment for dissolved oxygen. The Parcel and surrounding areas are open agricultural land, primarily farmed for row crops. The Parcel improves terrestrial habitats along streams and ditches by establishing and preserving the riparian buffers and riparian areas and allowing the land to undergo a natural succession back to a native, forested community. The Parcel restores forested riparian buffers and riparian areas 50-200 feet from viable project features and removes rotating crops and fertilizer inputs. The restored riparian buffers and riparian areas filter agricultural runoff from the surrounding farm fields and, over time, will provide shading Britt & Hales Annual Monitoring Report (MY1) DWR Project No. 2022-0293v2 December 2023 2 to reduce stream temperatures and improve aquatic habitat. Invasive vegetation will be managed as needed within the Parcel to promote native vegetation. 1.2 Existing Site Conditions The Parcel was successfully planted in 2023 with native seedlings and is now at the end of the first (1st) full growing season of successful riparian restoration. The Parcel has begun converting approximately 22 acres of agricultural fields into forested buffers and riparian areas along three unnamed tributaries (UT1, UT2, UT3) and three agricultural ditches (Ditch A1, B1, B2). The restored Parcel is set within a larger 180-acre parcel and surrounded by agricultural fields farmed for row crops. As Figure 1 illustrates, Ditch A1 emerges from a farm path south of the Parcel and flows north along the eastern Parcel border before turning west through the project area and transitioning into UT1. UT1, an intermittent stream, continues to flow west, turning north before merging with UT2, which continues northwards as UT3 to the Parcel terminus. Ditches B1 and B2 flow east and west, respectively, until the confluence with UT2, an intermittent stream. UT2 flows west to the confluence with Ditch B2, then turns north and northeast through the site until its confluence with UT1. It should be noted the centerline of Ditch A1 forms the eastern boundary of the conservation easement. The Parcel is composed of and surrounded entirely by agricultural fields, except for two small wetland areas (~0.2 acres) with existing trees and vegetation that have been preserved along UT1 and Ditch A1. Restoration activities saw buffers and adjacent riparian areas planted up to 200 feet from the top-of-bank of streams and viable channels, thereby removing rotating crops and fertilizer inputs. The restored Neuse riparian buffer and adjacent riparian areas will filter runoff from the surrounding farm fields and provide shading to improve stream temperatures and aquatic habitat. Vegetative success criteria was confirmed at all plots, with stem densities ranging from 400 to 800 stems per acre. Riparian buffer and adjacent riparian area restoration was accomplished in accordance with the Consolidated Buffer Mitigation Rule (15A NCAC 02B .0295) and the Nutrient Offset Credit Trading Rule (15A NCAC 02B .0703). Viable areas within 200 linear feet of the top-of-bank of subject streams, as measured from top-of-bank landward, were planted and devoted to generating riparian buffer mitigation credits. Mitigation credits generated are listed in Table 2 as based upon the DWR Buffer Mitigation Calculation Tool v5 (November 2022). Britt & Hales Annual Monitoring Report (MY1) DWR Project No. 2022-0293v2 December 2023 3 Parcel construction was completed in late March and early April 2023 with follow-up activities in May. Eco Terra and supporting team members successfully planted and restored the proposed areas dedicated for riparian buffer and adjacent riparian area restoration with native hardwood seedlings, as well as temporary and permanent seed covers. Because the land within the Parcel had been historically used for row crops, it required minimal soil disturbance to install the plants. 3.1 Riparian Area Restoration Activities In accordance with the Mitigation Plan, restoration of riparian areas involved the planting of one- and two-year old bareroot seedlings in zones specific to soil and site conditions. Planting activities utilized a combination of mechanical and manual methods depending on site conditions and location. A tractor ripped and planted most of the rows while handplanting occurred along tops-of-banks. Native hardwood seedlings were distributed evenly across the Parcel at an approximate 10 ft x 6 ft spacing. Approximately 16,700 stems (~752 stems/acre) representing 12 native hardwood species were planted within the riparian areas designated for restoration. It is expected that the initial planted density will be sufficient in meeting the performance standards of 260 trees per acre at the end of five years, as outlined in Rule 15A NCAC 02B .0295 and the MBI. The Mitigation Program Requirements for Protection and Maintenance of Riparian Buffers (15A NCAC 02B .0295) set forth specific performance criteria for the successful development and closeout of the Site. Performance criteria consists of annual monitoring of planted stems and standardized vegetation plots including: individual plot photo documentation; overall site photo documentation; and biannual visual assessments for easement integrity, invasive species and/or herbaceous competition, stem mortality, stand health, incidental damage from agricultural equipment, and stem loss/damage from natural causes (such as fire, disease, or animal behavior). Figure 1 illustrates the location of project easement, fixed vegetation plots, and photo points. 4.1 Vegetation Eighteen (18) fixed vegetation plots were established according to the most recent Carolina Vegetation Survey (CVS) protocol within the restored buffer area. Representative vegetation plots were established at a minimum density of 2% of the planted area. Specifically, vegetation monitoring was obtained for all plots according to the CVS-EEP Level I Protocol for Recording Vegetation manual, v4.2 (2008). Monitoring year one (MY1) vegetation stem data is included in Table 3. In summary, all vegetation plots met success criteria by averaging 651 stems/acre, 3.0 vigor, and a stem height of 53 cm. Britt & Hales Annual Monitoring Report (MY1) DWR Project No. 2022-0293v2 December 2023 4 4.2 Photo Reference Stations Site reference photo points were taken at designated points along the conservation easement boundary, providing an overall view of project success (Appendix 2). Individual plot photos were taken at the approximate southwest corner (origin) of each plot and are included in Appendix 3. All photo points were located by survey and georeferenced for map production to provide a consistent means for photo replication annually, or in the event a plot or photo location must be reestablished during the monitoring period. Photo orientation (direction and bearing) were recorded as well as approximate vertical position for consistency in photo logging. 4.3 Visual Assessments Additional observations were made of site conditions and vegetation conditions outside of monitoring plots. No encroachments or significant presense of invasives were observed. Biannual visual assessments will continue in order to appropriately monitor changing site conditions and address any issues to ensure Site success and performance criteria are met in subsequent monitoring years. 4.4 Annual Reporting Performance Criteria All monitoring reports, including this annual report, will be compiled and submitted to DWR annually in accordance with the MBI. Annual monitoring will occur for a minimum of five years or until performance criteria are met. 4.5 Maintenance and Contingency Plans Any Parcel observations identified through vegetation plots or visual assessments, whereby the performance criteria is not met, will be noted and discussed in the annual reports and addressed with a contingency plan as necessary. DWR will be notified and, if necessary, collaborate with Eco Terra to develop a contingency plan with remedial action steps to correct the performance criteria deficiency. Any contingency plan and remedial actions will occur within an agreed timeframe and monitoring adjusted accordingly, if necessary. Parcel problem areas will be monitored biannually to ensure performance criteria are met following any remedial action.
