The purpose of this letter is to transmit comments provided by the NC Interagency Review Team (NCIRT) during the review of the monitoring report and to confirm the annual credit release. The review of the annual monitoring report followed procedures outlined in Section 332.8(o)(9) of the Mitigation Rule. The comments listed below were provided by the NCIRT during this process. While it is not necessary to provide a response to specific comments at this time, please be sure to address the issues raised in future monitoring report submittals. Andrew Fried man-Herrina. NCDWR 1. Page 9, Stream Geomorphology Section: RES describes a boulder sill that may be preventing aquatic life passage due to height of the structure but indicated that no repairs are needed currently. Is sediment expected to accumulate in this area, raising the elevation? Please provide more detail about why RES has elected to wait on this repair and an estimate on when a decision will be made to adjust, if needed. It would be ideal to remedy this sooner rather than later, unless the situation is already corrected or is likely to self -correct in the near future. 2. A few of the plots have a very high proportion of sycamore stems, but sitewide plot diversity looks good. 3. Overall, the site seems great, and DWR supports the proposed credit release. Dave McHenry, NC WRC 1. 1 do recall some concerns were raised regarding an unstable access road along a preservation or maybe enhancement reach, but I believe as noted in the report they addressed that with the wattles and perhaps matting? With livestock now actively grazing outside of the project, please closely monitor previously identified areas with erosional features where vegetative stabilization measures were taken. The 2023 repairs included waddles for spreading flow which is a temporary solution. Update annually on these areas so we can track whether vegetation is able to more permanently resolve the concentrated runoff issues. 2. Discussing the status of specific cross sections in the Stream Geomorphology section was helpful since these areas did stand out in the Appendix D tables and plots. The riffle narrowing at cross sections 29 and 33 are a bit concerning, as is the pool depth at cross section 11. Is the presence of in -channel vegetation an issue along any reaches? 3. In the MY1 report, stream repairs were proposed for FC6, FC4-A and the FC7-A crossing. However, the completed stream repairs discussion in the MY2 report doesn't mention addressing the previously noted scour and headcuts along FC4-A. What is the current condition of this reach? In addition to the aquatic passage concern of the FC7 crossing, high drop structures were noted along FC2 and FC5 during the IRT as -built site walk. What is the current aquatic passage risk assessment for these structures? 4. CCPV — This is likely a product of map scaling, but please make sure all reach labels are visible (e.g., FC6-A, FC8, FC10, FC11). 5. Thank you for including crossing photos. The purpose of requesting these photos is to check that the crossing appears to be functioning properly, culverts aren't perched, adjoining banks aren't showing signs of scour/destabilization, and encroachments aren't visible. Please consider these items when taking future crossing photos. 6. Table 7 — a. The narrative mentions that no volunteers were noted within the veg plots. However, common hackberry, green ash and swamp chestnut oak are not included in the Table 5 planted species summary. Please explain. b. Comment #5 response from last years monitoring report review had a similar comment and the response stated, "We believe this was a mistake in data processing and was inadvertently included." When providing response to this question please consider last years data and provide an update clarifying this issue. 7. Please confirm all appropriate lines are shown on all cross section plots (i.e., low bank, floodprone area). 8. The FC5-A flow gauge graph shows multiple dips below the stream bed that were still counted towards consecutive days flow. The response to the MY1 IRT comment was that these drops were for less than 24 hours and therefore not considered loss of flow. Typically the IRT has considered any drop below stream bed elevation as a loss of flow that should not continue the consecutive flow days count. Please provide more information about this issue and why those dips should count toward consecutive flow. Is this related to the times measured per day, to incorrect elevations, or very low flowing stream heights... would a camera help resolve this issue? 9. Please add the stream bed line to the stage recorder graphs. 10. Please include sampling dates to Table 14 Nutrient/Bacteria Water Quality Summary. 11. This would be a good site to visit next year during the MY3 review. Based on our review of the monitoring report and the results of the NCIRT review, we confirm that you have satisfied requirements included in the approved banking instrument and mitigation plan for this site. Accordingly, with this correspondence we confirm the release of credits as shown on the attached credit release schedule. Additionally, per the request included in your monitoring report submittal, we agree to the M&M bond reduction for Bond No. 9409248 in conjunction with the Year 2 credit release.
