The subject Special Order by Consent (SOC) contains terms and conditions agreed to by The City of
Albemarle and the North Carolina Environmental Management Commission that were established to
promote Long Creek Wastewater Treatment Plant expedited return to consistent compliance with
applicable environmental laws, rules and/or permit conditions. Along with elements of limited relief
from existing regulation, the SOC includes an enforceable compliance schedule and provision for the
assessment of stipulated penalties when SOC terms and conditions are not met.
A review of Long Creek WWTP self -monitoring report for the month of October 2023 has indicated
violation(s) of the SOC limit(s) in the manner and to the extent shown below.

You are directed to immediately take whatever remedial actions are necessary to correct the
problems that have led to these violations. Paragraph 3. (c) of the SOC stipulates that unless
excused per the provisions of Paragraph 4., a penalty in the amount of $1000.00 Monthly Average
Exceedance and $500.00 for Weekly Average Exceedance shall be paid for each violation of a

modified limit. If you have information that will prove to the Division that any or all of the criteria set
forth in Paragraph 4. have been met, you must submit this information in writing to the Mooresville
Regional Office within ten (10) days after your receipt of this notice. In the absence of evidence
justifying the application of the provision within Paragraph 4., this Office will proceed with assessment
of stipulated penalties as provided for in the SOC.
