wastewater treatment facility and that the flow from this project is not anticipated to cause any capacity

treatment plant under normal circumstances, given the implementation of the planned improvements
identified in the planning assessment where applicable. This analysis has been performed in accordance
with local established policies and procedures using the best available data. This certification applies to

infrastructure.
I understand that this does not relieve the collection system owner from complying with G.S. 143-
215.67(a) which prohibits the introduction of any waste in excess of the capacity of the waste disposal
system.

Planning Assessment — Town of Four Oaks flow to Johnston County —
October 24, 2023
Currently the Johnston County Four Oaks WWPS pumps to the Town of Benson. Wastewater
is received by the Town under an inter-local agreement between the Town of Benson and
Johnston County.
Benson can no longer receive the full amount of wastewater allocated in the current agreement.
Currently the County sends all of the wastewater received at the Four Oaks WWPS to the Town
of Benson. Benson's WWTP discharges to the impaired Hannah Creek. Because of the
impairment, the Town has not been able to increase the plant's NPDES permit to the full design
capacity of the facility.
A new agreement is being developed with the Town of Benson to set a sustainable amount of
flow that can be received by the Town (Draft Agreement includes 200,000 gpd). Any additional
flow will be sent to the Central Johnston County Regional WWTF (CJCRWWTF).
• Four Oaks has a current allocation with the County of 384,455 gpd.
• The average daily flow from the Town of Four Oaks over the past two years is 242,088
gpd. They were dry years.
• The Town has 84,641 gpd of flow permitted, but not yet tributary to the system.
The County has devised a plan to handle the current and future flow from the Town of Four
Oaks. The plan includes upgrading the Four Oaks WWPS to send flow to the Town of Benson
and the CJCRWWTF simultaneously. Along the path to the CJCRWWTF, the Holt Lake WWPS
and the downstream FM be upgraded. The Neuse River WWPS will also need to be replaced.
The upgrades to the Four Oaks will allow the County to send 360 GPM to the Town of Benson
and 520 GPM to the CJCRWWTF simultaneously and better utilize the equalization on site. A
permit for this project is under review by DEQ. The project is planned to start construction in
early 2024 and be completed in 2025.
The upgrade to the Holt Lake WWPS will modify the existing wetwell to accommodate 700 gpm
pumps and a new generator on-site. In addition, 4,500 If of 8" FM along an existing easement
to the gravity system that drains to the Neuse River WWPS. This project is currently under
construction and will be completed in 2024. Until the upgrades are complete the station is
limited to 300 gpm or a permitted capacity of 172,800 gpd.
The existing Neuse River WWPS is precariously located close to the bridge over the Neuse
River on US 301. The station is almost completly surrounded by water during flood events, and
the station is in need of major repairs. In addition, a NC DOT bridge replacement project will
make safe access to the site limited. A replacement station with a capacity of 800 gpm is
planned outside of the floodplain. This project is in the final stages of design and will be
completed in 2025/2026. Until the new station is complete, the Neuse River WWPS is limited to
347 gpm or 200,000 gpd.
The flow tracking presented shows the future second path to the CJCRWWTF for flow from the
Four Oaks WWPS. The excess existing flow (42,088gpd) and all of the permitted but not yet
tributary flow currently allocated are included in the numbers presented.
No new flow from the Four Oaks Industrial Park will be accepted until the projects are complete.

Project Narrative
The proposed Mayes Farm Apartments project is located approximately 0.51 miles (NE)from the
intersection of Keen Road and E. Wellons Street in the Town of Four Oaks, North Carolina.The site is
9.62 acres and is bounded by US Highway 301 on the north side. The property coordinates are 35'26'
56.8" N; 78°24'S8.5"W.The existing site is a vacant wooded lot with several abandoned homes and
out structures that are to be demolished and removed.
Three apartment buildings, a club house, and associated parking are proposed to be constructed with
the development of this site. Twelve (12) 1-bedroom,twenty-four(24)2-bedroom and twenty-four(24)
3-bedroom units will be provided for a total of 60 residential units. Utilities will be served by the Town
of Four Oaks.
An existing 8"sanitary sewer line runs parallel to US Highway 301. A proposed 8" sanitary sewer line
from the project site will connect to the existing line. A lift station will not be required as there is
sufficient depth and slope. Onsite sanitary sewer lines are min. 6" diameter to comply with DWR design
criteria,
There are no existing sanitary sewer permits for this site. A new permit is being requested.

This office has reviewed the subject erosion and sedimentation control plan. We find the
plan to be acceptable and hereby issue this Letter of Approval. The enclosed Certificate of
Approval must be posted at the job site. This plan shall expire three(3)years following the
date of approval, if no land disturbing activity has been undertaken, as is required by Title
15A NCAC 413 .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent(eNOI) form requesting a Certificate of Coverage (COC) under
the NCG010000 Construction General Permit. After the form is reviewed and found to be
complete,you will receive a link with payment instructions for the$100 annual permit fee.
After the fee is processed, you will receive the COC via email. As the Financially
Responsible Party shown on the FRO form submitted for this project, you MUST obtain
the COC prior to commencement of any land disturbing activity. The cNOI form may be
accessed at deq.nc.gov/NCG0L Please direct questions about the eNOI form to the
Stormwater Program staff in the Raleigh central office. If the owner/operator of this

Title 15A NCAC 413 .0118(a) and the NCG01 permit require that the following
documentation be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 12 months.
Also, this letter gives the notice required by G.S. I I3A-61.1(a) of our right of periodic
inspection to ensure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance-oriented, requiring
protection of existing natural resources and adjoining properties. If, following the
commencement of this project, it is determined that the erosion and sedimentation control
plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statute 113A-51 through 66), this office may require
revisions to the plan and implementation of the revisions to ensure compliance with the
Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal
and State water quality laws, regulations, and rules. In addition, local city or county
ordinances or rules may also apply to this land-disturbing activity. This approval does not
supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided

After reviewing the Fast Track Sewer System Extension Application for Mayes Farm Apartments,
additional information is required in order to further process the application. Please provide the
following information by December 2,2023 and note that the requested information must be
submitted within 30 days of this request,or the applicant will be required to submit a new application
and application fee in accordance with 15A NCAC 02T.0107.
1. While reviewing the permit, I noticed that Barry Stanley is listed as the Public Works Director
with the Town of Four Oaks, however, our records do not indicate that Barry Stanley has
Signatory Authority for the Town of Four Oaks. Please submit the Delegation of Signatory
Authority form to the address provided on the form so that we can ensure that Barry has the
authority to sign the submitted Fast Track Application (FTA)and the Flow Tracking for Sewer
Extension Application (FTSE), please also email me a copy of the signed form so that I can attach
it to this application while NCDEQ is processing the form.

3. According to the project narrative,there is to be three (3)apartment buildings for a total of 60
residential units and a club house for the Mayes Farm Apartments. However, according to
Sections VI.4. and VI.7.,there are two (2) apartment buildings for a total of 48 units and no club
house or swimming pool. Please update these sections within the FTA and be sure to include
swimming pool clubhouse and filter backwash if those wastewater streams will be discharged to
the gravity sewer being proposed in this application.
RESPONSE:Typo in VI.7 table has been corrected. Also, no swimming pools are proposed with
this development,therefore Swimming Pool/Clubhouse is not checked. Clubhouse is not for
dwelling purposes.

type according to 15A NCAC 02T .0114, (ex. 1-2 BR units, 3 BR, pool, clubhouse).

4. According to the project narrative, an 8-inch gravity sewer is to be installed to connect the new
line to the exiting 8-inch gravity sewer that runs parallel to US Highway 301 . However,
according to Section VII.,there are multiple gravity sewers to be installed on the site (367 LF of
8" GS, 539 LF of 6" GS, and 238 LF of 4" GS). Currently the proposed gravity sewer design does
not meet the Division's Minimum Design Criteria (MDC for GS). If the project is unable to meet
the MDC for GS then an Alternate Sewer Extension Application or full plan review may be
necessary. Please verify that the length and size of the proposed gravity sewers meet minimum
design criteria and update the FTA accordingly.

5. According to Section IXA.,the project is located in the Neuse River Basin and is applicable to
State Buffer Rules. Does this project have any stream crossings or other stream and/or wetland
impacts? If so,what are the impacts and are they temporary or permanent?
RESPONSE:An existing stream runs through the property. No stream crossings are proposed.
No wetland impacts or encroachment into wetlands are proposed.
a. Please update and resubmit Page 4 of the FTA to indicate whether the project complies
with setback requirements according to the river basin rules.
RESPONSE: Page 4 updated as requested.
b. Additionally, please provide the Buffer Authorization Letter for this project.
RESPONSE: Project was not required to obtain Buffer Authorization Letter. DEQ
Permit issued. Please refer to DEQ Project ID No.JOHNS-2023-037 attached.
6. Section IX.5. of the application states that 401/404 authorization is not needed for this
project. Please provide an explanation indicating why a separation requirement is not
applicable to the project since this is a wooded area with a stream running north-south along
the eastern side of the project area.
RESPONSE: Even though an existing stream runs through the property, no crossings or
improvements are proposed that will impact the stream. Additionally, no improvements or
encroachments are proposed within 50'from either side of the center of the stream. Onsite
detention facilities are proposed to ensure existing flow patterns remain at pre-development
conditions.
7. The Flow Tracking for Sewer Extension Applications (FTSE)form is not filled in
completely. Please fill out and resubmit all sections of the form completely.
RESPONSE:Document provided to city staff for their assistance in filling it out as we don't
have the requested information. Form to be provided by city staff.
8. The topographical map submitted is not sufficient. According to Section F of the Application
Instructions, an 8.5-inch x 11-inch color copy of a USGS Topographic Map needs to clearly
identify the project area, including the closest surface waters,general location of the gravity
sewer, pumpstations, and force mains, and the downstream connection points for the receiving
sewer. Please provide the topo map according to the application requirements.

Hello Barry and Brian,
After reviewing the Fast Track Sewer System Extension Application for
Mayes Farm Apartments, additional information is required in order to
further process the application. Please provide the following information
by December 2, 2023, and note that the requested information must be
submitted within 30 days of this request, or the applicant will be required
to submit a new application and application fee in accordance with 15A
NCAC 02T .0107.
1. While reviewing the permit, I noticed that Barry Stanley is listed as
the Public Works Director with the Town of Four Oaks, however, our
records do not indicate that Barry Stanley has Signatory Authority for
the Town of Four Oaks. Please submit the Delegation of Signatory
Authority form to the address provided on the form so that we can
ensure that Barry has the authority to sign the submitted Fast Track
Application (FTA) and the Flow Tracking for Sewer Extension
Application (FTSE), please also email me a copy of the signed form
so that I can attach it to this application while NCDEQ is processing
the form. — completed
Forms and Reports I NC DEQ 4 Delegation of Signatory

1. According to Section V1.7., 14,400 GPD of domestic wastewater will
be generated by the project but no receiving facility or downstream
sewer information was listed. Please complete and resubmit
Sections IV. and V. of the FTA with the correct information pertaining
to the receiving wastewater treatment facility, the downstream
sewer, and the receiving collection system. — completed
2. According to the project narrative, there is to be three (3) apartment
buildings for a total of 60 residential units and a club house for the
Mayes Farm Apartments. However, according to Sections VIA. and
V1.7., there are two (2) apartment buildings for a total of 48 units and
no club house or swimming pool. Please update these sections
within the FTA and be sure to include swimming pool clubhouse and
filter backwash if those wastewater streams will be discharged to the
gravity sewer being proposed in this application. — completed

3. According to the project narrative, an 8-inch gravity sewer is to be
installed to connect the new line to the exiting 8-inch gravity sewer
that runs parallel to US Highway 301 . However, according to
Section VII., there are multiple gravity sewers to be installed on the
site (367 LF of 8" GS, 539 LF of 6" GS, and 238 LF of 4" GS).
Currently the proposed gravity sewer design does not meet the
Division's Minimum Design Criteria (MDC for GS). If the project is
unable to meet the MDC for GS then an Alternate Sewer Extension
Application or full plan review may be necessary. Please verify that
the length and size of the proposed gravity sewers meet minimum
design criteria and update the FTA accordingly. — GS design criteria

s. The topographical map submitted is not sufficient. According to
Section F of the Application Instructions, an 8.5-inch x 11-inch color
copy of a USGS Topographic Map needs to clearly identify the
project area, including the closest surface waters, general location of
the gravity sewer, pumpstations, and force mains, and the
downstream connection points for the receiving sewer. Please
provide the topo map according to the application requirements. -

1. "(2) (e) If an application is accepted and later found to be
incomplete, the applicant shall be advised how the application or
accompanying supporting information may be modified to make it
complete. The staff shall advise the applicant:
(2) if all required information is not submitted within 30 days,
the project will be returned as incomplete. Any resubmittal of a
returned application shall be accompanied with a new
application fee."
