I am responding to your NOTICE OF VIOLATION & INTENT TO ASSESS CIVIL PENALTY letter that I
received delivered certified mail to my mailbox. I picked up my mail on 12/16/23, where this was
included.
I was previously contacted by my waste water treatment company, Water Quality Labs, in
Banner Elk, NC that we had incurred violations because I had not sent them a copy of our new permit.
That was my oversight and I take full responsibility for that.
I had called the permitting department earlier in the year because I had not received our new
Permit and was informed the process was delayed due to the covid epidemic. When I did receive the
Permit renewal I filed it, not realizing there were changes to the process. (I believed that I also updated
my address at that time, but I did not note that and have no proof. That may have caused further delay.)
I am so sorry this happened. So much of the communications from the state seem to happen
directly between the Regional Office and Water Quality Labs that I made a stupid assumption that they
are copied on the Permit as well. Water Quality Labs now has a copy and has been in compliance with all
of the changes required by the permit since they, and I, were notified.
I am begging for forgiveness, as there was no malicious intent, and no harm was caused.
