DWR received the notice to withdraw the permit application for Core Creek, and Core Creek
Development Partners LLC on December 20, 2023, from DCM. If you plan to resubmit an
application for this project in the future, please reference DWR#20231410 and SAW-2023-
02079. Attached are the three requests that DWR was planning to request on the formal
additional information request. If you have any questions, please feel free to contact me.
1. It has been recognized that the DO standard may be difficult for many two or more
segment marinas to achieve because reduced water circulation favors stagnation and
oxygen demands can cause DO inside poorly flushed basins to be lower than in
adjacent waters (NCDEM, 1990). The standards state that DO shall be "Not less than
5.0 mg/l, except that swamp waters, poorly flushed tidally influenced streams or
embayment's, or estuarine bottom waters may have lower values if caused by natural
conditions" [15A NCAC 02B .0220 (5) and 15A NCAC 02B .0221]. The Division is only
able to issue a 401 Water Quality Certification if the project is likely to protect water
quality standards including existing uses and will not result in water quality
degradation. Please submit an approved flushing and dissolved oxygen model for
the proposed access channel and basins to help the Division determine what
impacts the proposed basins will have on water quality.
2. Marina development can result in reduced levels of dissolved oxygen and favorable
hydrographic characteristics include open water sites, sites with high tidal flushing, or
sites near inlets and mouths of tidal creeks. The Division has concerns about the
hydrographic characteristics of the proposed basins and how the proposed marina
basin being located approximately 9 nautical miles North of Beaufort Inlet and having
an approximate lunar tidal amplitude of +/-2 feet will impact water quality. Please
include both basins in the dissolved oxygen and flushing model and have it
approved by the DWR Modeling and Assessment Branch Staff. Attached is the link

3. Please provide a detailed map including sedimentation and erosion control
measures that are proposed to be used to contain the dredged material in the
disposal areas located on site, and delineate any wetlands located on the property.

DWR is placing your application on HOLD due to concerns about Dissolved Oxygen
(DO) and Flushing. A formal letter will be sent next week with clarification. The
applicant proposes to dredge an upland marina basin in the waters of Core Creek
(Intracoastal Waterway Adams Creek Canal) in Beaufort, North Carolina. The surface
waters of Core Creek are classified SA;HQW by the Division of Water Resources. Your
application is on HOLD until an approved DO and Flushing model are submitted for
review.
