Rosewood Bank Parcel Credit Release — Task 2 (final), Task 4
Dear Mr. Hutton,
On September 29, 2023, the Division of Water Resources (DWR) received a Year 1 Monitoring
Report from Wildlands Holdings III, LLC (Wildlands) for the Rosewood site. Overall, site
conditions appear to look good, performance standards for vegetation are met and minor
encroachment within the conservation easement areas was noted. Written communication needs to
be provided in the future if any other encroachments occur on the site. On June 8, 2023, DWR
issued a partial credit release of 10% for partial completion of Task 2 milestones, with a commitment
to issue the remaining 10% when confirmation of supplemental plantings required by DWR had been
fully implemented. On November 13, 2023, Wildlands submitted confirmation that all supplemental
planting efforts had been fully implemented.
DWR received a bond rider and continuation certificate for performance bond (#107889544) issued
to Wildlands from Travelers Casualty and Surety Company of America, in the amount of $80,000, to
cover monitoring and maintenance at the subject site. The term of this bond ends with DWR
approval of the Year 2 Monitoring Report. Future credit releases will be dependent on both the
renewal of this performance bond and the annual monitoring reports.
In accordance with the UMBI (DWR# 2021-0206v2), signed on February 15, 2022, the following
Project Milestones have been met and the corresponding credits shall be released:

2) Final All riparian Earthwork & Mitigation activities, planting and installation 10%
of monitoring devices completed, easement boundaries adequately marked
4) Monitoring Report #1: Approved by the DWR & financial assurance renewed 10%

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and the following credits are released:
• 20% of the Neuse buffer Restoration credits (0.20 x 717,559.251 ft2=143,511.850 ft2)
• 20% of the Nitrogen nutrient offset credits (0.20 x 57,929.684 lb-N = 11,585.937 lb-N)
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to 15A NCAC
02B .0703, which became effective on April 1, 2020. Additionally, the riparian buffer credits
must be used for impacts in the Neuse River Basin in accordance with guidelines in the
Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on
November 1, 2015.
