Aliisa, Thank you for the prompt response. I appreciate the responses provided but they do not answer my questions. We at the Corps understand that the pipe under the road (see email thread below). Is a stormwater pipe typical for a developer to route stormwater flow under proposed house lots? This connection seems to provide a hydrologic connection from upstream to downstream, so is it a French drain? There is a culvert emplaced in a location that does not have an aquatic feature, and we are not sure why. I understand the initial development was approved in 2007 by the city of Mint Hill. It is currently 2023 which is 16 years from approval. I am not sure that the network/ roadway alignment was appropriate at that time, is applicable with current codes. Do you have an updated development plan that has been approved? We also understand that it is the purview of the applicant to obtain all local/regional permits before starting work. We just want to ensure that all avoidance and minimization for the site layout has been completed. Lot sizes/ location and road designs can change, we want to make sure that the permit approval is up to date. In addition, the Delineation was not verified by the USACE. At this time, we would assume that the stream labeled 'intermittent" is actually a Perennial. And we would like to see a documented photograph from the top of the reach of Stream B (looking up -channel) to determine if it is a head cut/seep/ephemeral flow providing hydrology to this perennial stream. In addition to additional photographs, a datapoint with appropriate data forms within this reach are requested. You have 30 days to respond to this email, before the USACE will administratively withdraw the application due to lack of information. Regards, Doug J. Our responses are below in red. - First, what is that structure below those proposed house lots and what is the purpose? It is a stormwater pipe. The outlet is better shown in the screenshot below. (It does not drain directly to the stream). Second, why can't the road be shifted to the west and completely avoid the impacts? There appear to be plenty of SWCs already proposed for this project and plenty of room. - The SWC in question was required as a part of their fire safety plan. The proposed development was designed based on the zoning requirements of the City of Mint Hill. Site layout and roadway connectivity were initially established with previously approved plans for the subdivision. Based on the number of proposed lots and the requirements of the NC Fire Code and City of Mint Hill, the residential roadway network layout requires two points of access in the vicinity of the stream crossing. The proximity of the stream to the western boundary line limits the placement of these required internal roadway access points. The stream crossing was chosen to be at the upper end of the stream to reduce the need for culvert capacity and stream disturbance. I have attached the previous permit approval from 2007 for this project.
