Enclosed with this letter is a copy of the Draft NPDES permit renewal for your facility. Please
review this draft carefully to ensure thorough understanding of the requirements and conditions it
contains. There are several changes from the existing permit, including the following:
• The facility's system component list has been revised based on the submitted Process
Narrative and plant flow diagram (See Supplement to Permit Cover Sheet).
• Based on NPDES guidance regarding the reduction of monitoring frequencies in NPDES
permits for exceptionally performing facilities, monitoring requirements for BOD5, Total
Suspended Solids and Enterococci have been maintained at 2/week at 0.6 MGD [See A.
(I.)]. In addition, based on 15A NCAC 02B, .0508, monitoring frequencies for the above
parameters at 1.0 MGD expansion flow have been adjusted to 3/week with a footnote that
the Permittee may request reduction of monitoring frequency if no exceedances have been
reported within six (6) months after expansion [See A. (2.), Footnote 3].
• Based on calculations of site -specific limits for Ammonia in salt waters, Ammonia limits
have been adjusted at both flow tiers. In addition, in accordance with 15A NCAC 02B,
.0508, monitoring for Ammonia has been adjusted to 1/week at both flow tiers [See A. (1.)
and A. (2.)].
• To better identify nitrogen in the effluent, monthly monitoring for NO2+NO3 have been
added to the permit at both the 0.6 and 1.0 MGD flow tiers [See A. (1.) and A. (2.)].
• Based on the reasonable potential analysis (RPA) showing no reasonable potential to
violate state water quality standards, monitoring requirements for Bromoform have been
removed from the permit at both flow tiers [See A. (L) and A. (2.)].
• Based on the reasonable potential analysis (RPA) showing reasonable potential to violate
state water quality standards in High Quality Waters, limits for Total Copper and
Dibromochloromethane have been revised at both flow tiers [See A. (L) and A. (2.)]. In

addition, limits and monthly monitoring for Total Zinc and Bis(2-ehylhexyl) phthalate have
been added to the permit.
• Based on the RPA predicting a maximum effluent nickel concentration that is greater than
half of the allowable discharge concentration based on state water quality standards,
quarterly monitoring for Total Nickel has been added to the permit at both flow tiers [See
A. (L) and A. (2.)].
• The instream monitoring requirements have been removed from Sections A. (L) and A.
(2.) and placed as a separate condition [See A. (1)].
• Based on the Division of Marine Fisheries prohibiting Shallowbag Bay from shellfish
growing within Shellfish Growing Area H-1 due to fecal coliform concerns, effluent and
instream monitoring, the latter at all five (5) locations, for Fecal Coliform has been added
to the permit at a weekly frequency [See A. (1)].
• Because their limit effective dates have passed, the compliance schedule for Total Copper
and Dibromochloromethane has been removed from the permit.
• To provide an opportunity for the Town to develop a plan to assess sources of total copper
total zinc, dibromochloromethane and bis(2-ethylhexyl) phalate in order to come into
compliance with the limits in Section A. (L), a 5-year compliance schedule has been added
to the permit with an option to conduct a dilution study to produce a dilution factor for use
in site -specific limit development [See Special Condition A. (6.)].
• A special condition to monitor effluent PFAS chemicals 2/year has been added to the
permit, to be effective six (6) months after EPA has a final wastewater method in 40 CFR
136 method published in the Federal Register [See Special Condition A. (7.) PFAS
Monitoring Requirements].
• Some of the wording has changed in Special Condition A. (3.) Acute Toxicity Pass/Fail
Permit Limit; please review each paragraph carefully.
• Some of the wording has changed in Special Condition A. (4.), formerly A. (5.) Effluent
Pollutant Scan; please review each paragraph carefully.
• A notation was made concerning the Electronic Reporting Rule — NPDES Electronic
Reporting Rule — Phase 2 Extension. EPA extended the Phase 2 deadline to December 21,
2025 [See A. (6.)].
• Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and program reports. The requirement to continue reporting discharge monitoring
data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR)
internet application has been added to your NPDES permit [See Special Condition A. (6.)].
• The map has been revised to show instream monitoring locations.
The NPDES standard conditions (Parts II, III, and IV) that are a part of the permit are not included
in this draft document (cover, map, and Part I). The conditions are the same as in your current
permit except that agency and division names have been updated. The latest version is available at
https://bit.ly/3k5NFaL and can be viewed online or downloaded as a PDF file.
Concurrent with this notification the Division is publishing a notice in a newspaper having
circulation in the general Dare County area, soliciting public comments on this draft permit. Please

4. The facility shall monitor TRC when using chlorination for disinfection. The Division shall consider all effluent total
residual chlorine values reported below 50 µg/L to be in compliance with the permit. However, the permittee shall
continue to record and submit all values reported by a North Carolina certified laboratory (including field certified),
even if these values fall below 50 µg/L.
5. For a given wastewater sample, TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl
Nitrogen, and NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively.
6. Metals monitoring shall coincide with acute toxicity monitoring. Metals sampling shall be reported to the lowest
available target PQL identified by the Division's laboratory or the lower reporting level of the procedure.
7. The Permittee shall achieve compliance with these limitations within five years of the effective date of this permit and
shall follow the Total Copper, Total Zinc, Dibromochloromethane and Bis(2-ethylhexyl) phthalate compliance schedule
detailed in Special Condition A. (6.).
8. Mercury samples shall be analyzed using EPA Method 1631 E.

10. Acute Toxicity (Fathead Minnow) Pass/Fail at 90% effluerrtvith testing in February, May, August, and November. See

A.(4.) ACUTE TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERLY)
[15A NCAC 02B .0200, .0500 et seq]
The Permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina
Procedure Document entitled "Pass/Fail Methodology for Determining Acute Toxicity In A Single Effluent
Concentration" (Revised -December 2010, or subsequent versions). The monitoring shall be performed as a
Fathead Minnow (Pimephales promelas) 24-hour static test. The effluent concentration at which there may be at
no time significant acute mortality is 90% (defined as treatment two in the procedure document). The tests will
be performed during the months of February, May, August, and November. These months signify the first
month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must
be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring
will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
All toxicity testing results required as part of this permit condition will be entered electronically using the
Division's eDMR system for the month in which it was performed, using the parameter code TGE6C.

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after
the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during any month, the permittee will complete the
information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number,
pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the
form. The report shall be submitted to the Water Sciences Section at the address cited above.
Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to

(a.) Effluent Pollutant Scans. The Permittee shall perform a total of three (3) Effluent Pollutant Scans for all
parameters listed below. One scan must be performed in each of the first three years after expansion to 1.0

(b.) Effluent Scan Reporting. Test results shall be reported electronically via eDMR by December 31 st of
each designated sampling year, except that, subject to prior written approval by the Director, results can be
reported on DWR Form DMR-PPA-1 or other form approved by the Director. The Permittee must at least
report completion of the test in the eDMR system by entering "I" or "Y" for parameter code NCO 1- Annual
Pollutant Scan. If written reports are approved, the report shall be submitted to the following address:

(c.) 2nd-Species Toxicity Testing and Reporting.
(i.) In addition to the quarterly toxicity tests required in Condition A.(3.) Acute Toxicity Pass/Fail Permit
Limit, the Permittee shall perform and report the results of four (4) toxicity tests using the same test
methods using a second species of test organism suitable to the tests being conducted.
(ii.) The 2nd species toxicity tests shall be conducted either:
(A) Once per quarter in a single 12-month period (four samples); if this option is chosen, the
sample for each 2nd species test shall coincide with the quarterly samples collected for Acute
Toxicity Pass/Fail Permit Limit, or
(B) Once per 12-month period in the four -and one-half year period prior to the scheduled
application for permit renewal (four samples); if this option is chosen, three of the samples for
the 2nd species test shall coincide with those for the annual effluent scans and the coincident
quarterly toxicity test, and each of the four annual samples shall be collected in a different
calendar quarter in order to represent seasonal variation.
(iii.) The results of the toxicity tests shall be submitted to the following address:

A.(6.) SCHEDULE OF COMPLIANCE FOR TOTAL COPPER, TOTAL ZINC,
DIBROMOCHLOROMETHANE, AND BIS(2-ETHYLHEXYL) PHTHALATE LIMITS (5-YR)
[NCGS 143-215.5 (b)]
This compliance schedule includes the option for pursuing a dilution study for developing site -specific limitations
and compliance with the limits for Total Copper, Total Zinc, Dibromochloromethane and Bis(2-ethylhexyl)
phthalate.
(a.) If the Permittee wishes to pursue a dilution study to develop site -specific limitations for the above
pollutants, then within six (6) months of the permit effective date, the Permittee shall submit to the Division
of Water Resources a dilution study plan for approval. The Plan shall include a proposed modeling approach
and justification for the use of the selected model (CORMIX or equivalent), a proposed sampling protocol,
and a timeline for completion of the study.
(i.) Within eighteen (18) months of the dilution study plan approval by the Division, the Permittee shall
submit to the Division a report summarizing the results of the dilution study.
(A) A final model report shall be submitted to the Division within 90 days of completion of the
study. The report shall include a summary of all data collected, model assumptions, model
setup, model input and model results. If the dilution study results in site -specific limits for the
Total Copper, Total Zinc, Dibromochloromethane, and Bis(2-ethylhexyl) phthalate that the
Permittee wishes to have in the perm it, the Permittee shall submit to the Division a major permit
modification request to include the dilution factor -derived limits.
(B) The dilution factor determined by the CORMIX model (or equivalent) will be used by the
Division to develop site -specific limits for the above pollutants as well as for the chronic
effluent test concentration once the model is reviewed and approved by the Division.
(ii.) The final Total Copper, Total Zinc, Dibromochloromethane, and Bis(2-ethylhexyl) phthalate limits
based on dilution factor -derived limits, if approved, will be placed into effect upon the major permit
modification effective date and all remaining schedule items will be removed.
(b.) If the Permittee does not submit a dilution study plan within six (6) months of the permit effective date,
then the Permittee shall follow the Compliance Schedule outlined below (replacing the schedule in section
A.6.a. above) and substitute the dates for one through five years from the permit effective date:
(i.) Within one (1) year of the permit effective date, the Permittee shall submit to the Division a
Corrective Action Plan (CAP) for Division approval, summarizing the strategy or actions to be taken
to achieve compliance with the Total Copper, Total Zinc, Dichromobromomethane and Bis(2-
ethylhexyl) phthalate limitations listed in Section A. (1.). This plan will include specific dates for
completion or implementation of each action.
(ii.) Within two (2) years of the permit effective date, the Permittee shall submit to the Division a
summary of actions taken towards achieving compliance with the Total Copper, Total Zinc,
Dichromobromomethane and Bis(2-ethylhexyl) phthalate limitations specified in Section A. (1.).
(iii.) Within three (3) years of the permit effective date, the Permittee shall submit to the Division a
summary of actions taken towards achieving compliance with the Total Copper, Total Zinc,
Dichromobromomethane and Bis(2-ethylhexyl) phthalate limitations specified in Section A. (1.).
(iv.) Within four (4) years of the permit effective date, the Permittee shall submit to the Division a
summary of actions taken towards achieving compliance with the Total Copper, Total Zinc, Br
Dichromobromomethane and Bis(2-ethylhexyl) phthalate limitations specified in Section A. (L).
(v.) Within five (5) years of the permit effective date, Permittee shall achieve compliance with Total
Copper, Total Zinc, Dichromobromomethane and Bis(2-ethylhexyl) phthalate limitations specified
in Section A. (I.).

Upon approval of the Corrective Action Plan (CAP) by the Division, the report, actions, and implementation
dates become an enforceable part of this permit. Any modifications to the schedule shall be requested to the
Division at least ninety (90) days before the deadline. Modifications to the schedule more than four months will
be subject to public notice.
Annual summaries and the CAP shall include the owner's name, NPDES permit number, and a Permittee contact

Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted
monthly electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being
physically located in an area where less than 10 percent of the households have broadband access, then a

Monitoring results obtained during the previous month(s) shall be summarized for each month and reported
via the eDMR system no later than the last calendar day of the month following the completed reporting
period. Regardless of the submission method, the first DMR is due on the last day of the month following the
issuance of the permit or in the case of a new facility. on the last day of the month following the
commencement of discharge.
Starting on December 21, 2025, the Permittee must electronically report the following compliance
monitoring data and reports, when applicable:
• Sewer Overflow/Bypass Event Reports; and
• Pretreatment Program Annual Reports; and
• Clean Water Act (C WA) Section 316(b) Annual Reports.
The Permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver
from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1)(9), the Permittee must identify the initial recipient at the time of each
electronic submission. The permittee should use the EPXs website resources to identify the initial recipient
for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or
the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving
electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type
of electronic submission and for each state. Instructions on how to access and use the appropriate electronic

3. How to Request a Waiver from Electronic Reportin¢
The Permittee may seek a temporary electronic reporting waiver from the Division. To obtain an electronic
reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division.
Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written
approval at least sixty (60) days prior to the date the facility would be required under this permit to begin
submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall
thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division
unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division.
Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting
waiver request may submit monitoring data and reports on paper to the Division for the period that the
approved reporting waiver request is effective.

4. Signatory Requirements (Supplements Section B. (11.) (b) and Supersedes Section B. (11.) (d)]
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section
B. (I1.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (I I.)(b). A
person, and not a position, must be delegated signatory authority for eDMR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and
login credentials to access the eDMR system. For more information on North Carolina's eDMR system,

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make the

The Permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions. These
records or copies shall be maintained for a period of at least 3 years from the date of the report. This period
may be extended by request of the Director at any time [40 CFR 122.41 ].
