The requested figure revisions are attached. The previously permitted parking spaces totaled 873 spaces which was approximately 316,555 square feet. The currently proposed parking spaces total 213 spaces and equal approximately 76,901 square feet. Previously, 506 residential units were permitted, and none are currently proposed. In the previously permitted plans, —5,710 sf of new impervious was permitted within the 75 ft AEC. An additional—17,712 sf was already existing impervious within the 75 ft AEC, so the total impervious area within permitted plan was ^23,422 sf. Due to the size of the permitted basin, the total area within the permitted 75 ft AEC was—153,989 sf. The total impervious (existing and permitted) accounted for —15 percent of the 75 ft AEC. Please see the attached table for reference. In the proposed plans,—10,251 square feet is new proposed impervious surface. Approximately 27,368 sf is existing impervious because the waterfront site is largely concrete. Of this 27,368 sf, ^8,851 sf will be redevelopment. The total amount of impervious within the proposed 75 ft AEC is-37,619 sf. Due to the reduction in the basin size, the total area within the 75 ft AEC is-101,000 sf. The total impervious (existing and proposed) accounts for ^37 percent of the 75 ft AEC. Please see the attached table for reference. The AIW W at this location is classified as SA;HQW, primary nursery area and is closed to shell fishing. The shoreline length at MHW is 1,322 linear feet. The western adjacent riparian property is a marine construction company with a docking facility. The landward western neighboring tax parcels are either NCDOT or commercial businesses. The eastern adjacent riparian property is an undeveloped residential lot. All the neighboring properties to the east are residential lots that are either undeveloped or have existing single family homes. The site is currently owned by Oak Island Property Holdings LLC. It was historically a waterfront restaurant, and a large portion of the site is covered in impervious material from the historic parking, building footprint and road. The shoreline is largely concrete and impervious rubble. It currently has 74,350 square feet of impervious surfaces, much of which is near the shoreline. Over the years, some coastal wetlands have volunteered onto part of the concrete and rubble shoreline growing in the fractured impervious surfaces. Where there are not old impervious surfaces, there are coastal wetlands near the shoreline and 404 wetlands scattered throughout the southern portion of site. The northern half of the site contains all uplands and is cleared of most trees. There is one building in the northeastern most part of the project a rea. On 03/13/09, a major modification and permit transfer of CAMA permit no. 40-96 was issued which permitted 0.10 acres of wetland impacts, dredging, a basin, bulkhead, docking facility with slips, and upland development including boat racks, dry stacks, pedestrian walkways, forklift paths, parking, and residential units. These previously permitted structures can be seen on sheets 2 and 3 of in the attached figures. A stormwater permit was issued for the permitted development under stormwater permit no. SW8070685 on 10/16/07. On 06/09/09, a minor modification to CAMA permit no. 40-46 with additional mitigation required which was completed. A mitigation payment of $66,453.75 was made on 9/25/2009 to the EEP for these impacts. A request to renew CAMA permit no. 40-96 was submitted on 11/05/15. The lack of progress in construction was due to local economic hardship associated with the recession. Between the issuance of the permit, minor modification in 2009 and the renewal request in 2015, Oak Island Property Holdings hired surveyors, contractors, and planners to progress towards the construction of the project. The renewal was issued on 01/15/16 and set to expire on 10/20/17. Another renewal was issued on 10/19/17 before the previous expired. Work progress started on the project and additional renewals were issued on 11/26/19 and 09/22/21 and the permit is valid until October 20, 2023. On 06/13/23, a site visit was conducted with DCM staff to review the proposed minor modification plans and existing conditions. A renewal request is currently pending. Proposed Action The applicant proposes to modify the plans from their original permitted state in 2009. The modification request proposes a basin and bulkhead that are significantly reduced in size from what was originally permitted in 2009. The proposed bulkhead will be 753 ft long and the basin will increase public trust waters by approximately one acre. The total excavation landward of the MHW line will be 22,634 cy. The basin docks are proposed to be reconfigured into 3 floating docks, varying in width and length to support the dry stack storage marina versus the previously permitted permanent wet slip configuration. The total slip count will be reduced to 49 from the 83 that were permitted prior. Two forklift drop zones are proposed to lower vessels into the basin. Impervious concrete access paths are proposed to allow forklift access from boat storage to the basin. Four dry stack storage buildings measuring 103 by 35 feet are proposed directly north of the basin. One 170 by 35 foot dry stack storage building is proposed directly west of the basin. The 250 by 135 foot dry stack storage building will remain as previously permitted on the southwestern portion of the property along with the associated parking that will be slightly reconfigured, and two additional 270 by 35 foot dry stack storage buildings are located to the north in the middle portion of the property and are accessed by a concrete road. The total dry slip count will be 674. Fuel tank storage was previously permitted and remains unchanged. The 50 by 40-foot marina office and elevated wooden walkways surrounding it for access to and from the parking area and the floating docks within the basin remain largely unchanged. The elevated wooden walkways have been significantly reduced and the 10- foot-wide walkways that accounted for approximately 15,0091 square feet of shading over 404 wetlands have been eliminated from this proposal. Five work racks are proposed on the property, located adjacent to the concrete forklift access paths. Additional parking is proposed near the northern dry stack storage buildings making a total of 213 parking spaces for the proposed marina or 76,901 square feet. The previously permitted parking spaces totaled 873 spaces which was approximately 316,555 square feet. Previously, 506 residential units were permitted, and none are currently proposed. A connecting road is proposed to lead down to an elevated wooden walkway that provides access to the floating docks. An existing impervious area south of the forklift drop zone is proposed to be removed and reducesthe amount of impervious within the 30-foot CAMA buffer. Previously permitted maintenance dredging to provide access from the basin to the AIWW will remain unchanged to -6.5 MLW and total 5,675 cy of excavation. The spoil disposal location is unchanged from what was previously permitted and remains uplands on -site. In the previously permitted plans, -5,710 square feet of new impervious was permitted within the permitted 75 ft AEC. An additional-17,712 square feet was already existing impervious within the permitted 75 ft AEC, so the total impervious area within permitted plan was-23,422 square feet. The proposed stormwater infrastructure will capture 100% of the proposed impervious area within the 75' AEC. A stormwater permit modification is pending. The previously permitted stormwater pond is proposed to be slightly reconfigured but in the same general location. There are no new wetland impacts proposed. Hey Tara, I just dropped off a hard copy of that table earlier today. The stormwater permit modification will be submitted soon. The stormwater engineer confirmed that 100% of what is proposed will be treated in the proposed stormwater modification. This includes the new proposed impervious and the area that will be considered redevelopment over the existing impervious. These total to approximately 19,102 sf. This effectively reduces the impervious within the 75' AEC down to approximately 18%. Do you need calculations beyond that, and if so, can you specify exactly what you're looking for so we can forward it to the stormwater engineer?
