HiJonathan, I've spoken with Doug and will plan to take this across the finish line, given his current workload. It looks like you submitted a PCN to our office back in June 2023, and that permit went statutory with our office under a Nationwide Permit 29. Impacts statutorily authorized included 33 If of stream impact. The recently submitted "permit modification" would include the addition of 36 If of stream impact for roadway improvements. Considering the area proposed for the road widening is mostly forested, I can make a no effect for T&E species. Further, there are no archeological or architectural resources that would trigger Section 106 consultation. Based on the information dated November 1, 2023, and in consideration of the above referenced information, the Corps believes the proposed culvert extension along Huntersville-Concord Road qualifies for a non -notifying Nationwide Permit 14. Further, when evaluating the project cumulatively, the impacts still fall under the mitigation thresholds. You may proceed with your project as proposed, provided you obtain all required local and state certifications. Please let me know if you have any questions. Mr. Doug Perez from our office will be handling your permit application and will be in touch with any questions. Please note, we cannot issue "permit modifications" for NWPs. We will either re -verify the whole permit, which will supersede the previous verification, or we will issue a new permit specific to the additional impacts. During some recent discussions with the Town and NC DOT, they are requesting a lane widening of Huntersville-Concord Road. This impacts the Development and a culverted stream crossing under Huntersville-Concord Road. The proposed activity (modification request) includes an extension of approximately 36 LF of pipe, which will be attached to the existing culvert crossing. We worked with DOT and project partners to avoid/minimize impacts to WOTUS. This request is for SAW-2016-01916 & DWR-22-0672.
