Mitigation Project (“Project”) is a private commercial umbrella mitigation bank under the WLS Catawba 01 Umbrella Mitigation Bank (“Bank”). The site directly abuts Interstate 40 (I-40) between mile markers 133 and 135 in Conover within Catawba County, NC (35.727984, -81.176076). The Project is located within the Upper Catawba 8-digit HUC 03050101, in the Upper Lake Norman 10-digit HUC 0305010111, in the Lyle Creek Watershed 12-digit HUC 030501011102, all within the Catawba River Basin. The purpose of the Project is to provide stream mitigation credits to compensate for unavoidable impacts to Waters of the U.S. authorized under sections 401 and 404 of the Clean Water Act, Section 10 of the Rivers and Harbors Act, and all applicable state statutes. The Project is providing 9,656 warm thermal regime stream mitigation credits and 29.91 acres of easement that will be protected in perpetuity. See the mitigation plan for a detailed benefits summary and Table 1 for a summary of project assets. Figures 1a, 1b, and 1c illustrate the project mitigation components. Monitoring Year 1 (MY1) activities occurred during December 2023. This report presents the data for MY1. The Project meets the MY1 success criteria for stream horizontal and vertical stability, and vegetation. One of the three flow gauges did not meet minimum consecutive flow criteria. Based on these results, the Project is on trajectory to meet interim and final success criteria. For more information on the chronology of the project history and activity, refer to Appendix A, Table 2. Relevant project contact information is also presented in the appendices in Table 2, and project background information is presented in Appendix A, Table 3. 1.2 Monitoring Schedule and Reporting The Project will be monitored on a regular basis with physical inspections to occur a minimum of twice per year throughout the seven-year post-construction monitoring period, or until performance standards are met. The measure of stream restoration success will be documented by bankfull flows and no change in stream channel classification. The measure of vegetative success for the Project will be the survival of at least 210 seven-year-old planted trees per acre with an average height of 10 feet at the end of year seven of the monitoring period. Site inspections and monitoring reports will also identify components and features that require routine maintenance or adaptive management. The easement holder and long-term steward is Unique Places to Save (UP2S). UP2S will be responsible for annual inspection of the Project after close-out to ensure that restrictions in place required by the recorded Conservation Easement Deed are being upheld. 1.3 Project Goals and Objectives The Project will meet the goals and objectives described in the approved Final Mitigation Plan and will address general restoration goals and opportunities outlined in the North Carolina Division of Mitigation Services (DMS) Catawba River Basin Restoration Priorities (RBRP; NCEEP, 2007, amended 2013) and in the Catawba River Basin wide Water Quality Plan (NCDWQ, 2010). Watershed goals and management strategies will be met by: • Restoring aquatic habitats that are currently degraded by cattle access and bank erosion. • Improving water quality by excluding cattle. 2 • Restoring riparian buffers. • Stabilizing streams that are part of a WS-IV watershed. • Serving to continue existing water quality initiatives that are on-going in the watershed. To accomplish these project-specific goals, the following objectives will be measured to document overall project success: • Provide a floodplain connection to the incised Project stream reaches by lowering bank height ratios (BHRs) to less than 1.2, thereby promoting more natural floodplain storage and overbank flood flows, • Improve bedform diversity by increasing scour pool spacing and depth variability, • Increase native species riparian buffer and native vegetation density/composition along streambank and riparian areas, • Improve aquatic habitat and fish species diversity and migration through the addition of in-stream cover and native woody debris, • Site protection through a 29.91-acre conservation easement with minimum 50-foot riparian buffers from the top of banks along all streams in perpetuity. 1.4 Project Success Criteria The success criteria for the Project will follow approved performance standards and monitoring protocols from the final approved mitigation plan, which was developed in compliance with the USACE October 2016 Guidance, USACE Stream Mitigation Guidelines (April 2003 and October 2005), and the 2008 Compensatory Mitigation Final Rule. Cross-section and vegetation plot data will be collected in Years 0, 1, 2, 3, 5, and 7. Stream hydrology data and visual monitoring will be reported annually. Specific success criteria components and evaluation methods are described below. 1.4.1 Single-Thread Streams Stream Hydrology: Four separate bankfull or over bank events must be documented within the seven-year monitoring period, and the stream hydrology monitoring will continue until four bankfull events have been documented in separate years. Stream hydrology monitoring will be accomplished with pressure transducers installed in pools and correlating sensor depth to top of bank elevation (see Appendix E for installation diagrams). Recorded water depth above the top of bank elevation will document a bankfull event. The devices will record water depth every 30 minutes and will be inspected quarterly. In addition to the pressure transducers, visual indicators such as wrack lines and vegetation matting will be used to document bankfull events. Stream Profiles, Vertical Stability, and Floodplain Access: Stream profiles, as a measure of vertical stability and floodplain access, will be evaluated by looking at Bank Height Ratios (BHR). In addition, observed bedforms should be consistent with those observed for channels of the design stream type(s). The BHR shall not exceed 1.2 along the restored Project stream reaches. This standard only applies to restored reaches of the channel where BHRs were corrected through design and construction. Vertical stability will be evaluated with visual assessment, cross-sections and, if directed by the IRT, longitudinal profile. 3 Stream Horizontal Stability: Cross-sections will be used to evaluate horizontal stream stability. There should be minor change expected in as-built restoration cross-sections. If measurable changes do occur, they should be evaluated to determine if the changes represent a movement toward a more unstable condition (e.g., downcutting, erosion) or a movement towards increased stability (e.g., settling, vegetation establishment, deposition along the streambanks, decrease in width/depth ratio). Cross-sections shall be classified using the Rosgen Stream Classification method, and all monitored cross-sections should fall within the quantitative parameters defined for channels of the design stream type. Reference photo transects will be taken at each permanent cross-section. Lateral photos should not indicate excessive erosion or continuing degradation of the streambanks. Photographs will be taken of both streambanks at each cross-section. A survey tape stretched between the permanent cross-section monuments/pins will be centered in each of the streambank photographs and as much of the streambank as possible will be included in each photo. Photographers will attempt to consistently maintain the same area in each photo over time. Jurisdictional Stream Flow: Monitoring of stream flow will be conducted to demonstrate that the restored stream systems classified as intermittent exhibit surface flow for a minimum of 30 consecutive days throughout some portion of the year during years with normal or below normal rainfall conditions. Stream flow monitoring will be accomplished with pressure transducers installed in pools and correlating sensor depth to the downstream top of riffle elevation. If the pool water depth is at or above the top of riffle elevation, then the channel will be assumed to have surface flow (see Appendix E for installation diagrams). The devices will record water elevation twice per day and will be inspected quarterly to document surface hydrology and provide a basis for evaluating flow response to rainfall events. 1.4.2 Vegetation Vegetation monitoring will occur in the fall each required monitoring year, prior to leaf drop. Plots will be monitored in years 0, 1, 2, 3, 5, and 7. Vegetative success for the Project during the intermediate monitoring years will be based on the survival of at least 320, three-year-old planted trees per acre at the end of Year 3 of the monitoring period, and at least 260, five-year-old planted trees per acre that must average seven feet in height at the end of Year 5 of the monitoring period. The final vegetative restoration success criteria will be achieving a density of no less than 210, seven-year-old planted stems per acre that must average 10 feet in height in Year 7 of monitoring. 1.4.3 Visual Assessment WLS will conduct visual assessments in support of mitigation performance monitoring. Visual assessments of all stream reaches will be conducted twice per monitoring year with at least five months in between each site visit for each of the seven years of monitoring. Photographs will be used to visually document system performance and any areas of concern related to streambank and bed stability, condition of in- stream structures, channel migration, active headcuts, live stake mortality, invasive plant species or animal browsing, easement boundary encroachments, cattle exclusion fence damage, and general streambed conditions. Permanent photo points will be at the cross-sections and crossings. 4 2 Project Mitigation Components 2.1 Project Components The Project involved the restoration and permanent protection of nine stream reaches (S100 (North of I- 40, above crossing), S100 (North of I-40 below the crossing), S100 (South of I-40), S102, S101, S200 (North of I-40), S200 (South of I-40, above crossing), and S200 (South of I-40, below the crossing)) as shown on Figure 1. The design utilized a combination of Stream Restoration Priority I and Priority II activities, as summarized in the table below. All Year 1 monitoring data is presented in this report and in the appendices. The Project is on track for meeting stream and vegetation interim success criteria. All monitoring device locations are depicted on the CCPV (Figures 1a-1c). 3.1 Morphological Assessment Morphological data for the Year 1 Monitoring Report was collected in December of 2023. Refer to Appendices A, B, and D for summary data tables, stream photographs, and morphological data. 5 3.1.1 Stream & Longitudinal Profile and Horizontal Pattern Visual assessment was utilized for assessment of MY1 horizontal and vertical stability. The visual assessment for each stream reach documented MY1 stream channel pattern/longitudinal profiles and in- stream structure location/function still closely match the profile design parameters and MY0 baseline conditions (Appendix D). The MY1 planform geometry, or pattern, fell within acceptable ranges of the design parameters for all restored reaches. Minor channel adjustments in riffle slopes, pool depths, and pattern were observed based on natural sediment migration and stream bank vegetation establishment but do not present a stability concern. One stream problem area (SPA) was identified during December 2023 at the end of MY1. • SPA-1 – At the December 2023 site visit, WLS staff noted an area of minor rilling on the left floodplain hillslope near STA 50+50 of S200 south of I-40. This is most likely due to lower herbaceous vegetation on the hillslope and an adjacent drainage entering the easement. WLS will reseed this area and install coir wattles to slow overland flow at the beginning of MY2 and continue to monitor for any additional rilling and vegetation re-establishment. There were no issues observed with the streambanks and floodplain in this area. All water quality drainage features (WQDFs) throughout the site are functioning as intended and remain stable. Vegetation and live stakes are establishing well on all features. The minor headcut in the left floodplain of S200 just above the crossing, noted by IRT on the June 21st, 2023 site visit, also appeared stable throughout MY1.There are no other areas of concern in MY1, and WLS will continue to monitor this area and all WQDFs in MY2. 3.1.2 Stream Channel Dimension The MY1 stream channel dimensions generally match the design parameters and are within a stable range of tolerance. 23 cross-sections were installed on restoration reaches, with 13 installed in riffles and ten installed in pools. 12 of the 13 permanently installed riffle cross-sections show little to no change in BHR or bankfull area when compared to as-built measurements, and all BHRs are less than 1.2. Riffle cross- section 14, located on S200 north of I-40, has a BHR of 0.89. This BHR is due to the narrowing of the channel due to herbaceous plant establishment on the stream banks. The stream reach remains close to design parameters and pool cross-section 15, located just downstream, shows little change in BHR. It is expected that over time that some pools may accumulate fine sediment and organic matter, however, this is not an indicator of channel instability. Maximum riffle depths are expected to fluctuate slightly throughout the monitoring period as the channels adjust to the restored flow regime. 3.2 Hydrology 3.2.1 Stream Flow Three pressure transducers (flow gauges) were installed in January (FG-1 and FG-2) and March 2023 (FG- 3) in the restoration sections on reaches S101, S102, and S103 to document baseflow conditions. Two of the three flow gauges documented that the stream exhibited surface flow for a minimum of 30 consecutive days during the monitoring year. FG-1 only recorded three consecutive days of stream flow. WLS will continue to monitor in MY2 and develop an adaptive management plan if needed. See the chart below and Appendix E for flow gauge information. Additionally, to determine if rainfall amounts are normal for the given year, precipitation data was collected from an onsite rain gauge and the Oxford weather station near Claremont, NC, approximately 3.7 miles north of the Project site. Rainfall has been 6 lower than the 30th percentile for five of the past twelve months of data collected in MY1 (Table 8). The site has experienced abnormally dry conditions during the fall months (September-November 2023). During MY1, bankfull events were recorded on both pressure transducer crest gauges. CG-1 recorded eight events with a maximum event of 0.99 feet above bankfull on June 19-20th, 2023. CG-2 recorded seven events with a maximum event of 0.96 feet above bankfull on June 19-20th, 2023. The associated hydrologic data is in Appendix E, and gauge locations can be found on Figures 1a-1c. 3.3 Vegetation Monitoring of the 24 permanent vegetation plots was completed on December 6, 2023. Vegetation data can be found in Appendix C, with the associated photos located in Appendix B. The MY1 average planted density is 673 stems per acre, which exceeds the interim measure of vegetative success of at least 320 planted stems per acre at the end of the third monitoring year. Each vegetation plot currently meets success criteria with 526-931 stems per acre. Volunteer sycamore, tulip poplar, and black willow were noted in MY1, and more volunteers are expected to establish during the monitoring period. Visual assessment of vegetation outside of the monitoring plots indicates that the herbaceous vegetation is becoming well established throughout the Project. In discussion with IRT members during the As-built site visit, four permanent vegetation plots will be transitioned into mobile, random vegetation transects in MY2. Fixed plots 6, 13, 20, and 22 will transition to random plots and be placed to better monitor areas of vegetative concern such as the saturated floodplain, dense Juncus areas, and steep sloped areas on S200 north of I-40. As of MY1, all planted woody vegetation located in the saturated areas of floodplain benches is doing well, and Juncus does not appear to be suppressing vegetation growth. Privet (Ligustrum sinense) and multiflora rose (Rosa multiflora) is present in small pockets on S100 and S200 within the Project. Kudzu (Pueraria montana) is also present, predominately on S200 north of I-40. During MY1, WLS staff cut and treated privet, multiflora rose, and kudzu on 8/15/23. Additional treatments will continue to occur throughout MY2 and will be documented in future reports. 7 4 Methods Stream cross-section monitoring was conducted using a Topcon Total Station. Three-dimensional coordinates associated with cross-section data were collected in the field (NAD83 State Plane feet PIPS 3200). Morphological data was collected at 23 cross-sections. Survey data was imported into Microsoft Excel® for processing and analysis. The stage recorders include an automatic pressure transducer set in PVC piping in the channel. The elevation of the bed and top of bank at each stage recorder location was recorded to be able to document presence of water in the channel and out of bank events. Visual observations (i.e. wrack or debris lines) will also be used to document out of bank events. Vegetation success is being monitored at a total of 24 permanent vegetation plots. Vegetation plot monitoring follows the CVS-EEP Level 2 Protocol for Recording Vegetation, version 4.2 (Lee et al. 2008) and includes analysis of species composition and density of planted species. The data is processed using the NCDMS ShinyApp tool. In the field, the four corners of each plot were permanently marked with PVC at the origin and rebar at the other corners. Photos of each plot will be taken from the origin each monitoring year. Tree species and height will be recorded for each planted stem. The above morphology parameters reflect the 2018 guidance that arose from the mitigation technical workgroup consisting of DMS, the IRT and  industry mitigation providers/practitioners.  The outcome resulted in the focus on three primary morphological parameters of interest for the  purposes of tracking channel change moving forward. They are the bank height ratio using a constant As‐built bankfull area and the cross sectional  area and max depth based on each years low top of bank.  These are calculated as follows: 1 ‐Bank Height Ratio (BHR) takes the As‐built bankful area as the basis for adjusting each subsequent years bankfull elevation.  For example if the  As‐built bankfull area was 10 ft2, then the MY1 bankfull elevation would be adjusted until the calculated bankfull area within the MY1 cross section  survey = 10 ft2.  The BHR would then be calculated with the difference between the LOW top of bank (LTOB) elevation for MY1 and the thalweg  elevation for MY1 in the numerator with the difference between the MY1 bankfull elevation and the MY1 thalweg elevation in the denominator.   This same process is then carried out in each successive year. 2  ‐LTOB Area and Max depth ‐These are based on the LTOB elevation for each years survey (The same elevation used for the LTOB in the BHR  calculation).  Area below the LTOB elevation will be used and tracked for each year as above.  The difference between the LTOB elevation and the As- built (MY0) Credit Release. These comments were provided via email by Steve Kichefski on August 17, 2023. WLS is providing our written responses to the NCIRT’s review comments below. Each of the NCIRT review comments is copied below in bold text, followed by the appropriate response from WLS in regular text: Erin Davis/Steve Kichefski, USACE 1. Several floodplain benches showed saturation/standing water with potential wetland development. Closely monitor woody vegetation survival due to conditions wetter than anticipated and the potential need for supplemental planting of wetter species. We recommend changing fixed veg plots 6, 13, 20 and 22 into mobile/random veg plots to better monitor areas of vegetative concern such as the saturated floodplain, dense juncus areas and steep sloped areas on S200 north of I-40. WLS Response: WLS will transition plots 6, 13, 20, and 22 to random plots for MY2 monitoring and place them in areas of vegetative concern discussed during the as-built (MY0) site visit. 2. Please correct the mislabel of Priority I restoration for S200 on the CCPV. WLS Response: WLS has updated labeling of S200 to Priority II restoration from station 10+00 to the farm crossing at station 26+00. 3. Monitor the minor headcut in the left floodplain of S200 just above the crossing. WLS Response: WLS will monitor the drainage on S200 above the crossing and include it in the discussion of water quality treatment features in the report. This area is noted to be fully vegetated and stable at the time of the MY1 fall site-walk. 4. The thick Juncus vegetation was an IRT concern for suppressing other vegetative growth on S100 north of I-40. We recommend one of the mobile veg plots be placed in this dense juncus floodplain for the MY1 data collection. WLS Response: WLS will place a mobile vegetation plot within this area in MY2. As discussed during the as-built site visit, the existing permanent plots were monitored in MY1 to determine tree survivability from planting.
