Arnie, The project engineers (WK Dickson) have let me know that they have resolved the issue with Duke -Energy and their FERC boundary on Lake Wylie by reducing the length of the bottomless culvert barrel and adjusting the retaining wall. Connor from WKD mentioned that he was told the reviewer with Duke has informed DEQ that with these changes we do not have a conflict or issue any longer. I don't have a copy of that correspondence but if it was not you that they reached out to I can try to track that down. I've attached a full set of plans demonstrating that all phases of the project have been designed to be implemented without any impacts to jurisdictional waters of the US or State. The only impacts will be to the buffer per the attached updated plans. Please let me know if you have any questions or need anything else from me to continue processing the buffer permit request. I should be available most days next week if you'd like to connect on the phone to discuss any details. Amie, If you are able to provide the RPOT date you referenced I will let everyone know that is a hard deadline for the buffer application withdrawal, and in the meanwhile hopefully we can resolve this quickly. I'll keep you updated and also will work at providing a full plan set concurrently. It is hard to tell by the plans we received as there wasn't an overall site plan, which we would need. You can absolutely wait until Duke can provide you with feedback. However, we do have to abide by the RPOT date and would have to deny if that date approaches. I will also have to put the project ON HOLD for the state clock and the 60 day state review time would restart once the hold is removed. Please keep me updated. Amie, Thank you for your feedback and I've also received the email from Duke. I've reached out to the project engineers to get their thoughts, and I'll follow up with you. One thing that is not clear to me - I believe the existing road along the shoreline is already existing, and any new roads would be well landward of the FERC boundary. I'm hopeful that this can perhaps be resolved by having the engineering team coordinate with Duke. I would like to try to understand this a bit better with the engineers / Duke before withdrawing the application, and as such request a little time to see if this can be resolved. Duke will not allow this encroachment. I would suggest that you withdraw the application until you can resolve this issue with Duke because anything that I would issue on DWR's end would be invalid if/when you change the design of the project to meet Duke's requirements. I will need to see this for my review to ensure avoidance and minimization to the buffer for the road crossings and BMP's. If you could email those to me and I will add them to the project folder, it would be much appreciated.
