Hey Dana, Thank you for your patience, I have been waiting to wrap up my 106 consultation w/ NCSPHO and the tribes for this project. I received a response letter from the Catawba Nation today, and am still waiting on responses from INC SHPO and the Tuscarora. I think we are good for ESA, but I need to wait the 15-days required for the NLEB MA consistency letter (which would be 12/16/23). In further discussion w/ management, we will be requiring mitigation for the wetland fill. The wetlands onsite provide an important buffer/water quality function to the adjacent waters which are tidal wetlands and Outstanding Resource Waters (ORW). They are classified as Estuarine Woody Wetlands/estuarine wetland fringe and are Riparian wetlands. There are no banks available in this HUC which provide this type of wetland credit, so out of HUC and out of kind credit is all that is available to offset the impact. For these reasons, a 4:1 ratio will be applied for the unavoidable wetland impacts of 0.062-acre permanent loss. A credit reservation letter to provide 0.248-acre riparian wetland credit is required in order to continue processing the permit application. This ratio will be applied to all CWA 404 permit actions going forward which require wetland fill adjacent to/connected to tidal wetlands/ORW located in this development. One being the accuracy of the line. 1 know its old, verified back in Henry's days w/ the original permit for Cannonsgate SD development. 1 think we were last out there (in this location) in 2018, so I would like to conduct a site visit to see if the line is the same. 1 understand the topography between the uplands and wetlands is pretty obvious, so 1 would not expect the wetland footprint to expand. As per our 10/31/23 site visit, the wetland line, as drawn on the site plan, is accurate. I've been trying to track down the old permits to verify previous impacts, as there were substantial dredging impacts, a stream X-ing w/minor wetland fill, but I'm not certain of additional wetland fill with the subsequent modifications in the mid-2000's (original DCM CAMA permit no. 120-88, and Corps AID: SAW-2005-00999; original Corps AID unknown at this time). Any additional wetland impacts associated with development in the subdivision is considered cumulative. According to my research, there were no wetland impacts associated with installing any roads and/or infrastructure within the development. That being the case, the project has independent utilities and access and, therefore, meets the definition of a "single and complete project" and should not be treated cumulatively with the marina impacts or other impacts they may have taken place, to date, within the development. Please provide additional information regarding the applicant's efforts to avoid and minimize impacts to wetlands associated with the development of this site. According to Carteret County GIS, the applicant also owns two other waterfront lots within this subdivision which could be developed without impacting wetlands. Further avoidance and minimization has been incorporated into the plan. This was accomplished by positioning the structure as close to the front yard setback (i.e., 20' off the front property boundary) as possible and redesigning the back stairway (see attached 737 Cannonsgate Dr. CAMA Major Site Plan V2). This measure reduced wetland impacts by another 522 SF / 0.012 AC (i.e., from 3202 SF / 0.073 AC down to 2680 SF / 0.062 AC). As discussed during our on -site meeting, the Applicant intends to build upon other lots he owns within the subdivision. This home is intended for his daughter. Additionally, are there any additional impact drawing for the proposed development? Alternate site plans, or additional cross sections? If you could get the wetlands overlaid on an aerial with the proposed site plan, that would be helpful to me in my review. Unfortunately, there are no other site plans, for this project and SEGi is unable to overlay the plan on an aerial. Further, Mickey and 1 have had a discussion about requiring compensatory mitigation for the fill associated with the development at 737 Cannonsgate Drive. We can discuss this in more detail once 1 have received the requested additional information. While SEGi understands the USACE District Engineer has the discretion to require compensatory mitigation for impacts deemed to have more than minimal individual and cumulative adverse effects on the aquatic resource's functionality, in this case the physical, chemical and biological functions of the upper reach of a Headwater Forest, where vegetation is severely managed and sediment has been deposited during hurricane events. Completion of the NC Wetland Assessment Method (WAM) Calculator resulted in the wetland complex ranking low in functional value (see attached). Based on the WAM results, it is of SEGi's opinion the proposed fill will only remove flood storage area. The proposed project will not have an effect on flood levels, as all stormwater generated from the proposed development will be directed toward the road, where it will be collected and treated prior to discharging into the adjacent receiving water (i.e., Bogue Sound). Based on this information, SEGi and the Applicant are of the opinion compensatory mitigation is not warranted, as the proposed project will not have more than minimal individual and cumulative adverse effects on the aquatic resource's functionality. I am unable to complete my review until this information has been received and the above questions have been adequately addressed. This project has been assigned Corps action ID: SAW-2023-01896 and will be reviewed through the GP 291 process. I'm hoping we can find a time to meet onsite in the next couple of weeks. Thank you!
