Rosewood Nutrient Offset and Buffer Mitigation Bank Parcel

INTRODUCTION
The Rosewood Nutrient Offset and Buffer Mitigation Bank Parcel (Parcel) Monitoring Year 1 (MY1) report was
submitted to the North Carolina Division of Water Resources (NCDWR) on September 30, 2023. Within the MY1
report, a conservation easement encroachment was reported within a non-credit area. Wildlands Engineering
received a request from NCDWR on October 30, 2023, to be notified when the encroachment was resolved and
provide documentation on remedial actions.
ENCROACHMENT RESOLUTION
On February 23, 2023, Wildlands staff observed a pile of bricks, a fire pit, and a shooting target in the
conservation easement. Additionally, a wide path devoid of vegetation extended from Rab Trail and crossed the
conservation easement. As of June 23, 2023, the conservation easement boundary signage remained intact and
clearly visible. The encroachment area measured approximately 0.1 acres and was located within a non-credit
portion of the project. At the time of MY1 report submittal, Wildlands was in the process of gathering
information and ascertaining the best course of action. After the discovery of the responsible party, a
neighboring landowner, attempts at in person contact were initiated several times. Wildlands was unable to
reach the neighbor in -person, therefore, a letter was prepared and sent on August 30, 2023. In the follow-up
letter, Wildlands gave the neighbors a deadline of November 15th to remove any materials and cease prohibited
use of the conservation easement and stated that if the neighbors were still out of compliance, Wildlands would
remove encroaching materials and install polytape along the boundary where the incident is occurred. As of
November 18, 2023, the neighboring landowner responsible has removed all encroaching materials, and the
encroachment has been resolved. Polytape was installed around the affected Parcel conservation easement
boundaries on December 8t", 2023. Photographs of the Parcel boundaries reinforced with polytape are included
within this document as an attachment.
