Project Description and History 4a.Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The existing conditions on the project site consist of undisturbed woods and disturbed/successional areas.Phase 1 of Eagle Crest(+/-50 acres)is under construction,with two buildings already completed,immediately north of the project site.The vicinity surrounding the project area consists of primarily commercial and light industrial development.This quadrant between 1-40 and 1-440 has been identified and zones for this type of development. 4b.Have Corps permits or DWR certifications been obtained for this project(including all prior phases)in the past? The new crossing will replace this with 67 feet of 48"RCP along with 36 feet of downstream rip-rap that will be embedded in the stream bed.The road crossing will terminate with a cul-de- sac servicing Phase 3 and 4.There are no Section 404 impacts associated with Phases 3(Project Ocean)or 4.The applicant has submitted a variance request to NCDWR seeking approval to impact a riparian buffer that was placed on a non-jurisdictional drainage feature located between Phases 3 and 4.The portion of the feature being buffered was not claimed by USACE in the PJD portion of the JD site review(SAW-2020-01779).This variance request has been approved by NCDWR and is referred to as Project Ocean. No indirect impacts are anticipated from this project.The road will allow access to Phase 3 and 4;however,there are no Section 404 impacts resulting from development in Phases 3 and 4.Typical construction equipment will be utilized for the project. 5. Eagle Crest Phase 1 incurred 0.018 acre of wetland impact and was authorized with NWP 18(SAW-2020-01779)and the accompanying DWR WQC(DWR#21-0137).The 404 permit contained the following special condition: Please note that this project is considered cumulative with all current and future phases of the Eagle Crest commercial/industrial park development with respect to compensatory mitigation and Nationwide Permit thresholds.As such,impacts permitted for this project(SAW-2020-01779)are considered cumulative with impacts proposed for any future phases(conceptual plan shown on the attached Exhibit C,entitled"Conceptual Master Plan—Wetland Impacts').Current cumulative impacts to waters of the US for the Eagle Crest commercial/industrial park single and complete project include a total loss of 0.019 acre of wetlands/waters of the US.
