Good Morning
This email is a follow to the conversation that we had this morning. A site visit is scheduled for
December 5th at 9:00 AM.
1. This application is considered incomplete as it does not satisfy general condition 32 (4),(5) and
regional condition(a) of the NWP 39. All the wetlands and all impacts are not shown and/or
accounted for. There appears to be an impact for a stormwater pond in a wetland.
2. 1 have attached the NCDOT JD and the calls from DWR for the NCDOT project R-5857. These
show that the feature on site is a stream and that there is another wetland located between
the highway and the access rd. (This wetland [WM 0.1 Acres] has not been accounted for in
the impacts for this site nor is it shown on the plans). I have concerns about this wetlands
being cut off from downstream waters.
3. The impact to the stream has not been accounted for in the PCN and is shown as a ditch
impact of 0.015 acres on the plans. The impact area differs from the topo elevations shown
and acreage may need to be revisited. It appears that this impact could potentially exceed the
threshold for mitigation and will have to be mitigated for. The mitigation ratio for this impact
will depend on the determination of the quality of this stream during the site visit.
4. Currently there is a proposed 72" pipe coming into the stream that looks to be about 3 ft wide
and is not aligned with channel downstream. This does not meet the not meet condition 9 of
the NWP. I would like to see detailed drawing of this area where the pipe discharges and if
there is going to be any riprap. Please provide me with cross sections and profile view of this
area and detailed information how this is going to be stabilized. These impacts will need to be
accounted for.
5. The wetland that is in the southeast corner of the project is not accounted for in the impacts.
NWP 39 does not authorize the discharge in wetlands for stormwater management facilities.
6. There are also concerns on how this project lines up and conflicts with the NCDOT project and
their proposed pipes.
7. There is a potential that an additional wetland may be found on the site visit. On 11/15/2023 1
walked on the site to look at the stream briefly and noticed an area that potential was missed
under the original delineation. This will be determined on the upcoming schedule site visit.
8. With these additional impacts included the total number could result in more that 0.5 acres of
impacts which would push this project into an Individual Permit. The time frame of which
ranges from 4-6 months to complete.
At this time, I advise that we withdraw this application till some of these concerns can be delt with
and the JD be finalized. I you have any questions please let me know.

Thanks for taking my call today. The linked folder below contains the following:
1. PCN submittal — includes details about the NCDOT work under Project Description.
2. Supporting documentation attachments (Revised PJD, original PJD from May 2023, NCWAM
form, Wetland Data Forms, Impact Exhibits, letter to USFWS, letter to SHPO
3. SHPO concurrence letter (received yesterday after the PCN was submitted)
4. Digital Elevation Model Mapping— looks like that wetland shown on topo across Ocean Hwy
W has been ditched significantly.
5. Impact Exhibits — showing the jurisdictional ditch being piped so that it doesn't potentially
disconnect upstream aquatic resources. Also shows the proposed location of the DOT culvert
from TIP Project R-5837.
