We received your post-construction stormwater permit application for the subject project on 6/15/2023. Reviews under
the Standard permitting process can take up to 90 calendar days to complete. You can see where this project stands in
the review queue by emailing Jim Farkas (He has an autoreply set up that has the review queue on it). Please upload all

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Additional file types can be

"State Stormwater Information Uploads" section of the form. YOU MUST CLICK ON THE"ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD"TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads)will upload all of the files as the last

Wimberley Tract

Dear Mr. Pardo and Mr. Manley:
The Division of Energy, Mineral and Land Resources (DEMLR),received a Stormwater
Management Permit Application for the subject project on June 15, 2023. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. Plans
2x hard copies of revised sheets of the Application with the following corrections made:
(This item is required per 15A NCAC 02H.1042(2)(a) and per Section VI, 1 of the Application)
a. Impervious Areas
i. Sheet C2 lists impervious area data on the lefthand side of the page, but the
impervious areas for the roadway, sidewalk, total impervious, etc., conflict with
the impervious values provided elsewhere in the package. The BUA information
shown in the Application, Supplement-EZ Form, and calculations should be able to
be verified from the plans as required per Section VI, 8j of the Application.
b. The north arrow on Sheets C-12 and C-13 does not appear to correspond with the
orientation of the plans. The north arrow is required on the plans per the Application
Section VI, 8e.

c. Surface Waters
i. Please note that USGS and the NCRS Soils Map show Quewhiffle Creek crossing
the site in addition to the pond that is shown on the plans. It appears that the stream
may be shown on pages C-12 and C-13. Please add the stream to the legend or
provide a callout so that it is clearly a delineated stream. Recommend showing the
stream and wetlands on the existing conditions and site plan.Per Section VI, A of
the application and 15A NCAC 02H.1042(2)(g)(iii),please provide stream
delineation, or a note on the plans that none exist.
1. If the stream is found to be on site, please provide the required
vegetated setbacks. Vegetated setbacks for surface water are
required per 15A NCAC 02H.1003 (4). 15A NCAC 02H.1017(10)
can provide additional information on vegetated setback
requirements.
ii. Please delineate the vegetated setback from the pond shown on site, as this pond
appears as surface water on the NRCS soils map and USGS Topographic map.
This is required per 15A NCAC 02H.1017 (10).
d. Wet Pond
i. Side slopes of SCMs stabilized with vegetated cover shall be no steeper than 3:1
(horizontal to vertical)per General MDC 3. The side slopes of the main pool and
forebay listed in the cross section are 2:1 and the grading at the bottom of the
embankment appears to be 2:1 on the plan and cross section views of the detail.
Please revise these slopes or demonstrate that the soils and vegetation shall remain
stable.
ii. Per 15A NCAC 02H.1042 (h)plan details of each SCM in plan view at a scale of
one inch equal to 30 feet or larger and a cross-section view are required. Other
scales may be accepted if the scale is such that all details are legible on a copy.
1. Please provide a to scale cross-section view of the SCM.
a. Ensure that the concrete riser is to scale.
b. Recommend showing the line that the cross section is based
on in the plan view of the detail for clarity.
c. Recommend listing the elevations of the top and bottom of
the vegetated shelf in the wet pond cross section detail for
clarity. The cross section currently indicates the vegetated
shelf is below the normal pond elevation.
2. The current scale of the plan view is legible,but some components
(particularly the half foot contours) would be easier to distinguish
at a larger scale. Recommend using a larger scale and potentially
more line types and labels for the plan view of the wet pond detail
so that features can be more easily distinguished. Within the wet
pond, it is unclear if there are areas with steep grading or lines that
are not intended to be contours that are the same weight and style
as the contours.
iii. The normal pond elevation is 368.00, the top of the vegetated shelf is 368.5, there
is a 3 ft wide portion of the vegetated shelf that is not submerged. Per the Typical
Littoral Shelf Vegetation Detail, the vegetated shelf above the normal pool is
intended to be shallow land herbaceous plants, but only shallow water plants were
provided in the planting schedule.Refer to 15A NCAC 02H.1042 (2) (h)for
planting plan requirements.
e. Stormwater Maintenance Access and Easement
i. The stormwater maintenance access and easement must include the entirety of the
SCM, including the wet pond outlet, and must extend to the nearest public right-of-
way. Refer to General MDCs 8 & 9 (15A NCAC 02H.1050(8) & (9)) and Section VI,
8n of the Application. Recommend utilizing a different linetype, as it is difficult to
differentiate the easement from the pond contours on sheet SCM-1. Note that per
General MDC 8, maintenance accesses shall not include lateral or incline slopes that
exceed 3:1 and extend to the nearest public right-of-way.
The entire footprint of the SCM system must be included in the access and
maintenance easement, plus an additional ten or more feet around the SCM to provide
enough room to complete maintenance tasks. Wet ponds may require the use of large
equipment for maintenance, therefore, a width of 25 feet is recommended for
maintenance access (but not required). The SCM system includes the side slopes,
forebay, riser structure, SCM device, and basin outlet, dam embankment, outlet, and
emergency spillway. Including he maintenance easement on additional sheets,

1x hard copy of the complete, original Supplement-EZ Form is required per Sections V& VI, 3
of the Application
a. Cover, Line 9: Please revise to N/A, "No"means BUA is proposed in the setback that
does not meet requirements.
b. Drainage Areas, Additional Information: Please clarify where the impervious area
across from Lot 53 was accounted for in the BUA breakdown.
3. Calculations
Ix signed, sealed, and dated hard copy of calculations with the following corrections made:
(This item is required per Section VI, 7 of the Application)
a. Per General MDC 4, The inlet of the wet pond shall be designed to protect the SCM
from erosion resulting from stormwater discharges. Please provide engineering
calculations demonstrating this requirement is met. The rip rap apron will need to be
sized with the dimensions shown on the plans to ensure that erosion does not occur.
b. Per General MDC 4, The outlets of SCMs shall be designed so that they do not cause
erosion immediately downslope of the discharge point during the peak flow from the
10 year storm event. Please provide engineering calculations demonstrating this
requirement is met. The rip rap apron will need to be sized with the dimensions
shown on the plans to ensure that erosion does not occur.
4. Provide PDFs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.
a. PDFs must be uploaded using the form at:

Please reach out to me prior to hand delivering a submission to make sure that I
(or someone else in my group) will be able to receive the submission. Do not
leave the package in the foyer with the security guard.
NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay
the review process and the submission package may be lost while being sent from
the Regional Office to me in the Central Office.
An updated site plan (Sheet C-2), was sent to NCDEQ, however, the site plan that reflects
the wetlands that were delineated on site was not uploaded to the electronic repository,
please make sure that the electronic files are accurate and complete.
The plans call the project"Wimberly,"but other documentation uses "Wimberley Tract"
please verify the spelling of the project so that it is correct on the permit.
Sheet C-12 shows the inlet and outlet of the wet pond,but not the grading, and Sheet C-13
shows the grading, but not the inlet/outlet. Recommend having a sheet that shows both
grading and inlets/outlets.
Note that Sheet C-2 shows streets labeled Rannoch Heath Way and Crown Lane Way.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to September 1, 2023, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW6230601 on all correspondence.
If you need additional time to submit the information,please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
