I'm not sure how I over looked the 408 when I submitted this one. My apologies. We have been working on a Non -Recreation Outgrant Easement with the Jordan Lake USACE Operations staff. We are at the point now where we have discussed mitigation, and are waiting for the City to OK the mitigation proposal so the USACE and the City can sign the Memorandum of Agreement for it. Kelly Boone has been coordinating that with Michael Hosey and Shannon Maness. Let us know if you have any questions, need anything, if there's any steps we should be taking, and if we should bring Tim Quinlan in as you have suggested. Thank you. I have reviewed your application, and it appears that the project impacts the Corps' Jordan Lake 408 property which will require coordination with our USACE Wilmington District 408 Civil Works division. The Corps is currently unable to verify compliance with Nationwide Permit 58 General Condition 31 and General Condition 32 (b)(10) until Section 408 concerns are resolved. General Condition 31. Activities Affecting Structures or Works Built by the United States. If an NWP activity also requires permission from the Corps pursuant to 33 U.S.C. 408 because it will alter or temporarily or permanently occupy or use a U.S. Army Corps of Engineers (USACE) federally authorized Civil Works project (a "USACE project"), the prospective permittee must submit a pre -construction notification. See paragraph (b)(10) of general condition 32. An activity that requires section 408 permission is not authorized by NWP until the appropriate Corps office issues the section 408 permission to alter, occupy, or use the USACE project, and the district engineer issues a written NWP verification. General Condition 32 (b)(10). For an activity that requires permission from the Corps pursuant to 33 U.S.C. 408 because it will alter or temporarily or permanently occupy or use a U.S. Army Corps of Engineers federally authorized civil works project, the pre -construction notification must include a statement confirming that the project proponent has submitted a written request for section 408 permission from the Corps office having jurisdiction over that USACE project. Your project application will remain "on hold" in my review until I receive confirmation that all Section 408 coordination is complete. Please contact USACE Wilmington District Section 408 Coordinator Tim Quinlan timothy.guinlan@usace.army.mil with your complete PCN and all supporting documentation for the 408 review process.
