I tried to review both the 401 and the USACE impact tables and I'm still unclear as to why we have different
numbers. That is going to be essential to figuring out a resolution. As I said in my first response last week, I sent my
impact tables to the applicants and asked that they review that I had everything accurate and was told that they were. If
changes occurred to the design as it progressed since then and David just had more updated numbers then that would
cause our tables to be inconsistent. I'm going to need someone from the team to figure out why David and I have
different numbers and explain that tomorrow at the meeting. I suggest we focus on impact numbers, if we get those
straight then the mitigation numbers should fall into place.

Needless to say, we'd like to get this sorted ASAP. While I'm sure getting the FTO sent again this week is impossible, is
there a time this afternoon, tomorrow, or Wednesday that we could Teams meet and work out the numbers and how
the FTO gets corrected.
@Kristina Miller could you please help coordinate this meeting if its possible this week? If not, first thing next week.

Hi Colin, and my apologies for the delay. I spoke to Monte about this issue and more specifically our discussion
yesterday. He advises against signing the 15Y time out/permit until the number are rectified. The main reason is that our
Reg Chief and/or District commander may not feel comfortable counter -signing if we know about a discrepancy. I
floated the idea of the 401 being more forgiving in terms of impact allowances than the 404, but the overall idea of a
known discrepancy indicates that this should get figured out first. I'm around (though my schedule is very full) on
Monday and Tuesday of next week if you'd like to discuss prior to hearing from Sue.

There's a discrepancy in impact and mitigation numbers between the 401 detailed impact numbers (pdf page 58 and
59), and the 401 summary table mitigation numbers (pdf page 64) and subsequent 401 mitigation responsibility transfer
form (pdf page 81).
The 404 mitigation responsibility transfer forms (pdf pages 29 and 31) have a different set of impact numbers.
The detailed 401 impact numbers and the 404 impact numbers are +/- the same. The 401 summary table and transfer
forms are significantly higher.
What's the best way to address this?

Please reference the initial proffered permit (i.e. first time out letter and attachments) for this project submitted to you
yesterday. Subsequently, NCDOT requested to amend their compensatory mitigation requirement to procure stream
credits from a private mitigation bank rather than NCDMS. This requested change has been determined to be consistent
with the Corps Mitigation Rule pursuant to 33 CFR part 332. The amended initial proffered permit reflecting this change
is attached to this email. As described in my email yesterday, due to the file size of the permitted project plans, I have
provided a DoD SAFE link email containing the permitted plansheets for the Project Blue, HE-0006, and utilities project
components as well as the HDD contingency plan (referenced in Permit Special Conditions 1, 19, and 20); the above -
referenced amendment does not alter these documents, and they are still part of this initial proffered permit. Note that
hard copies of these documents will not be distributed unless specifically requested.
Please read over all of these documents carefully, and, if all appears acceptable, sign and date above the respective
"(Permittee)" lines on p. 6 of the pdf package, and send back (via email is preferred; reply all) as directed. Also note the
required payment (per 33 CFR part 325.1(f)) and associated instructions on pages 1 and 2 of the pdf package.
