April 3, 2023 Gary Beecher U.S. Army Corps of Engineers Wilmington District 69 Darlington Ave Wilmington, NC 28403 SUBJECT: Piedmont Natural Gas — Line 479 Transmission Pre -Construction Notification Additional Information Kleinfelder Project No.: 20213937.001A & 20213937.002A Dear Mr. Beecher, On behalf of Piedmont Natural Gas (PNG), Kleinfelder, Inc. respectfully submits this Preconstruction Notification (PCN) Packet under U.S. Army Corps of Engineers, Nationwide Permit 12, Oil or Natural Gas Pipeline Activities, effective March 15, 2021 (86 FR 2744) for the installation of a new natural gas pipeline in Robeson County, North Carolina. The Project proposes to install approximately 27.5 miles of 12" steel natural gas transmission, along with several small, unmanned above ground facilities as part of the PNG Line 479 Transmission Project to replace an existing line that was installed in 1959 to meet current industry standards. The Project consists of a 27.5-mile pipeline corridor that will start south of Old Allentown Road east of Lumberton, continue south and west around Lumberton and then turn northwest terminating at SR 710 north of the community of Pembroke, see Figure 1. The Project is located within the Lumber River Basin and intersects the Lumber River (Section 10 Navigable Water), Jack's Branch, Mill Branch, Jacob Swamp, Tenmile Branch, Jacob Branch, Little Jacob Branch, Holy Swamp, White Oak Branch, Moss Neck Swamp, and Bear Swamp. The proposed main pipeline and replacement line will be installed via open trenching where the pipeline will cross streams and wetlands. Portions of the proposed Project will parallel existing pipeline corridor to limit impacts and horizontal directional drilling (HDD) will be used to avoid impacts to Holy Swamp and the Lumber River. The limits of disturbance (LOD) associated with the Project consists of approximately 349.2 acres. The pipeline installation requires clearing that would result in approximately 23.254 acres of permanent conversion impacts of forested wetland to herbaceous wetland, approximately 25.167 acres of temporary impacts to forested and non -forested wetlands, and approximately 10,189 linear feet of temporary impacts to Jurisdictional ditches, ephemeral, intermittent, and perennial, streams (Figure 2). Temporary impacts include excavating an open trench, temporary dewatering, installing new pipeline, and replacing the removed fill once construction is complete. Bottom sediments removed from the streambed will be stored onsite and replaced once construction is complete. Right Solutions. To characterize site conditions, Kleinfelder scientists performed an on -site wetland and stream delineation on August 30-September 3, October 11-15, 2021, and January 10-13, 2022. The aquatic resources within the Project's LOD have been included in this permit application and preliminary jurisdictional determination request. Per Kleinfelder's on -site preliminary listed species assessment completed during the delineation fieldwork, the Project LOD was determined to potentially provide suitable habitat conditions for the red -cockaded woodpecker (Picodes borealis), wood stork (Mycteria americana), American alligator (Alligator mississippiensis), monarch butterfly (Danaus plexippus), and Michaux's sumac (Rhus michauxii). Kleinfelder determined that the Project would have "no effect" on the wood stork, American alligator, and monarch butterfly. A species survey for Michaux's sumac and a survey of potential foraging habitat for the red -cockaded woodpecker were conducted for the Michaux's sumac from October 26 to October 30, 2022. No federally listed species were observed during Kleinfelder's survey. Additionally, the potential red -cockaded woodpecker habitat had been recently logged and was no longer considered suitable habitat. Based on these observations, Kleinfelder determined that the Project would also have "no effect" on the red -cockaded woodpecker and Michaux's sumac. Kleinfelder received concurrence on February 2, 2023 from U.S. Fish and Wildlife Service (USFWS) for the determinations on species within the Project as proposed (Appendix B). Kleinfelder completed a Phase I archaeological survey of historical and cultural resources located within the Project's LOD (Appendix C). The purpose of the survey was to confirm if archaeological sites that are listed on, eligible for listing, or potentially eligible for listing on the National Register of Historic Places (NRHP) are located within the LOD. The archaeological survey was conducted between July 18 and August 9, 2022, and a second survey was conducted from September 28 to September 30, 2022, to survey reroutes of the main alignment. Four new archaeological resources were recorded within the vicinity of the LOD and two previously recorded archaeological resources within the vicinity of the LOD were relocated and revisited. One newly identified resource (31 RB654) was determined to not be eligible for listing in the NRHP but is regulated under the North Carolina statutes regarding cemeteries. Because of this, a minimum 30-foot buffer will be placed around the identified resource to avoid any impacts to it. The other five resources identified were not recommended as eligible for the National Register of Historic Places (NRHP) due to their lack of intact cultural deposits and disturbance from repeated soil turnover by agricultural equipment.
