Dear Mr. Denton,
This letter is in response to your letter dated August 4, 2023 (received on August 18, 2023) concerning the Town of
Nashville's Notice of Violation (NOV-2023-PC-0413) for our MS4 Permit. Since 2017 the Town has experienced several
position changes, including Town Manager, Finance Director, Planning Director, and Public Works Director. During these
times of positional vacancies, the Town has been unable to meet specific requirements for compliance with the MS4
program.Though the Town has struggled with its MS4 program in the past we are committed to making progress towards
compliance with all rules and regulations. Recent action items include:
• March 2023: created position for, and hired, an Environmental Programs Superintendent.
• July 2023: met with NCDEQ staff for MS 4 Audit.
• August 2023: acknowledged the shortcomings of our program and established goal dates to achieve compliance.
• September 2023: will present and adopt a council resolution declaring support for compliant MS4 program.
It is our intent to manage our Stormwater Systems in such a manner as to meet all the requirements of our permit and
address the action items detailed within your letter. We look forward to working with you and your staff as we work to
