Dear Mr. Ridings,
On behalf of Welcome Venture Park, LLC, we are requesting modification to the Buffer
Authorization received from the NCDWR on 7/31/2023. The City of Durham is requiring
additional grading to reduce the slope for a sewer easement within the right-of-way of the
Northern Durham Parkway stream crossing. Additionally, we are requesting a change in the
applicant to match the applicant on the 401 and 404 permits. The purpose of the proposed project
is construction of a road crossing and grading for a portion of the proposed Northern Durham
Parkway and to provide access to developable uplands for the Welcome Venture Park project.
The revised impacts are as noted in the following table:

The proposed Northern Durham Parkway - Phase 2 project area is ±9 acres in size and is aligned
within two parcels (PIN: 0843-09-55-1980 and 0833-98-68-0826). The Northern Durham
Parkway - Phase 2 alignment begins at Hamlin Road and runs northwest where it will terminate
at the existing railroad located southeast of Old Oxford Road and northwest of Hamlin Road in
Durham County (Lat: 36.055084°N;-78.862090°W).
The project is located in the Neuse River basin and onsite waters drain to the Eno River. The
Water Quality Classification for the Eno River is: WS-IV; NSW and the Stream Index Number is:
27-2-(19.5). The cataloging unit for the site is 030202010304.
Proposed Project
The primary purpose of the proposed project is to construct a road from existing Hamlin Road to
provide access to the Welcome Venture Park industrial park project whose impacts have been

authorized under a NWP 39 issued on 11/17/2022 (USACE AID# SAW-2021-02316) and a 401
WQC 5756 issued on 10/21/2022 (DWR# 20211128).
The proposed Northern Durham Parkway -Phase 2 will provide the primary access from Hamlin
Road to the Welcome Venture Park industrial park, including developable uplands in the northern
portion of the industrial park.
Eventually, the proposed Northern Durham Parkway - Phase 2 will be part of the future Northern
Durham Parkway, which is a component of the Durham - Chapel Hill - Carrboro Comprehensive
Transportation Plan evaluated as NCDOT State Transportation Project #U-4721.Once completed,
Northern Durham Parkway will provide an alternative route between Raleigh and Durham.
However, the City of Durham has not begun the full design of Northern Durham Parkway, nor
secured the necessary ROW needed to construct the entire roadway, which will likely take 5+
years.
Northern Durham Parkway is slated to ultimately be a 4-lane median divided road. The proposed
Northern Durham Parkway -Phase 2 has been designed as a 2-lane road as traffic for access to
Welcome Venture Park does not warrant a 4-lane median divided road. Northern Durham
Parkway -Phase 2 ROW will be dedicated as a public ROW. As such, impacts necessary to expand
this section to the ultimate 4-lane median divided road will be permitted in the future by the City
of Durham or NCDOT once the expansion is needed.
The proposed road will extend through an existing pond and wetland and cross a perennial stream.
A 10'x10' reinforced concrete box culvert (RCBC) is proposed for a single stream crossing of
Stream 1. The culvert will be installed a minimum of 12-inches below the streambed to allow for
aquatic life passage. A riprap dissipator will be constructed below the downstream end of the
culvert to dissipate energy and prevent erosion. Impacts for the culvert installation, open waters
and wetlands have been authorized under a 401 WQC issued on 7/31/2023 (DWR# 20211489
v2).
All proposed impacts are necessary for construction of the northern two lanes only. Impacts
necessary to expand to the ultimate 4-lane median divided road will be permitted separately in the
future once the expansion is needed.
Project History
WR completed a wetland delineation for the project area on 9/30/2021. WR submitted a
Preliminary Jurisdictional Determination Request to the USACE on 10/25/2021 (SAW-2021-
02316) for the Welcome Venture Park project that includes the Northern Durham Parkway
alignment. USACE sent a concurrence email on 2/10/2022 confirming concurrence with the PJD
Request.
NCDWR issued a Buffer Determination Letter (NBRRO #21-445) for the project dated 1/13/2022
which has been provided as an attachment.
NCDWR issued a 401 permit for the Welcome Venture Park project on 10/30/2022 (DWR
#20221128) and the USACE issued a 404 permit on 11/17/2022 (SAW-2021-02316) which this
portion of Northern Durham Parkway will provide access to.
WR submitted for 404 and 401 permits for Northern Durham Parkway on 3/10/2023. NCDWR
issued a 401 permit and buffer authorization on 4/11/2023.

WR submitted for an individual 404 permit on 7/27/2023 and according to the USACE, issuance
of the individual 404 is imminent.
The original Buffer Authorization has been modified twice with modified authorizations received
on 5/2/2023 and 7/31/2023.
Proposed Impacts
The Stream 1 crossing will result in 9,297 sf of permanent Zone 1 impacts and 6,562 sf of
permanent Zone 2 impacts. The total permanent riparian buffer impacts are 0.364 acres and
therefore is classified as "Allowable with Mitigation Upon Authorization" in the 2020 Neuse River
Riparian Buffer Rules (i.e., impact greater than one-third of an acre of riparian buffer).
The proposed impacts are necessary for construction of a perpendicular road crossing. The
permanent impacts will occur from installation of a 10'x10' RCBC culvert, riprap dissipator, and
grading required by the city of Durham to reduce the slopes for the existing sewer easement.
The road has been designed to cross Stream 1 perpendicularly with a reinforced concrete boxed
culvert beneath the road. The box culvert has been designed to be buried 12 inches below the
stream bed to allow for aquatic life passage.
A riprap dissipator will be installed on the downstream end of the culvert, The riprap dissipator is
necessary to prevent erosion of the stream from drainage from the adjacent land that will be
developed in the future resulting in higher flow velocity during storm events. The riprap will be
installed by burying the riprap such that the top of the riprap matches the pre -construction
contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss
of stream function.
Construction will be completed in the dry by installing temporary coffer dams and constructing a
temporary bypass swale to convey flow around the construction area. Additionally, the
construction of the culvert will be scheduled during a period with no forecasted rain.
Permanent impacts to Steam 1 buffers are necessary and unavoidable due to construction of the
proposed project. Impacts are due to grading and clearing to achieve the necessary grade for the
roadway. Authorization for impacts other than buffers has been received via a 401 permit from
NCDWR and a 404 Individual permit from the USACE is pending.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to buffers, wetlands and "waters" could be minimized.
Impacts have been minimized to only those necessary for a single road crossing to construct the
parkway and access developable uplands.
The Northern Durham Parkway - Phase 2 stream crossing has been designed to cross Stream 1 at
a perpendicular angle at a straight segment of stream channel. Additionally, wing walls will be used
to stabilize road fill at the culvert rather than traditional backslopes.
The riprap dissipator below the access road culvert will be constructed such that the riprap will be
installed by burying the riprap such that the top of the riprap matches the pre -construction
contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss
of function of stream channel.

Upon completion of construction, the temporarily impacted stream channel will be restored to
pre -construction conditions and grades, and temporarily stabilized with biodegradable matting and
seeded to provide temporary stabilization until natural regeneration of native vegetation
permanently stabilizes the stream banks. No matting will be placed on the stream bed.
The Northern Durham Parkway - Phase 2 alignment was designed to align with existing designated
alignment of Northern Durham Parkway in Durham's future transportation plan. Additionally, the
proposed alignment is necessary to avoid existing buildings and homes.
Pond 1 is not subject to the Neuse buffer rules.
Construction techniques used to avoid or minimize impacts include installation of erosion &
sediment control devices prior to construction activities and construction access occurring from
uplands.
Mitigation
The proposed road crossing will result in 15,879 sf/0.364 ac (Zone 1: 9,927 sf; Zone 2: 6,562 sf).
The crossing is classified as "Allowable with Mitigation Upon Authorization" and therefore riparian
buffer mitigation is required because the impacts total greater than one third of an acre.
The applicant proposes to provide 37,764 sf of riparian buffer mitigation as documented in the
following table:

WithersRavenel contacted mitigation banks that service the Neuse 03020201 basin within the
Falls Lake Watershed to determine availability of buffer mitigation. The applicant proposes to
provide the 37,764 sf of riparian buffer mitigation through purchase of credits from Wildlands.
The Statement of Availability from Wildlands Holdings has been provided as an attachment.
Stormwater Management Plan
Stormwater from the proposed roadway will be routed to SCM's located within the adjacent
Welcome Venture commercial development. Stormwater not captured will be conveyed as sheet
flow. The stormwater management plan for Welcome Venture development consists of five
constructed stormwater wetland SCMs and one SCM pond which provide a minimum of 30%
nitrogen removal and therefore diffuse flow is not required. The stormwater management plan
will be reviewed and approved by the City of Durham as the certified municipality.

Wildlands Holdings V, LLC, owned and operated by Wildlands Engineering, Inc., currently has sufficient riparian
buffer credits from the above -mentioned banks to satisfy the riparian buffer mitigation requirements related to
your project. The project is located within the service area (HUC 03020201), of the Banks.
This letter is simply a statement of availability of credits as of the date written. We have the inventory as shown
above, however, this letter is not a guarantee of availability as credits will be sold on a first come, first serve
basis. An invoice for this transaction will be sent upon your request and we will formally reserve both the
credits and price quoted for a period of 30-days from the invoice.
Final transfer of the credits will be made upon receipt of a copy of the 401 Water Quality Certification and
Authorization Certificate from the NC Department of Environmental Quality -Division of Water Resources
approving the Riparian Buffer mitigation purchase from the Bank and upon receipt of your payment to
Wildlands Holdings V, LLC (depending on availability at the time of permit issuance). We will then issue a credit
transfer certificate verifying your credit purchase to the North Carolina Division of Water Resources and to you
for your records.
