In response the NOV issued by the ARO on the SSO (202301509) which occurred on November
2, 2023 the Town of Burnsville provides the following information:
On August 24, 2022 the Town was issued a Letter of Intent to Fund (Project No.: SRP-W-ARP-
0143) for a project to include Improvements to the Main Sewer Interceptor (East) in the
amount of $2,153,570.00. The project includes rehabilitation of 5500 LF of 8-inch sewer line by
cured in place pipe lining and manhole rehabilitation of 40 manholes. The area where this SSO
occurred is within the project area for this intended work. To date the Engineering Report has
been approved and engineers from WithersRavenel along with camera crews were onsite this
Tuesday to inspect the project area for planned pre -inspection camera work. Construction
contracts are on schedule to be executed in the summer of 2024.
The Town is currently operating its sewer collection system under a Special Order of Consent
executed December 6, 2021. The rehabilitation of the East Sewer Interceptor and appurtenant
manholes is not a listed project under the SOC; however, the Town is committed to
rehabilitation of the collection system and therefore sought funding for this project when it
became available. This is the first SSO that has occurred since before the SOC was executed as is
indicated in my quarterly reports to the ARO.
The Town's crew wasted no time in repairing the line to minimize the total number of gallons
(5,600) spilled. The breakage leading to the spill was not intentional, but was due to a collection
of grease and debris that had backed up the line in a manhole. The spill began at 2:40 pm and
the line was completely open by 4:00 pm. There were no reported impacts to public health, fish
kills or recreational area closures. All required public notices were issued after the spill by the
Public Works Department.

In consideration of the rehabilitation work that is underway, the relatively small size of the spill,
the timely manner in which the spill was corrected and the fact that no impact to public health
was reported the Town would request that a civil penalty be waived.
