In addition to the requested information from October 2, 2023, please provide additional clarification regarding the
following impact locations:
1. The Stream and Wetland Delineation Map included with the Preliminary Jurisdictional Determination Request
does not depict a pre-existing culvert in stream SE. However, impact S1 is a 30-foot culvert replacement for a
reported pre-existing 20-foot culvert. Am I correct to assume the 20-foot pre-existing culvert is not presently
within a jurisdictional stream, but the additional 10 feet for the replacement will extend into a jurisdictional
stream?
2. Where is the 31 feet of temporary impact associated with impact S4? Is it the 31 feet immediately below the
outlet of the proposed culvert at S1?
3. Please provide additional information detailing why temporary culvert TEMP -AT (Impact S2) is needed?
4. In areas where the stream banks will be re-established, what measures will be used for erosion control and
ground stabilization while the live stakes become established?

Hello,
The United States Army Corp of Engineers (USACE) received a Preconstruction Notification (PCN) for the subject project
on Sept 8, 2023.
As the project is located within a designated Trout Watershed, the subject application is considered incomplete until
North Carolina Wildlife Resource Commission provides comments and recommendations to facilitate the determination
of any potential impacts to designated Trout Waters. Please see Regional Condition 3 of Nationwide Permit 29 for more
information.
Please see the request for additional information below:
• Plans received with the subject PCN indicated historic stream impacts associated with forestry. As the proposed use
of the historic fill is not an exempt activity, these impacts may require permitting. Please provide information such
as date of installation as well associate impact tables.
• Plans received with the subject PCN indicate phased work labeled as "Phase 2 Future Project". Will impacts to
Waters of the United States associate with fill be conducted to complete future phases? If so, please provide details
regarding these impacts and an impact table.
• Plans received with the subject PCN indicate fill associated with temporary dewatering. Please indicate the amount
and area of temporary fill to be placed and removed associated with proposed pump around impacts.
• The subject request was accompanied with a Preliminary Jurisdictional Determination Request form. This office did
not receive a map identifying the location of data points for each Wetland Determination Data Form or tributary
assessment reach. Please provide a copy of this map. This office would like to perform a field visit to observe the
aquatic resources and existing impacts. Upcoming available dates are October 111" ,October 181", November 15T, and
November 3rd . Please notify this office if one of these dates work with your schedule.
• Northern Long Eared Bat as well as Tri Colored Bat are currently listed as species with potential summer habitat
within your project area. Please answer the questions below regarding tree clearing to facility consultation with
USFWS:
1. Enter the extent of the action area (in acres) from which trees will be removed - round up to the nearest tenth
of an acre. For this question, include the entire area where tree removal will take place, even if some live or
dead trees will be left standing.
2. In what extent of the area (in acres) will trees be cut, knocked down, or trimmed during the inactive
(hibernation) season for northern long-eared bat? Note: Inactive Season dates for spring staging/fall swarming
areas can be found here: https://www.fws.gov/media/inactive-season-dates-swarming-and-staging-areas
3. In what extent of the area (in acres) will trees be cut, knocked down, or trimmed during the active (non -
hibernation) season for northern long-eared bat? Note: Inactive Season dates for spring staging/fall swarming

4. Will all potential northern long-eared bat (NLEB) roost trees (trees >_3 inches diameter at breast height, dbh) be
cut, knocked, or brought down from any portion of the action area greater than or equal to 0.1 acre? If all NLEB
roost trees will be removed from multiple areas, select 'Yes' if the cumulative extent of those areas meets or
exceeds 0.1 acre.

5. Enter the extent of the action area (in acres) from which all potential NLEB roost trees will be removed. If all
NLEB roost trees will be removed from multiple areas, entire the total extent of those areas. Round up to the
nearest tenth of an acre.
6. For the area from which all potential northern long-eared bat (NLEB) roost trees will be removed, on how many
acres (round to the nearest tenth of an acre) will trees be allowed to regrow? Enter '0' if the entire area from
which all potential NLEB roost trees are removed will be developed or otherwise converted to non -forest for the
foreseeable future.
7. Will any snags (standing dead trees) >_3 inches dbh be left standing in the area(s) in which all northern long-
eared bat roost trees will be cut, knocked down, or otherwise brought down?

8. Will all project activities by completed by April 1, 2024?
Yes or No
