Dear Mr. Snyder and Mr.McComb:
On September 26, 2023, Lily Kay from the Mooresville Regional Office of the Division of Energy, Mineral and
Land Resources (DEMLR), conducted a site inspection for the Carolina Ready Mix facility located at 1808 Valley
Parkway,Union County,North Carolina. A copy of the Compliance Inspection Report is enclosed for your review.
The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit
NCG140000 under Certificate of Coverage NCG140461. Permit coverage authorizes the discharge of stormwater
from the facility to receiving waters designated as East Fork Twelve Mile Creek,class C waters in the Catawba River
Basin.
As a result of the site inspection,the following permit conditions violations are noted:
1) Stormwater Pollution Prevention Plan(SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has not been developed or properly implemented. (Part B of
NCG140000)
2) Qualitative Monitoring
Qualitative monitoring has not been conducted and/or recorded in accordance with permit requirements. (Part D
of NCG140000)

3)Analytical Monitoring
Analytical monitoring has not been conducted and/or recorded in accordance with permit requirements. (Part E
of NCG140000)
Other Observations
As outlined in the enclosed Compliance Inspection Report, concrete waste was observed being dumped by trucks in
the back of the facility without proper controls.
Requested Response
You are asked to respond to this office,in writing,within 30 calendar days from receipt of this notice.Your written
response should include a reasonable explanation as to why the aforementioned violations have occurred as well as
a Plan of Action to prevent these violations from recurring.
Action Items
Submit a Corrective Action Plan for the site deficiencies noted in the inspection report with an approximate timeline
for the completion of the corrective actions.
Prepare and submit a Stormwater Pollution Prevention Plan to the Mooresville Regional Office to review within 60
days of receipt of this NOV.
Conduct qualitative and analytical monitoring at the next "measurable storm event" and submit the monitoring
reports to the Mooresville Regional Office to review.
Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement
to the Director of the Division of Energy,Mineral&Land Resources regarding these issues.Your above-mentioned
response to this correspondence will be considered in this process. This office requires that the violations, as
detailed above,be properly resolved. These violations and any future violations are subject to a civil penalty
assessment of up to $25,000 per day for each violation. Should you have any questions regarding these matters,
