Dear Sir:
On March 18, 2 02 1, the Division of Water Resources (DWR) received a request from you,
to appeal an on -site determination made by the Town of Morrisville as provided in Title
15A NCAC 02B .0714 (4) of the Neuse River Riparian Buffer Rules. On April 22, 2021,
Shelton Sullivan of DWR, conducted an on -site determination to review Feature B Stretch
2 on the property for applicability to the Neuse River Riparian Buffer Rules 15A NCAC
02B .0714.
According to Title 15A NCAC 02B .0714 and based on the April 22, 2021 field evaluation,
DWR has determined that Feature B Stretch 2 rates as an ephemeral stream and not subject
to the Neuse River Riparian Buffer Rules. See the below table, attached photographs, maps,
and stream form.

This determination is only for Features B Stretch 2 and replaces the determination
originally performed by the Town of Morrisville as documented in their attached
letter dated January 19, 2021 for Feature B Stretch 2. This determination shall
expire five years from the date of this letter.

This Determination can be contested as provided in Chapter 150B of the North Carolina
General Statutes by filing a Petition for a Contested Case Hearing (Petition) with the North
Carolina Office of Administrative Hearings (OAH) within sixty (60) calendar days.
Requirements for filing a Petition are set forth in Chapter 150B of the North Carolina
General Statutes and Title 26 of the North Carolina Administrative Code. Additional
information regarding requirements for filing a Petition and Petition forms may be
accessed at http://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-
3000.
One (1) copy of the Petition must also be served to the North Carolina Department of
Environmental Quality:

This letter only addresses the applicability to the buffer rules on the subject property and
does not approve any activity within any riparian buffers. Nor does this letter approve any
activity within waters of the of the State or waters of the United States, which include
wetlands. Any activities along these features may require 404/401 permits and
certifications. Any inquiries regarding applicability to Section 404 of the Clean Water Act
should be directed to the US Army Corps of Engineers Raleigh Regulatory Field Office at

Dear Mr. White:
On Thursday, January 7, 2021, the Town of Morrisville conducted an on -site investigation to review the
potential streams located on/adjacent to the subject property for applicability to the Town of Morrisville
Unified Development Ordinance (UDO), Section 6: Riparian Buffers. The streams are labeled as "Feature A"
and "Feature B" on the attached USGS and USDA Soils map.
Staff certified to determine stream origin points per the North Carolina Department of Environment Quality
(NC DEQ) Division of Water Quality (DWQ) Surface Water Identification Training and Certification (SWITC)
observed the features in question.
The Town of Morrisville has determined that the stream labeled as "Feature A" on the attached map is at least
intermittent and is subject to the 50' Buffer Rule. It was also determined that sections of the stream labeled
"Feature B" are at least intermittent and are subject to the 50' Buffer Rule, while other sections are not at least
intermittent, and are not subject to the 50' Buffer Rule.

checked "Not Subject" has been determined not to be a stream or is not present on the property. Features that
are checked "Subject" have been located on the property and possess characteristics that qualify it to be a
stream. There may be other streams located on your property that do not show up on the maps referenced
above, but still may be considered jurisdictional according to the US Army Corps of Engineers and/or to the

This on -site determination shall expire five (5) years from the date of this letter. Landowners
or affected parties that dispute a determination made by the DWR or Delegated Local Authority
may request a determination by the Director. An appeal request must be made within sixty (60)
days of date of this letter or from the date the affected party (including downstream and/or
adjacent owners) is notified of this letter. A request for a determination by the Director shall
be referred to the Director in writing to the DWR 401 & Buffer Permitting Unit, 1650 Mail
Service Center, Raleigh, NC 27699-1650.
If you dispute the Director's determination you may file a petition for an administrative
hearing. You must file the petition with the Office of Administrative Hearings within sixty (60)
days of the receipt of this notice of decision. A petition is considered filed when it is received in
the Office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:0o am and 5:00 pm,
except for official state holidays. To request a hearing, send the original and one (1) copy of the
petition to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-
6714. The petition may also be faxed to the attention of the Office of Administrative Hearings at
(919) 733-3478, provided the original and one (1) copy of the document is received by the Office
of Administrative Hearings within five (5) days following the date of the fax transmission. A
copy of the petition must also be served to the Department of Natural Resources, c/o Mary
Penny Thompson, General Counsel, 1601 Mail Service Center, Raleigh, NC 27699-1601.
This determination is final and binding unless, as detailed above, you ask for a hearing or
appeal within sixty (60) days.
The owner/future owners should notify the Division of Water Resources (including any other
Local, State, and Federal Agencies) of this decision concerning any future correspondences
regarding the subject property (stated above). This project may require a Section 4041401
Permit for the proposed activity. Any inquiries should be directed to the Division of Water
Resources (Central Office) at (919)-807-6301, and the US Army Corp of Engineers (Raleigh
Regulatory Field Office) at (919)-554-4884•
