Since it may be an attachment issue, I have copy/pasted the language in this email below: Hi Jonathan, I spoke with Stephanie regarding your stormwater and bank stabilization projects. Please see our response below: 9 Site #5: o It appears that this would fit under existing us%xisting stormwater conveyance and as long as you stay within the existing footprint, you would not need a buffer authorization from DWR. o As long as you do not trigger any of the thresholds in the corresponding GC4239 for the NWP3, mainly staying under the 40 linear feet impact (Item b), then you should be covered by the GC and not need written 401 authorization from DWR. o Please make sure to include information about this site in your PCN application for Site #6 if you plan to do the work at the some time to help the review understand the impacts (design, non -notifying, etc.) • Site #6: o It appears that this one would need written buffer authorization from DWR for the bank stabilization/protection of existing structures (15A NCAC 028.0714(11)(s)& (dd)) and a NWP13 corresponding 401 for the stream relocation/restoration portions of the project. o Please make sure to include information about Site #5 in your PCN application (design, non -notifying, etc.) • We can consider your pre file notification date in April when you first notified Stephanie/me via email. Please make sure to send a notification email to the 401PreFile@deg.nc.gov to meet the requirement and include a copy as part of your application. I wanted to let you know that I submitted a pre -filing notification (attached) in case our correspondence from back in April cannot cover that requirement. Additionally, I was curious if you had a chance to catch up with Stephanie to confirm if Site 5 might be appropriate for construction without notification. As discussed, the stream impacts should be below 40 LF, and is largely focused on rehabilitation of an existing stormwater conveyance. We plan to submit a PCN for the 404/401/buffer authorization covering site 6, but will likely bid and construct both sites together. We look forward to hearing your thoughts. I wanted to follow up regarding a project we discussed with you and Stephanie via email back in April. I have attached that older correspondence for reference. As part of that project, the Town of Wake Forest had originally identified five existing outfall locations to be improved (sites #1- #5) and one segment of stream requiring restoration (site #6). At this time, we are planning to pause the design for sites 1-4 and are moving forward with 5 and 6 only. We are working to expedite our design schedule, and have been talking with Dicky Harmon (USACE) about the best way to permit these sites. Below is a quick summary of each: • Site #5 is located in the backyard of 1301 Clatter Ave. and is an approximately 50LF long ephemeral tributary requiring reconstruction along with drainage outfall improvements. The tributary receives flow from three dual -grate reverse flow inlets. o The existing dual -grate structures, sections of existing pipe connecting the structures, and the existing riprap lined channel will be removed and replaced with a modified regenerative step pool storm conveyance (RSPSC). o Nationwide Permit 3 — Below the threshold for notification Site #6 is located in the backyard of 922 Jones Wynd and is an approximately 220LF long, perennial stream, requiring minor relocation and comprehensive bank stabilization. Site 6 is located <300 feet downstream of proposed work at Site #5. o The primary objective at site #6 is to restore the stream segment into a stabilized and healthy state and in doing so will mitigate homeowner concerns as the stream migrates. As evident in the attached pictures, the bank erosion is rapidly approaching the home's foundation and support columns for the rear deck. Due to the safety concerns and potential loss of property, Site #6 has become the highest priority for the town, and has been put on an expedited design schedule. o Nationwide Permit 13 Based on initial conversations with Dicky, it sounds like he would only expect submission of a 404 application for Site 6. However, I would like to talk with you about the expectations for the 401 permit and buffer authorization. I am wondering if the impacts would be considered "allowable" and if any kind of permit submission would be required. If authorization is required, I want to discuss how to handle that with the two sites combined. Would you be available for a quick call in the next day or two?
