Regarding your condition related to item #6, a stream assessment documenting existing conditions and post -
construction conditions one year following completion of development can be provided. The assessment will include
the DWR stream evaluation form completion with photo documentation of the upper reaches of T-4 to ensure that the
feature continues to function minimally as a Class C waters of the state. This data can be submitted as designated by
your office, or can be kept on file and provided upon request.

Thank you for the response to the items requested below. The Division has reviewed the response and found the
responses to be adequate with the exception of Item #6. Please provide the additional information requested below

1. It is DWR staff experience that regardless of the history of the formation of an intermittent stream, surface
hydrology, which supports shall groundwater levels, is essential to maintaining existing functions and uses in
intermittent streams within the piedmont ecoregion. Upon review of your response to Item #6, the Division's
original concern has not been adequately addressed. Please provide a response that satisfies one of the
options previously requested: "Please either include indirect impacts to Tributary 4 within the impact table
and provide mitigation for this section, provide hydrologic calculations to document that surface flow will
continue to support the existing function of Tributary 4, or provide a monitoring plan that will document
existing conditions of Tributary 4 and post construction conditions." If it is your professional opinion that a loss
of function is not likely to occur in Tributary 4 then you may want to consider proposing a monitoring plan to
document existing and post construction conditions in Tributary 4.

Krysta, We received the provisional approval that you issued for this project via email. (SAW-2022-01214 Greenbriar
Ridge).
In response to DWR comments, the attached additional information including impact drawings and impact tables
reflects an additional 24 If of temporary stream impact (0.002 ac) to Tributary 1 to accommodate temporary pump -
around to ensure construction "in -the -dry" conditions for the installation of the road crossing culverts.

Hello Perry,
I have been assigned the review the above noted project. I have a few items that require some additional information
in order for me to complete the review and issue a 401. Please respond to this email within 30 days. Please note that
the application will be considered on hold until receipt of a complete response.
1. Please confirm that a riprap dissipator will not be required by the local government or appropriate S&EC review
entity or revise the project impacts and plan sheets accordingly. It is the Division's experience that energy
dissipation is required by these agencies.
2. The project proposes utility impacts that are offsite. The offsite impacts do not appear to be within the limits
that were verified by the USACE. Please clarify whether the USACE has provided verification or confirmation of
the offsite features.
3. Please provide plan sheets that show that the stream channel will not be widened above and below the storm
culvert in accordance with standard 401 requirement: Culverts shall be designed and installed in such a manner
that the original stream profiles are not altered and allow for aquatic life movement during low flows. The
dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by
widening the stream channel or by reducing the depth of the stream in connection with the construction
activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical
low flow and spring flow without adversely altering flow velocity. If the width of the culvert is wider than the
stream channel, the culvert shall include multiple boxes/pipes, baffles, benches and/or sills to maintain the
natural width of the stream channel. If multiple culverts/pipes/barrels are used, low flows shall be
accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they receive only
flows above bankfull.
4. Please note that all work must be done "in the dry'. Therefore, dewatering methods will be necessary to
temporarily dewater the stream channel during culvert installation and during utility line installation. Please
provide a construction sequence and dewatering details that show that dewatering is to be utilized at the site
and the sequence of construction events to be followed to ensure compliance with this condition. In addition,
please ensure that the location of the temporary impacts are shown on the construction drawings and clearly
indicated in the revised impact table.
5. Please provide a stream restoration detail for the utility line installation stream impact locations and a wetland
restoration detail for utility line installation wetland impact locations.
6. Pursuant to 15A NCAC 02H.0506(b) "a 401 Water Quality Certification may only be issued upon determining that
the proposed activity will comply with state water quality standards which includes designated uses, numeric
criteria, narrative criteria and the state's antidegradation policy, as defined in rules of 15A NCAC 02B .0200... In
assessing whether the proposed activity will comply with water quality standards, the Division shall evaluate if
the proposed activity: (2) would cause or contribute to a violation of water quality standards; (3) would result
in secondary or cumulative impacts that cause or contribute to, or will cause or contribute to, a violation of
water quality standards;" Based on the current proposed plan the Division believes there is potential for
indirect impacts to Tributary 4 as all surface flow to this channel appears to be routed to two SCMs which
would discharge at the lower end of the project boundary. Please either, include indirect impacts to Tributary
4 within the impact table and provide mitigation for this section, provide hydrologic calculations to document
that surface flow will continue to support the existing function of Tributary 4, or provide a monitoring plan that
will document existing conditions of Tributary 4 and post construction conditions.
7. Sheet 8 of 12 appears to show a proposed greenway crossing over Tributary 1. Please clarify if there will be
additional impacts as a result of the greenway at this location.
8. Sheet 10 of 12 shows a proposed water line location within the limits of the Top of Bank of Tributary
7. Standard 401 certification conditions require that: Any utility construction corridor that is parallel to a
stream or open water shall not be closer than 10 feet to the top of bank or ordinary high-water mark.
