USACE Project ID; SAW-2023-01011 Application Review Comments: -Mitigation Requirement-: Wetland impacts over .10 -acres will require mitigation. (c) Compensatory mitigation at a minimum one -for -one ratio will be required for all wetland losses that exceed 1/10-acre and require pre - construction notification. (page 8 of the NWP 39 guidance Document) I use a standard 2:1 ratio for permanent wetland impacts (regardless of quality). We're aware of the mitigation requirements and I believe have provided the appropriate documentation indicating that. But let me know if additional information is needed. Attached is the Statement of Availability provided by the WLS Turtle Creek Mitigation Bank, which was included in the PCN, indicating expressed interest to utilize 0.30 Riparian Wetland Mitigation Credits. I've attached photos depicting representative site and feature conditions. At some point in the past, the site was cleared and graded. Wetland Area #1 and the northern fork of Wetland Area #2 are manmade ditches that capture/convey stormwater. Wetland Area 1 is only present due to the development of the property located immediately north of the subject property. Per the County's request to provide means for ingress/egress between the subject property and the property located immediately north of the subject property, Wetland Impacts A, B and C at Wetland Area #1 are unavoidable. Proposed Wetland Impacts A & C are necessary and are proposed to be filled and graded for road construction. A pipe is depicted at the eastern -most County -required road crossings of Wetland Area 1, which is labeled Wetland Impact B. Based on existing site conditions, if there is a means of reducing the mitigation ratio below a 2:1 ratio, I know our Client would be very appreciative. -How does filling of these wetlands affect upstream areas - This wetland/stream system takes water/hydrology from property above it (see lidar map) Will filling these aquatic features not effect the property above this one? Based on the small size of the drainage area up reach from the subject property, no. The Corps will not issue a permit if we know that the fill may back up water on a neighbor above the project. Wetland Area #1 does not extend further west, and Wetland Impacts A & C (circled below) represent the western limits of Wetland Area #1. Therefore, fill proposed at the locations of Wetland Impacts A & C will not influence hydrology on the neighboring property. The full extent of Stream 1 and Wetland Area 2 (including the northern fork) are proposed to be piped, thus, allowing water from the property to the west to continue being conveyed east. An existing crossing of the Wetland 2/Stream 1 complex is present onsite and does not appear to have any negative influence on the movement of water deriving from the property to the west. The proposed pipe will be sized appropriately and installed to accommodate safe passage of aquatic life. WETLANDS WETLAND IMPACT SAND FILTER LEVEL SPREADER VEGETATED FILTER -51--- Ex. Will the stream and wetlands both be filled? I don't know which areas will be filled and which will be left. Please send in a more detailed plan that accurately shows which aquatic features will be filled. Everything depicted as blue in the Impacts Exhibit is proposed to be filled and/or piped. The "LOT 2 WETLANDS MAP" more clearly depicts the stream vs. wetland areas. I've also attached the site layout and grading/sediment and erosion control plans. If still needed, I will work with the client on generating a revised impacts drawing that more clearly depicts the impacts. Just let me know. Is the stream going to be piped? There's what looks like a 24" storm pipe going through the stream? The full extent of Stream 1 depicted in the attached "LOT 2 WETLANDS MAP" will be piped. There is an existing 24" pipe that measures 41 linear feet. The 41 linear feet should have been accounted for as temporary impact in the PCN for disturbance associated with replacing that portion of pipe, but it wasn't, and I apologize. The revised proposed stream impact totals should, therefore, be 41 linear feet of temporary impact and 284 linear feet of permanent impact. -N LF B- I've requested in IPAC to be a member of this project, you may have already gotten a message from the IPAC system. There are only a handful of mature trees on the property, none of which have cavities, sloughing bark, or deeply furrowed bark. Representative site photos are attached. This application is not complete due to the inadequate plan and lack of mitigation proposal. The Corps may send additional comments for this application.
