If a change in the authorized work is necessary, you should promptly submit revised plans to the Corps showing the proposed changes. All pages of both copies of the signed permit with drawings should then be returned to this office for final authorization. A self-addressed envelope is enclosed for your convenience. Title 33, Part 325.1(f), of the Code of Federal Regulations reads, in part, that, "A $10 fee will be charged for permit applications when the work is noncommercial in nature and provides personal benefits that have no connection with a commercial enterprise...", and "A fee of $100 will be charged for permit applications when the planned or ultimate purpose of the project is commercial or industrial in nature and is in support of operations that charge for the production, distribution, or sale of goods or services." As your application fits the second category, you are requested to remit your check for $100, made payable to the Finance and Accounting Officer, USAED, Wilmington. The term "this office" refers to the appropriate district or division office of the Corps of Engineers having jurisdiction over the permitted activity or the appropriate official of the office acting under the authority of thecommandingofficer. You are authorized to perform work in the accordance with the terms and conditions specified below. Project Description: The proposed project involves the discharge of fill material into Waters of the US (WoUS) to support the disposal of coal ash at two locations owned by the applicant, Green Meadow, LLC; the Brickhaven Mine (including an adjacent property owned by Moncure Holdings, LLC) and the Sanford Mine (also known as the Colon Mine). The coal ash will be used as the primary reclamation material for the mined areas of the Brickhaven and Sanford Mines. Green Meadow also plans on expanding the already mined areas at the Brickhaven and Sanford Mines in order to accept more coal ash for permanent storage. Coal ash will be transported by truck and rail to the two mines, where it will be placed into lined cells, filled to grade, and capped with an interim soil cover. At the Brickhaven Mine the grading, filling, and associated infi•astructure to prepare the site for the coal ash fill would encompass approximately 166 acres, of which approxhnately 145 acres will be covered with a composite base -liner system and filled with coal ash. Five individual cells would make up the total 145 -acre fill area. At the Sanford Mine, the grading, filling, and associated infi•astructure to prepare the site for the coal ash fill would encompass approximately 137 acres, of which approximately 118 acres would be covered with a composite base -liner system. Five individual cells would make up the total 118 -acre fill area. In order to construct the project as needed, approximately 4,256 linear feet (If) of stream channel, and 1.162 acres of wetlands will be filled and/or impacted. Specifically, the project involves the installation of culverts in the stream channels and the necessary amount of clean fill material discharged into the stream channels and wetlands to prepare the site for the installation of the clay and geosynthetic liners to construct the cells for coal ash disposal. This includes 1,716 linear feet of jurisdictional stream and 1.1 acres of jurisdictional wetlands at the Sanford Mine and 2,540 linear feet of jurisdictional stream and 0.052 acre of jurisdictional wetlands at the Brickhaven Mine. Mitigation is required for this project. Project Location: The Brickhaven mine is located off Moncure-Flatwood Road, approximately 2 miles east of Moncure, in Chatham County, North Carolina. In general, the Brickhaven Mine is bordered to the north by an unnamed dirt road, the south and east by Moncure-Flatwood Road, and to the west by Corinth Road. In addition, there is a proposed railroad spur that would be constructed along an established easement on a tract of land adjacent to the Brickhaven Mine, owned by Moncure Holdings, LLC. The Sanford (Colon) mine site is located off of Brickyard Road, approximately 1 mile northeast of Sanford, in Lee County, North Carolina. In general, the Sanford Mine is bordered to the north by an unnamed tributary to Roberts Creek, the south and east by an existing CSX and Norfolk Southern rail lines, and to the west by Colon Road. Shaddox Creek is the nearest named waterway for the Brickhaven Mine and Roberts Creek is the nearest named ENG FORM 1721, Nov 86 EDITION OF SEP 82 IS OBSOLETE. (33 CFR 325 (Appendix A)) waterway for the Sanford Mine. These two streams are classified as relatively permanent waters and ultimately drain to the Cape Fear River. Both projects are within the Cape Fear River Basin (8 -Digit Cataloging Units 03030004 and 03030002, respectively). There are several non -isolated jurisdictional wetlands on the properties; some isolated wetlands (not subject to Section 404 of the Clean Water Act), as well as several streams and open waters associated with the proposed mining reclamation activities. LATITUDE & LONGITUDE: Latitude North: 35.59814; Longitude West: -79.021925 (Brickhaven Mine) Latitude North: 35.53688; Longitude West: -79.144720 (Sanford Mine) Permit Conditions: General Conditions: 1. The time limit for completing the work authorized ends on December 31, 2019. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached. 2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area. 3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. 4. If you sell the property associated with this permit, you must obtain the signature of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization. 5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions. 6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit. Congressional Authorities: You have been authorized to undertake the activity described above pursuant to: ( ) Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403). Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following: a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or fi-om natural causes. b. Damages to the permitted project or uses thereof as a result of current or future activities undertaken by or on behalf of the United States in the public interest. c. Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity authorized by this permit. d. Design or construction deficiencies associated with the permitted work. e. Damage claims associated with any future modification, suspension, or revocation of this permit. 4. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided. 5. Reevaluation of Permit Decision. This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and conditions of this permit. b. The information provided by you in support of your permit application proves to have been false, incomplete, or inaccurate (See 4 above). c. Significant new information surfaces which this office did not consider in reaching the original public interest decision. Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the issuance of an administrative order requiring you to comply with the terms and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any corrective measures ordered by this office, and if you fail to comply with such directive, this office may in certain situations (such as those specified in 33 CFR 209.170) accomplish the corrective measures by contract or otherwise and bill you for the cost. 6. Extensions. General condition 1 establishes a time limit for the completion of the activity authorized by this permit.
