Specifically, permanent stream, wetland, buffer, and temporary wetland impacts have been reduced. Temporary stream and buffer impacts have increased. Therefore, modification of the previous 404/401/Buffer permits is necessary. NWP 29 PCN Permit Modification Request The total currently proposed permanent impacts to jurisdictional waters are 0.229 acres (see table below) and therefore the project is eligible for authorization under an NWP 29. The proposed River Towne subdivision consists of four parcels (PINS: 1756421236, 175641190, 1756410428, 1756309588) located at 8301 Buffaloe Road in Knightdale, Wake County (Lat: 35.843044°N;-78.479931°W). The project site is ±307 acres. The project is in the Neuse River basin (HUC: 03020201) and onsite waters drain to Hodges Mill Creek. The Water Quality Classification for Hodges Mill Creek is: Class C; NSW and the Stream Index Number is: 27-26-1-(2). Proiect History WithersRavenel (WR) conducted a delineation of the wetlands, streams, and riparian buffers in January 2021. WR received a concurrence letter from the USFWS on January 3, 2022. USFWS indicated the proposed project was not likely to adversely affect any federally listed endangered or threatened species, their formally designated habitat, or species currently proposed for listing. An emailed concurrence letter was received from the USACE on January 4, 2022. See attached concurrence letter and delineation exhibit. NC DWR issued a Neuse River Riparian Buffer Determination Letter (NBRRO # 21-247) on August 27, 2021, which has been provided as an attachment. In April 2021, WR submitted a SHPO request review for the site. It was noted that multiple structures were present within the project area. Additionally, a gravesite was found within the eastern portion of parcel 1. The project is planned to be designed around the gravesite. SHPO issued a comment letter on June 11, 2021, that mentioned a 2013 survey which uncovered six archaeological sites and the Watkins Cemetery in the project area. SHPO did not recommend any further work for the archeological sites. However, the cemeteries are protected under state law. Since the Watkins Cemetery contains additional gravesites marked with fieldstones and due to the possibility for unmarked graves, SHPO recommended an archaeological delineation of the cemetery be conducted. Terracon Consultants coordinated with SHPO to establish the survey area and protocol and then conducted a Phase 1 archeological survey for the project and identified 7 new archeological sites. In a letter dated September 9, 2022, SHPO agreed with Terracon's recommendation that the sites should not be considered eligible for listing in the NRHP. Your Success- NWP 29 PCN Permit Modification Request Therefore, the proposed project will not result in impacts to archeological, historic or cultural resources. The SHPO final comment letter has been provided as an attachment. WR submitted a PCN on 11/22/2022 for a NWP 29 and associated 401 WQC. A 401 WQC and Buffer Authorization was received on 2/2/2023 and an NWP 29 404 (statutory approval) was received on 5/26/2023. The previously issued permits have been included as attachments. Site optimization around proposed impacts found that some permanent impacts could be eliminated or made to be temporary. Permanent stream impacts have been reduced by .0004 ac/53 If (Functional Loss: 0.003 ac/44 If; No Functional Loss: 0.001 ac/9 If). Permanent wetland impacts have been reduced substantially by 0.047 ac. Temporary wetland impacts have decreased by 0.123 acres and temporary stream impacts have increased by 0.017 acres (150 If). Additionally, permanent buffer impacts have been reduced from those previously approved by 21,817 sf (Zone 1: 5,919 sf; Zone 2: 15,898 sf). Temporary buffer impacts have increased by 6,903 sf. The purpose of the proposed project will consist of the construction of a mixed density residential development and associated infrastructure in 7 phases to meet the existing and growing demand for residential housing in Wake County. The project is being phased; however, impacts for all phases are being requested at this time. The project consists of the construction of the following: • 1,017 total lots • 437 single-family detached home units • 545 townhome units • 35 open space/HOA lots • 117 acres of open space • Construction of infrastructure (roads, greenways, parking (bicycle, car), utilities, stormwater management, etc.) The proposed design for the roads will result in two stream crossings. "Street S" will cross Stream 6 perpendicularly with a culvert. "Street P" will connect to Buffaloe Road by crossing Stream 2. Riprap dissipators will be constructed below the culverts to dissipate flow velocity to prevent erosion and sedimentation of the streams. Additional impacts are proposed for one greenway trail crossing, a wetland impact for site grading, required widening of Buffaloe Road, onsite sewer line installation, and offsite water and sewer force main extensions. The internal gravity sewer will be installed using conventional open trenching methodology. Temporary impacts for internal sewer lines are proposed for one stream crossing and wetland conversion impacts. Page 4 of 11 River Towne Knightdale, Wake Co. NWP 29 PCN Permit Modification Request • 89,079 sf of permanent riparian buffer impacts (Zone 1: 37,664 sf; Zone 2: 51,415 sf) • 8,829 sf of temporary buffer impacts (Zone 1: 6,646 sf; Zone 2: 2,183 sf) Proposed permanent stream impacts are necessary for the installation of two road crossings. Temporary stream impacts are also proposed for rip rap dissipators and construction/dewatering at the crossings. Additional temporary stream and wetland impacts are proposed for installation of sewer and water utilities, and greenway trail. "Street S" will cross Stream 6 perpendicularly with a culvert. "Street P" will connect to Buffaloe Road by crossing Stream 2 perpendicularly. The 42" RCP culvert under "Street S" is proposed to be buried 10.5" and the 54" RCP culvert under "Street P" will be buried 12" below the stream bed to allow for aquatic life passage. Riprap dissipators will be installed below the culverts to prevent erosion and sedimentation of downstream waters. The riprap will be installed by burying the riprap such that the top of the riprap matches the pre -construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of stream function. Permanent wetland impacts are necessary at both road crossings, a short segment of greenway trail where the trail crosses Stream 3 and Wetland M, and site grading impacting Wetland G. Temporary wetland impacts are proposed for a portion of a boardwalk crossing and installation of sewer and water utilities. Offsite sewer force main and water line installation along Old Crews Road and Buffaloe will result in temporary wetland impacts; however, the lines will be installed in the existing cleared right of way adjacent to the roads. The remainder of the temporary wetland impacts are those for sewer line installation (permanent conversion impacts). Permanent buffer impacts are proposed for five SCM outfalls, the two road crossings mentioned previously, one greenway boardwalk/trail crossing, and installation of sewer and water utility lines. Both perpendicular and non -perpendicular permanent impacts for utilities are proposed. Some temporary buffer impacts are necessary for road crossings and for the installation of sewer and water lines within the existing and cleared right of way along Old Crews Road and Buffaloe Road. Additionally, 1,071 sf of temporary buffer impacts are proposed for construction easement areas to install utilities. The installation of the onsite utilities (sewer & water) will be installed using traditional methods and all stream and wetland impacts associated with the installation of the utilities will be temporary. Some unavoidable impacts to buffers will result from utility installation. The utility easements will be mowed/maintained through the wetlands and buffers in perpetuity, resulting in 0.422 acres of permanent wetland conversion impacts and 51,468 sf of permanent buffer impacts. After construction of the sewer lines, the entire permanent 30' sewer easement through wetlands will be mowed/maintained in perpetuity, resulting in 0.422 ac of permanent wetland conversion impacts as noted in the table below. Upon completion of construction, all temporarily impacted streams and buffers will be restored to pre -construction contours and the banks will be stabilized using a biodegradable matting and seeded with a riparian seed mix. No matting will be placed on the stream beds. Additionally, all temporarily impacted wetlands will be restored to natural grade and seeded with a wetland seed mix to provide temporary stabilization until natural revegetation permanently stabilizes these areas. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. An optimization in the proposed site design has resulted in an overall reduction of permanent impacts previously approved. Proposed permanent impacts for construction of the subdivision and infrastructure have been minimized to only those necessary for construction of two road crossings to access developable uplands within the site and create connectivity to existing roads, utility installation, a single greenway crossing, and SCM outfalls. There are no impacts proposed for construction of lots. All road crossings have been designed to cross streams perpendicularly to minimize impacts to streams and riparian buffers. The use of retaining walls have been maximized to minimize impacts. Riprap dissipators will be constructed at road crossings such that the riprap will be installed by burying the riprap such that the top of the riprap matches the pre -construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of function of stream channel. Upon completion of construction, all temporarily impacted streams will be restored to pre - construction conditions and grades, and temporarily stabilized with biodegradable matting and buffers will be seeded with a riparian seed mix. NWP 29 PCN Permit Modification Request The internal gravity sewer was designed to minimize impacts to wetlands and stream by locating the sewer line within uplands and roads where possible. Where wetland and stream crossings could not be avoided, the alignments have been designed to cross wetlands, streams, and buffers perpendicularly to the extent possible. Impacts to riparian buffers have been minimized to the greatest extent possible. The proposed riparian buffer impacts will occur from construction of the road crossings, required road widening, utilities and SCM outlets. Sewer line construction has been designed to minimize Zone 1 impacts wherever possible. Buffer impacts for the sewer lines could not be entirely avoided due to topography and the need to install gravity sewer. All proposed riparian buffer impacts are for uses classified as "deemed allowable", "allowable upon authorization" or "allowable with mitigation" in the Neuse River Riparian Buffer Rules' Table of Uses. Access during construction will occur within uplands. Additionally, sediment and erosion control measures will be installed prior to construction. Mitigation Stream Mitigation The redesign of the Stream S road crossing (Impact Map C) has resulted in the currently proposed permanent stream impacts with functional loss being less than 0.02 acres therefore the applicant does not propose stream mitigation. WithersRavenel contacted mitigation banks that service the Neuse 03020201 basin to determine availability of wetland mitigation credits. A Statement of Availability letter from RES for 0.844 acres of wetland mitigation has been provided as an attachment. Buffer Mitigation There are three buffer impacts which are "allowable with mitigation upon authorization." The impacts are B11 B12, and B27 all of which are non -perpendicular sewer line impacts where mitigation is required for Zone 1 impacts. Permanent buffer impacts B9, B10, B13, B14, B17, B18, B19, B20, B21, B22, B23, and B24 are also non -perpendicular utility line impacts but do not require mitigation because there are no Zone 1 impacts. Impacts B8, B15, B25, B32, B33, and B35 are perpendicular sewer crossings that have a construction corridor (where applicable) of less than or equal to 40 linear feet and a permanent maintenance corridor equal to or less than 30 and therefore are considered "Deemed Allowable." Neither road crossing requires mitigation because impacts are not greater than a third of an acre of riparian buffer. SCM outlet impacts (131, B2, B7, and B26), are "Deemed Allowable" impacts as these are considered new drainage conveyances from primary SCM's. Impact B4 for a greenway trail is an "Allowable" activity. Mitigation is not required for the trail crossing as the trail is less than 10 feet in width and no built upon area greater than ten feet in width is proposed. Stormwater Management Plan The stormwater management plan consists of seven wet detention basin SCMs which provide a minimum of 30% nitrogen removal and therefore diffuse flow is not required. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down -gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http://www.fws.gov/raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. In 2013, an archaeological reconnaissance survey identified six archaeological sites (31WA1798 — 31WA1803) and the Watkins Cemetery (31WA1804) in the project area. None of the identified archaeological sites are eligible for listing in the National Register of Historic Places, and no further work is recommended in association with them. However, cemeteries are protected under North Carolina General Statutes Chapter 14-148 and 14-149 and are afforded consideration under NCGS Chapters 65 and 70. The Watkins Cemetery contains one engraved stone marking the burial of Mollie Watkins. An archaeological reconnaissance survey identified another burial marked with fieldstones adjacent to the grave of Mollie Watkins, and it is possible that additional graves without markers are present in the cemetery. We recommend that archaeological delineation of the cemetery be undertaken, including use of ground penetrating radar as appropriate. Alternately, a cemetery avoidance plan may be developed such that the portions of the subject project area with potential for containing unmarked graves are excluded from development, inclusive of an appropriate buffer area. The cemetery delineation report or avoidance plan should be forwarded to this office for review and comment prior to any ground disturbing activities within the project area. Please note that our office now requests consultation with the Office of State Archaeology Review Archaeologist to discuss appropriate field methodologies prior to the archaeological field investigation. Anti -seep collars may be constructed with class B concrete, compacted clay, PVC pipe, or metal collars. Wetland crossings that are directionally drilled, and perpendicular wetland crossings that are open cut and less than 150 feet long do not require anti -seep collars. The compacted clay shall have a specific infiltration of 1 X 10' cm/sec or less. See Water Quality General Certification No. 4256 for a section and plan view diagram for the anti -seep collars. During excavation, the soils shall be placed on fabric to minimize impacts whenever possible. Topsoil excavated from utility trenches will be piled separately from subsoils and will be backfilled into the trench only after the subsoils have been placed and compacted. Citation: 15A NCAC 02H.0506; 15A NCAC 02H.0507(c) Justification: Surface water quality standards require that conditions of waters be suitable for all best uses provided for in state rule (including, at minimum: aquatic life propagation, survival, and maintenance of biological integrity; wildlife; secondary contact recreation; agriculture); and that activities must not cause waterpollution thatprecludes any best use on a short-term or long-term basis. 11) All activities shall be in compliance with any applicable State Regulated Riparian Buffer Rules in Chapter 2B of Title 15A in the North Carolina Administrative Code. Citation: 15A NCAC 02H . 0506(b); 15A NCAC 02H . 0507(c) Justification: The referenced Riparian Buffer rules were adopted to address water quality impairments and further protect existing uses. 12) When applicable, all construction activities shall be performed and maintained in full compliance with G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Regardless of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management Practices for the control of sediment and erosion so that no violations of state water quality standards, statutes, or rules occur. Design, installation, operation, and maintenance of all sediment and erosion control measures shall be equal to or exceed the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual, or for linear transportation projects, the North Caroline Department of Transportation Sediment and Erosion Control Manual. All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites, including contractor -owned or leased borrow pits associated with the project. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. Reclamation measures and implementation shall comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971. If placed within authorized impact areas, then placement of such measures shall not be conducted in a manner that results in dis-equilibrium of any wetlands, streambeds, or streambanks. Any silt fence installed within wetlands shall be removed from wetlands and the natural grade restored within two (2) months of the date that DEMLR or locally delegated program has released the specific area within the project to ensure wetland standards are maintained upon completion of the project. Ensuring that in -stream structures are installed properly will ensure that surface water quality standards are met and conditions of waters are suitable for all best uses. 18) Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. If the width of the culvert is wider than the stream channel, the culvert shall include multiple boxes/pipes, baffles, benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels are used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they receive only flows above bankfull. Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48 inches, to allow low flow passage of water and aquatic life. Notification, including supporting documentation to include a location map of the culvert, culvert profile drawings, and slope calculations, shall be provided to DWR 30 calendar days prior to the installation of the culvert. When bedrock is present in culvert locations, culvert burial is not required, provided that there is sufficient documentation of the presence of bedrock. Notification, including supporting documentation such as a location map of the culvert, geotechnical reports, photographs, etc. shall be provided to DWR a minimum of 30 calendar days prior to the installation of the culvert. If bedrock is discovered during construction, then DWR shall be notified by phone or email within 24 hours of discovery. Installation of culverts in wetlands shall ensure continuity of water movement and be designed to adequately accommodate high water or flood conditions. When roadways, causeways, or other fill projects are constructed across FENIA-designated floodways or wetlands, openings such as culverts or bridges shall be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in destabilization of streams or wetlands. The establishment of native woody vegetation and other soft stream bank stabilization techniques shall be used where practicable instead of rip -rap or other bank hardening methods. All temporarily impacted sites shall be restored and stabilized with native vegetation. All rip -rap shall be placed such that the original streambed elevation and streambank contours are restored and maintained and shall consist of clean rock or masonry material free of debris or toxic pollutants. Placement of rip -rap or other approved materials shall not result in de -stabilization of the stream bed or banks upstream or downstream of the area or be installed in a manner that precludes aquatic life passage.
