8. PROJECT SUMMARY: The applicants propose to install a shared docking facility for a total of eight (8)
formalized slips.

9. PROJECT DESCRIPTION:
The project site is located at 327 and 331 Seabreeze Boulevard, adjacent to Masonboro Sound, in Wilmington,
New Hanover County. 331 Seabreeze Blvd. consists of a 1.17-acre parcel that is situated on land that is
approximately 15 feet above normal high water (NHW) and is vegetated with native grass. A small pond exists on
the eastern side of the property. A single-family residence is currently under construction. 327 Seabreeze Blvd.
consists of 3 parcels totaling approximately 8.72 acres. The property is 0-15 feet above NHW and is vegetated
with native hardwoods, shrubs, grass. Both properties transition from upland vegetation to §404 type vegetation
before coastal wetlands vegetation consisting of Black Needlemsh (Juncus roemarianus), Spike Grass (Distichlis
spicata), and Salt Meadow Grass (Spartina patens before transitioning to a large stretch of Smooth Cordgrass
(Spartina alternifolora). East of the stretch of Smooth Cordgrass exists an open -water bay that extends
approximately 280' wide with water depths of approximately 0 to 2' above Mean Low Water (MLW) based on
the provided hydrographic survey. The bay is filled with several oyster rocks. East of the bay, Smooth Cordgrass
exists before a sandy, beach area vegetated with Smooth Cordgrass and Glasswort (Salicornia spp.) before
reaching the open waters of Masonboro Sound and the Atlantic Intracoastal Waterway (AIW W). An old landing
exists through coastal wetlands at 327 Seabreeze Blvd. The landing extends approximately 175' east from the
high ground through coastal wetlands and consists primarily of old rip rap, bricks, and oyster shell. There are
remnant pilings from a docking facility that connected the landing to the shallow open water bay. The old landing
appears to pre -date 1970 NCDOT aerial photography but it is unclear when the docking facility was built. The
docking facility pre -dates 1999 Google Earth imagery. The docking facility appears to have been partially
destroyed in 2007 and only pilings exist by the September 2018 Google Earth aerial. No permit history was found
for the landing or the previous facility. The property is bordered by the south and north by single family
residences. The property is to the north has a pier that spans coastal wetlands to reach the AIW W that was
authorized in 2008 through State Permit #87-08. The joint shoreline length of the properties is approximately
250'. The property two parcels to the south currently have a proposed docking facility in CAMA Major Permit
review that would cross the same bay.
The Wilmington -New Hanover County Land Use Plan classifies the area as Resource Protection. The waters in this
location are classified as SA; ORW by the Division of Water Resources. The area IS designated as a Primary Nursery
Area (PNA) by the Division of Marine Fisheries appears that it is OPEN to the taking of shellfish.
10. PROPOSED PROJECT:
The applicants propose to install a shared docking facility for a total of eight (8) formalized slips. Extending from
the joint property line of 327 Seabreeze Blvd. and 331 Seabreeze Blvd., the applicants propose a 6' wide pier that
is 1,149' in length that would span approximately 630 linear ft. of coastal wetlands, the open -water bay,
approximately 180 linear ft. of oyster bed and the sandy beach area to reach the open water of Masonboro Sound
and the AIW W. A 10' wide span 4' above NHW is proposed approximately 630' from the beginning of the pier in
an attempt to not block public trust access (See Page 1 and 3 of 6). The water depths in the area of the proposed
span are 0' MLW.
As the proposed pier extends towards the AIW W, approximately 95' from the waterward edge of coastal
wetlands, the applicant proposes two single -pile jet ski lifts that measure approximately 5' wide by 10 on either
side of the pier. The applicant also proposes two 8' wide by 20' long floating docks that would be located
approximately 125' from the waterward edge of coastal wetlands. The proposed floating docks would be located
on either side of the pier and would run parallel to the AIWW. A proposed 16' long by 16' wide boat lift would
be located in the western (landward) slip of both floating docks. The pier would terminate at a 20' wide by 20'
long gazebo. Two additional 16' wide by 16' long boat lifts would be located on the northern and southern side of
the gazebo for a total of 8 formalized slips. (See Page 2 of 6)
According to provided hydrographic survey, the depth in the open water bay is 0' MLW or above in the project
area with the proposed 10' wide span being located in approximately the deepest area of the shallow bay. See the
shaded portion of the proposed pier on Page 1 of 6 for the location of the span. The proposed jet ski list would be
in water depths of approximately -2' NLW, the proposed western boat lifts would be in water depths of
approximately -T NLW, the proposed floating docks would be in water depths of approximately -10' NLW, and
the proposed eastern boat lifts would be in water depths of approximately -12' NLW. The NLW water depths
were verified by the provided hydrographic survey which appears to agree with the provided NLW depths. (See
Page 1 of and the hydrographic survey)

The proposed facility extends approximately 1,105' below NHW. The application utilizes both properties
shoreline and a joint riparian corridor. See the attached hydrographic survey for Mean Low Water depth
information and location of oyster beds.
11. ANTICIPATED IMPACTS:
The proposed docking facility would incorporate approximately 7,940 sq. ft. of Public Trust Area and Estuarine
Waters and shade approximately 3,800 sq. ft. of coastal wetlands. The structures would not encroach into either
15' riparian corridor setback. As proposed, the docking facility would not encroach into the USACE AIW W 80'
setback. The proposed structures would extend approximately 184' into the AIWW portion of the waterbody, in
an area that measures approximately 736' across. The proposed structures would accommodate up to eight (8)
vessels at this location within water depths of -2.34 to -I 1.84' relative to NLW. There are potential navigation
impacts for ingress/egress of the bay and the applicant has proposed a bridged portion of the fixed pier to try to
address navigation concerns.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for James and
Theresa Hoffman and Trenton Ganey and Ann Vinci, for State approval for development of the subject properties located
at 237 and 331 Seabreeze Boulevard, adjacent to the Masonboro Sound in New Hanover County. It was received as
complete on November 13, 2023 and appears to be adequate for processing at this time. The projected deadline for
making a decision is January 27, 2024. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you
should consider the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 13, 2023, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of
my field report and/or comments from reviewing agencies.

The Department of Environmental Quality hereby gives public notice as required by NCGS
113A-119(b) that the following applications were submitted for development permits in Areas of
Environmental Concern as designated under the CAMA: On November 14, 2023, Corbett Place
HOA proposed to expand an existing docking facility to accommodate ten (10) vessels, and
proposes excavation that includes the docking facility and existing tributary that provides access
to the main channel of Bradley Creek to a max of -4.5' MLW at 6602 Spring Garden Drive adj. to
Bradley Creek, in Wilmington, New Hanover County; On November 14, 2023, James and Theresa
Hoffman & Trenton Ganey & Ann Vinci proposed to install a shared dockingfacilityfor a total of
eight (8) slips at 327 and 331 Seabreeze Blvd, adj. to Masonboro Sound in Wilmington, New
Hanover County, And on November 14, 2023, Cedar Creek Basin Assoc., LLC proposed
maintenance excavation of an existing residential basin to a depth of-6'MLW and installation of
six channel markers at the end of Old Military Rd, adj. to Cedar Creek Basin in Wilmington, New
