Specifically, the errors consisted of the omission of a property owner, as the project will expand beyond the NCDOT ROW, as well incorrect assessment of the absence of Northern Long-Eared Bat habitat within the project area. Therefore, we are submitting the enclosed updated PCN, which has been revised to correct the errors. On behalf of Crosspointe Church at Cary, we are requesting authorization from the USACE to use NWP 14 for o.005 acres of permanent wetland impacts and 34 lf of permanent stream impacts for improvements to NC Hwy 55 at Indian Wells Road. We are also requesting a 401 WQC from NCDWR forthe above referenced impacts. The proposed project consists of the widening of 2,430 lf of NC Hwy 55 beginning at Indian Wells Road in Cary, Wake County (Latitude: 35•g1949o°N; Longitude: -7g•g7376o°W). The project is located in the Cape Fear River basin (HUC o3030002) and onsite waters drain to Panther Branch. The Water Quality Classification for Panther Creek is WS-V; NSW and the Stream Index Number is: 16-4i-1-17-3. Proposed Project The purpose of the proposed project is to widen 2,430 lf of NC Hwy 55 to extend a through lane that currently ends immediately south of Indian Wells Road. These improvements are a requirement by the Town of Cary as part of the approval of the expansion of the Crosspointe Church facilities, and are in accordance with the Town of Cary Transportation Plan. Project History James Lastinger with the Corps of Engineers field verified the wetland delineation, completed by S&EC, for location of the Hwy 55 improvements as part of the "Phillips Tract" project on January 17, zo14. Avoidance and Minimization The project consists of the widening of the NC Hwy 55 to extend an existing through lane. Therefore, design alternatives to further minimize impacts was not possible. Mitigation Because wetland impacts are less than o.10 acres, and stream impacts are less than 150 lf, no mitigation is proposed. The current request is for o.005 acres of permanent wetland impacts and 34 lf of permanent stream impacts (see the attached maps and PCN for details). W&R reviewed the NC Natural Heritage Program database, located at https://ncnhde.natureserve.org/contenUmap to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any occurrences of endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter. Site reviews did not identify any occurrences of, or potential habitat for, federally protected species known to occur in Wake County, except for the Northern Long Eared Bat. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The proposed improvements to NC 55 will extend beyond the cleared ROW into forested areas with trees over 3" DBH, and therefore, potential northern long eared bat habitat is present. In an email from USFWS dated April 15, 2015, the USFWS has specified that a project may result in an adverse effect on the NLEB is there will be cutting or destroying of mature forest within 0.25 miles of an known roosting site, or if the project involves the cutting or destroying of known, occupied roost trees during the pup season (June 1 S� — July 31St). The nearest known active roost tree site is in Currituck County. Therefore, the proposed project is not located within 0.25 miles of any known roost trees. Furthermore, clearing of mature forest between June 1 St and July 31 S� is not anticipated for construction of the proposed project. Therefore, W&R concludes that the project "may affect, but is not likely to adversely affecY' the northern long-eared bat. 6. Essential Fish Habitat (Corps Requirement) 6a.
