On behalf of Wake Technical Community College, we are applying for a 401
Water Quality Certification and Neuse River Basin Riparian Buffer
Authorization for temporary stream impacts and impacts to Zone 1 and Zone 2
of the Neuse Buffer associated with the proposed construction of a temporary
construction access path crossing the unnamed tributary to Mills Branch that
separates Parking Lots S and P to permit safe construction access and working
conditions as improvements are being completed to Parking Lot S and Parking
Lot P. The project site is located within the Neuse River Basin (HUC
03020201) and the unnamed tributary to Mills Branch has a NCDWR Water
Quality Classification of Class C and Nutrient Sensitive Waters. Construction
activities associated with the previously authorized improvements to Parking
Lots S and P have begun and classes at the campus are in session. Therefore,
we are hoping authorization of the proposed activities can be acquired as
expeditiously as possible. At this time, we are requesting that the proposed
construction of a temporary construction access path be authorized under
General Certification 3893 (Temporary construction, access and dewatering)

STREAM MAPPING: McAdams Company, Inc. conducted a jurisdictional
wetland and stream delineation of the Wake Technical Community College
main campus. Based on the delineation, the Wake Technical Community
College main campus contains unnamed tributaries to Mills Branch, which
discharge into the Neuse River (HUC 03020201). The unnamed tributaries to
Mills Branch have a NCDWR Water Quality Classification of Class C and
Nutrient Sensitive Waters. The main campus contains a total of 2,704 linear feet
of perennial and intermittent jurisdictional streams. No jurisdictional wetlands
were identified on the main campus. The U.S. Army Corps of Engineers
conducted a jurisdictional wetland /stream field determination on November 20,
2014 (SAW- 2014- 02128); however, the Jurisdictional Determination Plat has
not been signed yet. Based on the delineation, there are stream features located
on the main campus that are subject to the Neuse River Buffer Rules. NCDWR
conducted a field determination on November 5, 2014, and on November 19,
2014 provided a Neuse Buffer Determination (NBRRO #14 -402, attached).
PROJECT LOCATION /HABITAT: The areas are termed as Parking Lot S
(PIN Number: 0689804752) and Parking Lot P (PIN Number: 0689708713).
Parking Lot S is an existing gravel parking area located on the east side of the
main campus. Parking Lot P is an existing gravel parking area located on the
southwest side of the main campus. Approximately 80 percent of Parking Lot
P contains forested areas. Parking Lots S and P are separated by an unnamed
tributary to Mills Branch and associated forested areas.

The riparian buffer is mostly forested and consists of mainly loblolly pine
(Pinus taeda) and oak species (Quercus sp.), in addition to red maple (Acer
rubrum) and tulip poplar (Liriodendron tulipifera) with an understory of
Chinese privet (Ligustrum sinense) and greenbriar (Smilax rotundifolia). The
project site contains an unnamed tributary to Mills Branch, which discharges
into the Neuse River (HUC 03020201). The unnamed tributary to Mills Branch
has a NCDWR Water Quality Classification of Class C and Nutrient Sensitive
Waters. No jurisdictional wetlands were identified on the main campus.
Stream features "A" (perennial) and "D" (intermittent) are subject to the Neuse
River Buffer Rules.
Land use within the vicinity of the project site is a mix of institutional, multi-
family, light industrial- office, railroad, and forested areas.
PROPOSED PROJECT /IMPACTS: During the month of March, 2015,
Wake Technical Community College applied for a Neuse River Riparian Buffer
Authorization for permanent impacts to Zone 1 and Zone 2 of the Neuse Buffer
associated with the proposed improvements to the parking lot located within the
main campus and repaving of Parking Lots S and P, construction of stormwater
management facilities, construction of a new wooden pedestrian bridge
connecting Parking Lot S to Parking Lot P, and the establishment of a 20 foot
permanently maintained sanitary sewer easement. Authorization from DWR to
proceed with the proposed activities was received on May 21, 2015 (attached
DWR # 15- 0321). Classes are currently in session as construction activities for
the authorized activities are being performed. As a result, construction
equipment and vehicles are forced to travel the entire length of Parking Lots S
and P in order to conduct the authorized construction activities. This leads to
safety issues and concerns with students attending Wake Technical Community
College. Therefore, Wake Technical Community College proposes
constructing a temporary construction access path crossing the unnamed
tributary to Mills Branch that separates between Parking Lots S and P to permit
safe construction access and working conditions as the previously authorized
improvements are being completed. Following completion of construction
activities, the temporary construction access path will be removed in its entirety
to an area that has no waters of the U.S. and the affected area will be restored
to pre - construction elevations.

AVOIDANCE and MINIMIZATION: Proposed impacts to jurisdictional
streams and wetlands have been avoided and minimized to the maximum extent
practicable for the proposed activities. School is currently in session as
construction activities for the previous authorized activities are being
performed (previous authorized activities described in attached DWR # 15-
0321, May 21, 2015). As a result, construction equipment and vehicles are
forced to travel the entire length of Parking Lots S and P in order to conduct the
previously authorized construction activities. This leads to safety issues and
concerns with students attending Wake Technical Community College.
Therefore, avoiding impacts to the unnamed tributary to Mills Branch is not
feasible due to safety concerns associated with the current school session.
Additional alternative locations alignments were examined for the temporary
construction access path. However, it was determined that these additional
locations either impacted more stream or more riparian buffers. The proposed
location of the temporary construction access path impacts the least amount of
stream and riparian buffers in addition to providing the needed ease of
construction access to conduct the previously authorized activities.
DIFFUSE FLOW: Proper sedimentation and erosion control methods will be
utilized during construction in accordance with the NC Division of Land
Quality and City of Raleigh guidelines. All work will take place during dry
conditions and can be facilitated from high, non - jurisdictional, stable ground.
The contractor shall install silt fence, inlet protection, sediment traps, diversion
ditches, tree protection, clearing only as necessary to install devices. All
erosion and sediment control measures will be checked for stability and

operation following every runoff producing rainfall, but in no case less than
once every week. Any needed repairs will be made immediately to maintain all
measures designed. An erosion control inspections report is required and will
be kept by the owner's representative. Temporary seeding and permanent
seeding plans are included to restore impacted areas
STORMWATER MANAGEMENT: The proposed temporary construction
access path is required to permit safe construction access and working
conditions as the previously authorized improvements are being completed.
The previously authorized improvements associated with the issued
Authorization Certificate per the Neuse River Basin Riparian Buffer Protection
Rules (attached DWR # 15 -0321; May 21, 2015) contained stormwater
management facilities per the Wake County Design Tool which include a
stormwater wetland, wet pond, level spreaders, and vegetative filter strips.
Wake County has approved the stormwater management plan (see attached
SWCPA; Project number S -4185 & 5 -3211; Approval Date May 27, 2015).
MITIGATION: All buffer impacts are deemed "Allowable" under the Neuse
River Riparian Buffer Rules — 'Table of Uses. Therefore, no riparian buffer
mitigation is proposed. All stream impacts are temporary in nature. Following
completion of construction activities, the temporary construction access path
will be removed in its entirety to an area that has no waters of the U.S. and the
affected area will be restored to pre - construction elevations. Therefore, no
stream mitigation is proposed.

2. No Waste, Spoil. Solids, or Fill of Anv Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre - Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur [15A NCAC 02H .0501
and .0502].
3. Protective Fencing
All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the
construction area on the project site shall be clearly marked (example- orange fabric
fencing) prior to any land disturbing activities and must be maintained on the property until
the project phase is completed. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A NCAC 02H
.0507 (c)]
4. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Buffer
Authorization. If you change your project, you must notify the Division and you may be
required to submit a new application package with the appropriate fee. If the property is
sold, the new owner must be given a copy of this approval letter and is responsible for
complying with all conditions.
5. This approval and its conditions are final and binding unless contested. [G.S. 143 - 215.5]

3a Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: Improvements to Parking Lot S (PIN Number 0689804752) and Parking Lot P (PIN Number
0689708713) are currently ongoing and under construction. Parking Lots S and P are separated by an unnamed
tributary to Mills Branch and associated forested areas.

2,704 linear feet of jurisdictional streams located at the Wake Technical Community College — Main campus.
3d Explain the purpose of the proposed project: The purpose of the project is to construct a temporary construction access
path crossing the unnamed tributary to Mills Branch that separates Parking Lots S and P to permit safe construction access
and working conditions as improvements are being completed to Parking Lot S and Parking Lot P.
3e Describe the overall project in detail, including the type of equipment to be used: During the month of March, 2015, Wake
Technical Community College applied for a Neuse River Riparian Buffer Authorization for permanent impacts to Zone 1
and Zone 2 of the Neuse Buffer associated with the proposed improvements to the parking lot located within the main
campus and repaving of Parking Lots S and P, construction of stormwater management facilities, construction of a new
wooden pedestrian bridge connecting Parking Lot S to Parking Lot P, and the establishment of a 20 foot permanently
maintained sanitary sewer easement. Authorization from DWR to proceed with the proposed activities was received on
May 21, 2015 (attached DWR # 15- 0321). Classes are currently in session as construction activities for the authorized
activities are being performed. As a result, construction equipment and vehicles are forced to travel the entire length of
Parking Lots S and P in order to conduct the authorized construction activities. This leads to safety issues and concerns
with students attending Wake Technical Community College. Therefore, Wake Technical Community College proposes
constructing a temporary construction access path crossing the unnamed tributary to Mills Branch that separates between
Parking Lots S and P to permit safe construction access and working conditions as the previously authorized improvements
are being completed. Following completion of construction activities, the temporary construction access path will be
removed in its entirety to an area that has no waters of the U.S. and the affected area will be restored to pre- construction
elevations. Typical construction equipment will be used for Phase I, such as a front end loaders, bulldozers, and paving
equipment.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Proposed impacts to
jurisdictional streams and wetlands have been avoided and minimized to the maximum extent practicable for the proposed
activities. School is currently in session as construction activities for the previous authorized activities are being performed
(previous authorized activities described in attached DWR # 15 -0321, May 21, 2015). As a result, construction equipment and
vehicles are forced to travel the entire length of Parking Lots S and P in order to conduct the previously authorized
construction activities. This leads to safety issues and concerns with students attending Wake Technical Community College.
Therefore, avoiding impacts to the unnamed tributary to Mills Branch is not feasible due to safety concerns associated with the
current school session. Additional alternative locations alignments were examined for the temporary construction access path.
However, it was determined that these additional locations either impacted more stream or more riparian buffers. The
proposed location of the temporary construction access path impacts the least amount of stream and riparian buffers in
addition to providing the needed ease of construction access to conduct the previously authorized activities.
1 b Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Proper
sedimentation and erosion control methods will be utilized during construction in accordance with the NC Division of Land
Quality and City of Raleigh guidelines. All work will take place during dry conditions and can be facilitated from high, non -
jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, tree
protection, clearing only as necessary to install devices. All erosion and sediment control measures will be checked for
stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs
will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept
by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas.
